On August 1, 2011, Chris Matthews, host of MSNBC’s “Hardball,” wrapped up his program with a search for “options” to avoid another round of Republican extortion tactics:
“I want to know what steps the president [Barack Obama] ‘could’ have taken to avoid this hostage-taking [over raising the debt-ceiling].
“…Is there another way than either buckling to the Republicans or letting the government and the country crash?
“How does he use the power of the presidency, the logic, emotion and basic patriotism of the people to thwart those willing to threaten, disrupt, even possibly destroy to get their way?”
And the answer to his questions–then and now–is: Replace the law of fear with the rule of law.
As Niccolo Machiavelli, the father of modern politics, instructed future leaders in The Prince:

Niccolo Machiavelli
“And men have less scruple in offending one who makes himself loved than one who makes himself feared; for love is held by a chain of obligations which, men being selfish, is broken whenever it serves their purpose; but fear is maintained by a dread of punishment which never fails….
“I conclude, therefore, with regard to being loved and feared, that men love at their own free will, but fear at the will of the prince, and that a wise prince must rely on what is in his power and not on what is in the power of others….”
Instead, in 2011, President Barack Obama surrendered to Republican extortion demands. As a result, the United States suffered a massive loss to its international credit rating.
But there were two other ways Obama could have stood up to Republican extortionists:
- Invoke the Racketeer Influenced Corrupt Organizations Act (RICO) and/or the USA Patriot Act;
- Rally the American people against this criminal threat to the security of the Nation.
And these remain available to him now–if only he has the courage to act.
Second Option: Calling upon the American people for their support
President John F. Kennedy did just that–successfully–during the most deadly crisis of his administration.
Addressing the Nation on October 22, 1962, Kennedy shocked his fellow citizens by revealing that the Soviet Union had placed offensive nuclear missiles in Cuba.

President John F. Kennedy
After outlining a series of steps he had taken to end the crisis, Kennedy sought to reassure and inspire his audience. His words are worth remembering today:
“The cost of freedom is always high, but Americans have always paid it. And one path we shall never choose, and that is the path of surrender or submission.”
Just as President Kennedy called on his fellow Americans for support against a foreign enemy, President Obama could rally his countrymen against an equally ruthless domestic enemy.
During such a national address, President Obama could reveal such blunt truths as:
- Republicans have adopted the same my-way-or-else “negotiating” stance as Adolf Hitler.
- Like the Nazis, they are determined to gain absolute power–or destroy the Nation they claim to love.
- And, once again, they are threatening to shut down the government–and deny essential services to millions of Americans–unless they get their way.
Finally, President Obama could end his speech by directly calling for the active support of his fellow Americans. Something like this:

President Barack Obama
“My fellow Americans, I have taken an oath to ‘preserve, protect and defend the Constitution of the United States.’
“But I cannot do this on my own. As citizens of a Republic, each of us carries that burden. We must each do our part to protect the land and the liberties we love.
“Tonight, I’m asking for your help.
“We stand on the edge of economic and social disaster. Therefore, I am asking each of you to stand up for America tonight–by demanding the recall of the entire membership of the Republican Party.”

The 1938 Munich Conference taught an invaluable lesson in foreign affairs: Caving in to the demands of insatiable thugs leads to only more demands.
That was what British Prime Minister Neville Chamberlain learned when he sought to appease Adolf Hitler, Germany’s war-intent Fuehrer.

Neville Chamberlain greets Adolf Hitler
Chamberlain believed that by giving in to Hitler’s demands for the “German part” of Czechoslovakia known as the Sudetenland he could avoid war.
On September 29, Chamberlain and French Prime Minister Edouard Daladier met with Hitler and signed the Munich Agreement, resulting in the immediate German occupation of part of Czechoslovakia.
The Czechoslovakian government had not been a party to the talks. Their “allies” had sold them out.
In a matter of weeks, Hitler turned his attention–and demands–to Poland.
When his generals balked, warning that invading Poland would trigger a war with France and Britain, Hitler brushed aside their fears: “Our enemies are little worms. I saw them at Munich.”
Chamberlain returned to England a hero. Holding aloft a copy of the worthless agreement he had signed with Hitler, he told cheering crowds in London: “I believe it is peace for our time.”
Winston Churchill knew better, predicting: “Britain and France had to choose between war and dishonor. They chose dishonor. They will have war.”
And so they did.
It is not too late for President Barack Obama to apply this lesson from history.

On July 9, 2011-–Republican extortionists again threatened the Nation with financial ruin and international disgrace unless their demands were met.
President Obama had offered to make historic cuts in the Federal Government and the social safety net–on which millions of Americans depend for their most basic needs.
And the Republican response?
Said Rep. Darrell Issa, chairman of the Oversight and Government Reform Committee:“Quite frankly, [Republican] members of Congress are getting tired of what the president won’t do and what the president wants.”
Noted political analyst Chris Matthews summed up the sheer criminality of what happened within the House of Representatives.
Speaking on MSNBC’s “Hardball,” on July 28–five days before Congress reached its August 2 deadline to raise the debt-ceiling–Matthews noted:
“The first people to bow to the demands of those threatening to blow up the economy were the Republicans in the House, the leaders. The leaders did what the followers told them to do: meet the demands, hold up the country to get their way.

Chris Matthews
“Those followers didn’t win the Senate, or the Presidency, just the House.
“But by using the House they were able to hold up the entire United States government. They threatened to blow things up economically and it worked.
“They said they were willing to do that–just to get their way–not by persuasion, not by politics, not by democratic government, but by threatening the destruction of the country’s finances.
“Right. So what’s next? The power grid? Will they next time threaten to close down the country’s electricity and communications systems?”
With the United States teetering on the brink of national bankruptcy, President Obama faced three choices:
- Counter Republican extortion attempts via RICO–the Racketeer Influenced Corrupt Organizations Act.
- Make a “Cuban Missile Crisis”-style address to the American people, seeking to rally them against a criminal threat to the financial security of the Nation.
- Cave in to Republican demands.
Unfortunately for Obama and the Nation, he chose Number Three.
The results were easily predictable: Emboldened by success, the extortionists continue to make even greater demands.
Such as those now being made: De-fund Planned Parenthood or we’ll destroy the country.
But this is a nightmare that doesn’t have to be.
There are, in fact, two ways to avoid it.
Assuming that President Obama doesn’t once again surrender to Republican extortion demands, he has two formidable weapons he can deploy:
First Option: RICO to the rescue
The Racketeer Influenced Corrupt Organizations (RICO) Act is a provision of the Organized Crime Control Act of 1970. It authorizes prosecution for acts performed as part of an ongoing criminal organization.
It has been applied to not only the Mafia but to individuals, businesses, political protest groups, and terrorist organizations. In short, a RICO claim can arise in almost any context.
Such as the one President Barack Obama faced in 2011 when Republicans threatened to destroy the credit rating of the United States unless their budgetary demands were met.
And such as the present case when Republicans are again threatening the security of the Nation with extortionate demands.
RICO opens with a series of definitions of “racketeering activity” which can be prosecuted by Justice Department attorneys. Among those crimes: Extortion.

Extortion is defined as “a criminal offense which occurs when a person unlawfully obtains either money, property or services from a person(s), entity, or institution, through coercion.”
The RICO Act defines “a pattern of racketeering activity” as “at least two acts of racketeering activity, one of which occurred after the effective date of this chapter and the last of which occurred within ten years…after the commission of a prior act of racketeering activity.”
And if President Obama believes that RICO is not sufficient to deal with extortionate behavior, he can rely on the USA Patriot Act of 2001, passed in the wake of 9/11.
In Section 802, the Act defines domestic terrorism. Among the behavior that is defined as criminal:
“Activities that…appear to be intended…to influence the policy of a government by intimidation or coercion [and]…occur primarily within the territorial jurisdiction of the United States.”
Republicans are now demanding that Democrats de-fund Planned Parenthood or be forced to shut down essential services needed by millions of Americans.
That clearly falls within the legal definition of “activities…intended…to influence the policy of a government by intimidation or coercion.”
The remedies for punishing such criminal behavior are now legally in place. President Obama need only direct the Justice Department to apply them.
President Obama can direct Attorney General Loretta E. Lynch to investigate whether Republican Congressman—and their Tea Party cohorts—have violated Federal anti-racketeering and/or anti-terrorism laws.
- Lynch can order the FBI to conduct such an investigation.
- If the FBI finds sufficient evidence that these laws had been violated, Holder can empanel criminal grand juries to indict those violators.
Criminally investigating and indicting members of Congress would not violate the separation-of-powers principle. Congressmen have in the past been investigated, indicted and convicted for various criminal offenses.
Such indictments and prosecutions–and especially convictions–would serve a truly cleansing function.
They would serve notice on current and future members of Congress that the safety and fortunes of American citizens may not be held hostage as part of a negotiated settlement.

Republicans love fetuses.
In fact, they love them so much they’re willing to shut down the Federal Government and deny vital public services to millions of their fellow Americans.
That shutdown could be coming as early as September, when Congress returns from its summer break.
The reasons are two-fold:
First, the fast-approaching 2016 Presidential election; and
Second, Republicans’ long-standing desire to de-fund Planned Parenthood (PP).

This upcoming effort will be fueled by a highly emotional charge: That PP sells fetal tissue and organs.
Anti-abortion organizations Operation Rescue and the Center for Medical Progress recently released videos purporting to show PP officials discussing such sales.
In response, PP said that they may donate fetal tissue at the request of a patient, but that fetal organs and tissues are never sold.
Three Congressional committees are now making inquiries into PP practices.
On August 3, 2015, a Republican bill to defund PP failed to pass in the Senate. Currently, the organization receives $528 million in Federal funding each year.
Since the 1980s, Congressional Republicans have tried to de-fund PP. Their efforts almost led to a government shutdown in 2011.
PP has consistently claimed that it does not use its Federal funding to pay for abortion services. But anti-abortionists argue that Federal monies free up other resources that are used to provide abortions.
Abortions represent three percent of total services provided by PP, and are provided to about 10% of its clients.

The other 97% of services are for contraception, treatment and tests for sexually transmitted diseases, cancer screenings, and other women’s health services.
PP estimates that its contraceptive services prevent approximately 612,000 unintended pregnancies–and 291,000 abortions–annually.
According to Politico, Republican Senators plan to attach a provision to the current omnibus spending bill–which funds all Federal agencies for 2015-2016.
The provision will ban funding for all Federal agencies–unless PP’s funding is cut.
Leading the call for a government shutdown is Texas Senator Ted Cruz, who tried to de-fund PP in 2013. That attempt led to a two-week government shutdown.

Senator Ted Cruz
Joining Cruz are Republicans in the House and Senate—not enough to defund PP, but enough to deny vitally-needed services to millions of Americans.
The reason for the 2013 government shutdown? Republicans were enraged that millions of uninsured Americans might receive medical care on a par with that given members of the House and Senate.
It was, in short, yet another Right-wing effort to eliminate the Affordable Care Act, better-known as “Obamacare.”
So on September 20, 2013, the House of Representatives voted on a short-term government funding bill that included a provision to de-fund Obamacare.
That provision was a no-go for Senate Democrats and President Barack Obama. When the House and Senate couldn’t reach a compromise, many functions of the Federal government shut down on Oct. 1.
The shutdown lasted for 16 days and cost the United States economy $2 to $6 billion in economic output, according to the Office of Management and Budget.
It ended when President Obama and Senate Democrats refused to submit to Republican blackmail. Medical care still remained available to millions of poor and middle-class Americans.
Republicans have repeatedly threatened to shut down the government unless their constantly escalating demands were met.
In November, 1995, Newt Gingrich, then Speaker of the House of Representatives, carried out this threat.
The official reason: Republicans objected to Democratic President Bill Clinton’s budgetary requests for funding Medicare, education, the environment and public health in the 1996 Federal budget.
The real reason: Gingrich unwisely admitted that he was angry because Clinton had put him in the back of Air Force One during a recent trip to Israel.
The shutdown proved a disaster for Republicans. Clinton was handily re-elected in 1996 and Gingrich suddenly resigned from Congress in 1998.
In April, 2011, the United States government almost shut down again over Republican demands about subsidized pap smears.
During a late-night White House meeting with President Obama and key Congressional leaders, Republican House Speaker John Boehner made this threat:
His conference would not approve funding for the government if any money were allowed to flow to Planned Parenthood through Title X legislation.
Facing an April 8 deadline, negotiators worked day and night to strike a compromise–and finally reached one.
Three months later–-on July 9, 2011-–Republican extortionists again threatened the Nation with financial ruin and international disgrace unless their demands were met.

Sign of The Black Hand extortion group
President Obama had offered to make historic cuts in the Federal Government and the social safety net–on which millions of Americans depend for their most basic needs.
But House Speaker John Boehner rejected that offer. He could not agree to the tax increases that Democrats wanted to impose on the wealthiest 1% as part of the bargain.

John Boehner
As the calendar moved ever closer to the fateful date of August 2, Republican leaders continued to insist: Any deal that includes taxes “can’t pass the House.”
President Obama had previously insisted on extending the debt ceiling through 2012. But in mid-July, he simply asked congressional leaders to review three options with their members:
- The “Grand Bargain” choice—favored by Obama–would cut deficits by about $4 trillion, including spending cuts and new tax revenues.
- A medium-range plan would aim to reduce the deficit by about $2 trillion.
- The smallest option would cut between $1 trillion and $1.5 trillion, without increased tax revenue or any Medicare and Medicaid cuts.
And the Republican response?

President Obama claims to be a serious student of Realpolitick. If this were so, he would have predicted that most businesses would seek to avoid compliance with his Affordable Care Act (ACA).
And the remedy would have been simple: Require all employers to provide insurance coverage for all of their employees, regardless of their fulltime or part-time status.
This, in turn, would have produced two substantial benefits:
- All employees would have been able to obtain medical coverage; and
- Employers would have been encouraged to provide fulltime positions rather than part-time ones.
The reason: Employers would feel: “Since I’m paying for fulltime insurance coverage, I should be getting fulltime work in return.”
If the President ever considered the merits of this, he apparently decided against pressing for such a requirement.
Obama is one of the most rational and educated men to occupy the White House. So what accounts for this failure to expect the worst in people–especially his self-declared enemies–and prepare to counter it?
Niccolo Machiavelli’s brilliant assessments have repeatedly proven invaluable to understanding the failures of the Obama Presidency. Once again, he provides a shrewd insight into what may be the central reason for all of them.

Niccolo Machiavelli
Writing in The Prince, his classic work on the realities of politics, Machiavelli states:
I also believe that he is happy whose mode of procedure accords with the needs of the times, and similarly, he is unfortunate whose mode of procedure is opposed to the times….
On this depend also the changes in prosperity, for if it happens that time and circumstances are favorable to one who acts with caution and prudence he will be successful. But if time and circumstances change he will be ruined, because he does not change the mode of his procedure.
No man can be found so prudent as to be able to adopt himself to this, either because he cannot deviate from that to which his nature disposes him, or else because having always prospered by walking in one path, he cannot persuade himself that it is well to leave it.
And therefore the cautious man, when it is time to act suddenly, does not know how to do so and is consequently ruined. For if one could change one’s nature with time and circumstances, fortune would never change.
Obama is by nature a supreme rationalist and conciliator–not a confronter nor an attacker. And his career before reaching the White House greatly strengthened this predisposition.
From 1985 to 1988, Obama worked as a community organizer–setting up a job training program, a college preparatory tutoring program, and a tenants’ rights organization. Such activity demands skills in building consensus, not confrontation.
He then taught at the University of Chicago Law School for 12 years—as a Lecturer from 1992 to 1996, and as a Senior Lecturer from 1996 to 2004, teaching constitutional law.

University of Chicago Law School
Law professors spend their time in clean, civil classrooms–far removed from the rough-and-tumble of criminal defense/prosecution.
If Obama had accused President George W. Bush of conspiring with Al Qaeda–as Republicans have repeatedly accused Obama–retribution would have been swift and brutal.
In short: Obama–who believes in reason and conciliation–is paying the price for allowing his sworn enemies to insult and obstruct him
Obama Mistake No. 6: Failing to closely study his proposed legislation.
Throughout his campaign to win support for the ACA, Obama had repeatedly promised: “If you like your health insurance plan, you can keep your plan. Period. If you like your doctor, you can keep your doctor. Period.”
But, hidden in the 906 pages of the law, was a fatal catch for the President’s own credibility.
The law stated that those who already had medical insurance could keep their plans–so long as those plans met the requirements of the new healthcare law.
If their plans didn’t meet those requirements, they would have to obtain coverage that did.
It soon turned out that a great many Americans wanted to keep their current plan–even if it did not provide the fullest possible coverage.
Suddenly, the President found himself facing a PR nightmare: Charged and ridiculed as a liar.
Even Jon Stewart, who on “The Daily Show” had supported the implementation of “Obamacare,” ran footage of Obama’s “you can keep your doctor” promise.

Jon Stewart
The implication: You said we could keep our plan/doctor; since we can’t, you must be a liar.
As a result, the President now finds his reputation for integrity–long his greatest asset–shattered.
All of which takes us to the final warning offered by Niccolo Machiavelli:
Whence it may be seen that hatred is gained as much by good works as by evil….

Barack Obama is one of the most highly educated Presidents to occupy the White House.
When he took office, he intended to make healthcare available to all Americans–and not just the wealthiest 1%.

President Barack Obama
But he made a series of deadly mistakes:
- In crafting the Affordable Care Act (better known as Obamacare);
- In building public support for it;
- In underestimating the venom and opposition of his Republican enemies;
- In failing to effectively counter that Right-wing venom and opposition; and
- In underestimating the opposition of the business community to complying with the law.
Three of those mistakes have already been outlined. Here are the remaining three.
Obama Mistake No. 4: He allowed himself to be cowed by his enemies.
In The Prince, Machiavelli laid out the qualities that a successful ruler must possess. There were some to be cultivated, and others to be avoided at all costs. For example:

Niccolo Machiavelli
He is rendered despicable by being thought changeable, frivolous, effeminate, timid and irresolute—which a prince must guard against as a rock of danger….
[He] must contrive that his actions show grandeur, spirit, gravity and fortitude. As to the government of his subjects, let his sentence be irrevocable, and let him adhere to his decisions so that no one may think of deceiving or cozening him.
So how has Obama fared by this standard?
On July 2, 2013, the Treasury Department issued a press release about a major change in the applicability of the Affordable Care Act:
“Over the past several months, the Administration has been engaging in a dialogue with businesses – many of which already provide health coverage for their workers – about the new employer and insurer reporting requirements under the Affordable Care Act (ACA).
“We have heard concerns about the complexity of the requirements and the need for more time to implement them effectively….We have listened to your feedback. And we are taking action.
“The Administration is announcing that it will provide an additional year before the ACA mandatory employer and insurer reporting requirements begin.”
[Boldface in the original document.]
In short: The administration is delaying until 2015 the law’s requirement that medium and large companies provide coverage for their workers or face fines.
And how did Obama’s self-declared enemies react to this announcement?
On July 30, House Republicans voted to proceed with a lawsuit against the President, claiming that he had failed to enforce the Affordable Care Act.
“In 2013, the president changed the health care law without a vote of Congress, effectively creating his own law by literally waiving the employer mandate and the penalties for failing to comply with it,” House Speaker John A. Boehner said in a statement.
“That’s not the way our system of government was designed to work. No president should have the power to make laws on his or her own.”

John Boehner
Thus, Boehner intends to sue the President to enforce the law that the House has voted 54 times to repeal, delay or change.
Obama Mistake Nol 5: Believing that public and private comployers would universally comply with the law.
The Affordable Care Act requires employers to provide insurance for part-time employees who work more than 30 hours per week.
Yet many government employers claim they can’t afford it–and plan to limit worker hours to 29 per week instead. Among those states affected:
- “Our choice was to cut the hours or give them health care, and we could not afford the latter,” Dennis Hanwell, the Republican mayor of Medina, Ohio, said in an interview with the New York Times.
- Lawrence County, in western Pennsylvania, reduced the limit for part-time employees to 28 hours a week, from 32.
- In Virginia, part-time state employees are generally not allowed to work more than 29 hours a week on average over a 12-month period.
President Obama and those who helped craft the Act may be surprised at what has happened. But they shouldn’t be.
Greed-addicted officials will always seek ways to avoid complying with the law–or achieve minimum compliance with it.
And what goes for public employers goes for private ones, too.
A company isn’t penalized for failing to provide health insurance coverage for part-time employees who work fewer than 30 hours.
The result was predictable. And its consequences are daily becoming more clear.
Increasing numbers of employers are moving fulltime workers into part-time positions–and thus avoiding
- providing their employees with medical insurance and
- a fine for non-compliance with the law.
Some employers have openly shown their contempt for President Obama–and the idea that employers actually have an obligation to those who make their profits a reality.
One of these is John Schnatter, CEO of Papa John’s Pizza, who has been quoted as saying:
- The prices of his pizzas will go up–by eleven to fourteen cents price increase per pizza, or fifteen to twenty cents per order; and
- He will pass along these costs to his customers.
“If Obamacare is in fact not repealed,” Schnatter told Politico, “we will find tactics to shallow out any Obamacare costs and core strategies to pass that cost onto consumers in order to protect our shareholders’ best interests.”
After all, why should a multi-million-dollar company show any concern for those who make its profits a reality?

In The Prince, his classic treatise on Realpolitick, Niccolo Machiavelli, the Florentine statesman, warned:
“There is nothing more difficult to carry out, nor more doubtful of success, nor more dangerous to handle, than to initiate a new order of things.”
This proved exactly the case with the proposed Affordable Care Act (ACA). Its supporters–even when they comprised a majority of the Congress–have always shown far less fervor than its opponents.
This was true before the Act became effective on March 23, 2010. And it has remained true since, with House Republicans voting 54 times to repeal, delay or revise the law.
So before President Barack Obama launched his signature effort to reform the American medical system, he should have taken this truism into account.
Obama Mistake No. 3: Failing to consider–and punish–the venom of his political enemies.
The ancient Greeks used to say: “A man’s character is his fate.” It is Obama’s character–and our fate–that he is by nature a conciliator, not a confronter.
Richard Wolffe chronicled Obama’s winning of the White House in his book Renegade: The Making of a President. He noted that Obama was always more comfortable when responding to Republican attacks on his character than he was in making attacks on his enemies.
Obama came into office determined to find common ground with Republicans. But they quickly made it clear to him that they only wanted his political destruction.
At that point, he should have put aside his hopes for a “Kumbaya moment” and re-read what Niccolo Machiavelli famously said in The Prince on the matter of love versus fear:

From this arises the question whether it is better to be loved than feared, or feared more than loved. The reply is, that one ought to be both feared and loved, but as it is difficult for the two to go together, it is much safer to be feared than loved.
For it may be said of men in general that they are ungrateful, voluble, dissemblers, anxious to avoid danger and covetous of gain.
As long as you benefit them, they are entirely yours: they offer you their blood, their goods, their life and their children, when the necessity is remote. But when it approaches, they revolt….
And men have less scruple in offending one who makes himself loved than one who makes himself feared; for love is held by a chain of obligations which, men being selfish, is broken whenever it serves their purpose; but fear is maintained by a dread of punishment which never fails.
Moreover, Machiavelli warns that even a well-intentioned leader can unintentionally bring on catastrophe. This usually happens when, hoping to avoid conflict, he allows a threat to go unchecked. Thus:
A man who who wishes to make a profession of goodness in everything must inevitably come to grief among so many who are not good.
And therefore it is necessary, for a prince, who wishes to maintain himself, to learn how not to be good, and to use this knowledge and not use it, according to the necessity of the case.
For President Obama, such a moment came in October, 2013, when House Republicans shut down the government to force Obama to scrap Obamacare.
Obama, a former attorney, heatedly denounced House Republicans for “extortion” and “blackmail.”
Unless he was exaggerating, both of these are felony offenses that are punishable under the 2001 Patriot Act and the Racketeer Influenced Corrupt Organizations (RICO) Act of 1970.

All that he needed do was to order his Attorney General, Eric Holder, to ask the FBI to investigate whether either or both of these laws have been violated.
If violations had been discovered, indictments could have quickly followed– and then prosecutions.
The results of such action can be easily predicted.
- Facing lengthy prison terms, those indicted Republicans would first have to lawyer-up. That in itself would have been no small thing, since good criminal lawyers cost big bucks.
- Obsessed with their own personal survival, they would have found little time for engaging in more of the same thuggish behavior that got them indicted. In fact, doing so would have only made their conviction more likely.
- Those Republicans who hadn’t (yet) been indicted would have realized: “I could be next.” This would have produced a chilling effect on their willingness to engage in further acts of subversion and extortion.
- The effect on Right-wing Republicans would have been the same as that of President Ronald Reagan’s firing of striking air traffic controllers: “You cross me and threaten the security of this nation at your own peril.”
It would no doubt be a long time before Republicans dared to engage in such behavior–if they ever so dared again.
So: Why didn’t the President act to punish such criminal conduct?

A majority of Americans–53%–disapprove of the Affordable Care Act (ACA), better known as Obamacare.
So says a July healthcare tracking poll of the Henry J. Kaiser Family Foundation, a non-profit organization focusing on national health issues
This is clearly a plus/minus situation for President Barack Obama.
On the positive side: According to the Department of Health and Human Services, Obamacare enrollment has cut the number of uninsured people in the nation by 10 million.
On the negative side: Obamacare has always had weak support among the American public. Among the reasons for this:
- Constant Republican attacks labeling the law as “socialistic” (by which they mean “communistic”).
- Public opposition to the individual mandate that almost everyone obtain coverage.
- Many Americans think they can’t afford the insurance sold on the Obamacare exchanges–and don’t know that financial aid is available.
Among the poll’s findings:
- Sixty percent of the public wants Congress to improve the Affordable Care Act, not repeal and replace it.
- Thirty-eight percent were unaware that the Act offers consumers a choice among private health plans.
- Less than half of those polled–47%–say they have discussed the law with friends or family.
- Of that 47%, a majority–27%–say they’ve heard more bad than good about the law in these conversations.
- Healthcare isn’t a top priority for Americans right now–except for medical care for veterans (71%).
Among those issues the public does rate as highly important:
- Economy and jobs (70%)
- Federal budget deficit (68%)
- Education (66%)
- Social Security (65%)
- Illegal imigration (61%)

Barack Obama is easily one of the most highly educated Presidents in United States history.
He is a graduate of Columbia University (B.A. in political science in 1983).
In 1988, he entered Harvard Law School, graduating magna cum laude–“with great honor”–in 1991. He was selected as an editor of the Harvard Law Review at the end of his first year, and president of the journal in his second year.

President Barack Obama
He then taught constitutional law at the University of Chicago Law School for 12 years—as a Lecturer from 1992 to 1996, and as a Senior Lecturer from 1996 to 2004.
So where did he go so wrong? Several ways:
Obama Mistake No. 1: Putting off what people wanted while concentrating on what they didn’t.
Obama started off well when he took office. Americans had high expectations of him.
This was partly due to his being the first black elected President. And it was partly due to the disastrous legacies of needless war and financial catastrophe left by his predecessor, George W. Bush.
Obama entered office intending to reform the American healthcare system, to make medical care available to all citizens, and not just the richest.
But that was not what the vast majority of Americans wanted him to concentrate his energies on. With the loss of 2.6 million jobs in 2008, Americans wanted Obama to find new ways to create jobs.
This was especially true for the 11.1 million unemployed, or those employed only part-time.
Jonathan Alter, who writes sympathetically about the President in The Center Holds: Obama and His Enemies, candidly states this.
But Obama chose to spend most of his first year as President pushing the Affordable Care Act (ACA)–which soon became known as Obamacare–through Congress.
The results were:
- Those desperately seeking employment felt the President didn’t care about them.
- The reform effort became a lightning rod for Right-wing groups like the Tea Party.
- In 2010, a massive Rightist turnout cost the Democrats the House of Representatives, and threatened Democratic control of the Senate.
Obama Mistake No. 2: He underestimated the amount of opposition he would face to the ACA.
For all of Obama’s academic brilliance and supposed ruthlessness as a “Chicago politician,” he has displayed an incredible naivety in dealing with his political opposition.
Niccolo Machiavelli (4169-1527), the Florentine statesman and father of modern politics, could have warned him of the consequences of this–through the pages of his famous treatise on the realities of politics: The Prince.

Niccolo Machiavelli
And either Obama skipped those chapters or ignored their timeless advice for political leaders.
He should have started with Chapter Six: “Of New Dominions Which Have Been Acquired By One’s Own Arms and Ability”:
…There is nothing more difficult to carry out, nor more doubtful of success, nor more dangerous to handle, than to initiate a new order of things.
For the reformer has enemies in all those who profit by the old order, and only lukewarm defenders in all those who would profit by the new order, this lukewarmness arising partly from fear of their adversaries, who have the laws in their favor, and partly from the incredulity of mankind, who do not truly believe in anything new until they have had actual experience of it.

“Hitler gave good speeches, too.”
That’s what many Right-wingers say in disparaging the oratorical effectiveness of President Barack Obama.
It’s a slogan that’s misleading on two counts.
First, the people saying it are exactly the type who would have voted for Adolf Hitler. And who vote for his wannabe dictatorial successors such as Joseph McCarthy, Newt Gingrich and Ted Cruz.
Second, the slogan dismisses the power of language–as though words are entirely divorced from action. On the contrary: Words–effectively used–can and usually do lead to action.
A classic example: During the desperate months of the Battle of Britain and the London Blitz, Prime Minister Winston Churchill’s soaring rhetoric armed his fellow Englishmen with the will to resist Nazi aggression.
The truth is, words matter. For good and ill.
Republicans, for example, have long used the power of language to gain and hold power.
Take their use of the phrase, “the death tax.”
The correct term used to be “the estate tax.” And it applied to a relatively small number of citizens who die leaving large estates.
But Republicans, struggling to make the world a better place for the ultra-rich, convinced millions of ignorant voters who don’t have estates that the tax applies to them.
The result: A Republican-introduced bill to the House of Representatives–“The Death Tax Repeal Act of 2013.”
Its goal: “To amend the Internal Revenue Code of 1986 to repeal the estate and generation-skipping transfer taxes, and for other purposes.”
In short: Relieve the ultra-rich from the unfair burden of paying taxes.
So far, the bill has not been passed.
Or take the 2001 “USA Patriot Act,” which did pass by overwhelming margins after 9/11.
Republicans crammed this full of Orwellian changes they knew Democrats wouldn’t like–such as vastly expanding the powers of the National Security Agency to collect files on American citizens.
So how did they get Democrats to support it?
By calling it the “Patriot Act.” By choosing this title, Republicans easily put Democrats on the defensive.

Anyone who dared oppose the bill would be attacked: “Why don’t you support the Patriot Act? Are you unpatriotic?”
The Left has also made use of language to obtain its political objectives.
Consider the highly popular and Politically Correct term, “People of color.”
This is used by blacks, Hispanics, Asians and American Indians when referring to members of their own particular ethnic group.
On the other hand, members of these groups become enraged if they’re referred to as “colored people.”
But what’s the difference? It’s like saying “jeans of blue” instead of “blue jeans.”
And, in either case, it totally hides what they really mean: “Nonwhites.”
Because to the Politically Correct crowd, “white” is not a color. Which is another way of saying, “Whites aren’t really part of the population.”
And here’s another Leftist-language achievement: “The Dream Act.”
This is a phrase conjured up by those who essentially want to remove all barriers to illegal immigration–at least as it applies to those mostly in Mexico and other Latin and Central American countries.
Its effectiveness lies in the magical word “dream.” As in the Walt Disney Cinderella song: “A Dream is a Wish Your Heart Makes.”
Thus, the United States now has millions of illegal aliens (the Left prefers to call them “immigrants,” which sounds nicer) who claim to cherish their Mexican heritage and love their native land.
But if they cherish Mexico so much, why have so many of these “Dreamers” fled this “paradise”?
And why is their “dream” to never live in Mexico again?
A final word: At election time, the TV airways are clogged with ads supposedly sponsored by “Citnzens for….”
As in: “Citizens for a Responsible Energy Policy.”
Whenever you see the word “citizens for” or “people for” in a televised ad, don’t believe it.
The only “citizens” who can afford to blitz the airways with millions oof dollars’ worth of propaganda are “citizens” who own wealthy corporations.
And when you read/hear words like “responsible,” watch out: Who is defining what as responsible?
When greed-based companies are the ones defining responsible, it means: Whatever creates greater profits for them.
You know, like gutting environmental protection laws and allowing behemoth corporations to pay no taxes.
So keep that in mind the next time you see a slick ad that claims your fellow “citizens” seek your support on an important issue.

The media has given wall-to-wall coverage of the Federal Government shutdown–and the effects it has had on both Federal employees and ordinary Americans.
But there is one aspect of this story that hasn’t been covered. In fact, it is so obvious that I can only conclude that editors are deliberately ignoring it.
President Barack Obama, a former attorney, has denounced House Republicans as guilty of “extortion” and “blackmail.”
Unless he was exaggerating, both of these are felony offenses that are punishable under the 2001 Patriot Act and the Racketeer Influenced Corrupt Organizations Act of 1970.
So: Why hasn’t the President acted to punish such criminal conduct?

All that he need do is to order his Attorney General, Eric Holder, to ask the FBI to investigate whether either or both of these laws have been violated. If it’s discovered that they have, indictments could immediately follow, and then prosecutions.
The results of such action can be easily predicted.
- Facing lengthy prison terms, those indicted Republicans would first have to lawyer-up. That in itself would be no small thing, since good criminal lawyers cost big bucks.
- Obsessed with their own personal survival, they would find little time for engaging in more of the same thuggish behavior that got them indicted. In fact, doing so would only make their conviction more likely.
- Those Republicans who hadn’t (yet) been indicted would realize: “I could be next.” This would produce a chilling effect on their willingness to engage in further acts of subversion and extortion.
- The effect on Right-wing Republicans would be the same as that of President Reagan’s firing of striking air traffic controllers: “You cross me and threaten the security of this nation at your own peril.”
It would no doubt be a long time before Republicans dared to engage in such behavior–if they ever so dared again.
Had Obama done so when Republicans began threatening to shut down the government and destroy the country’s credit rating unless they got their way, this crisis would now be past.
In fact, if he had warned, months ago, that he would react to such terroristic behavior with indictments and prosecutions, it’s highly unlikely that this crisis would have occurred.
With major Republicans like House Speaker John Boehner and Senator Ted Cruz facing prosecution and imprisonment, the rest of the party would have quickly found a way to pass a budget and ensure that the United States pays its debts.
The ancient Greeks used to say: “A man’s character is his fate.” It is Obama’s character–and our fate–that he is by nature a conciliator, not a confronter.
Richard Wolffe chronicled Obama’s winning of the White House in his book Renegade: The Making of a President. He noted that Obama was always more comfortable when responding to Republican attacks on his character than he was in making attacks of his own.

Niccolo Machiavelli
From this arises the question whether it is better to be loved than feared, or feared more than loved. The reply is, that one ought to be both feared and loved, but as it is difficult for the two to go together, it is much safer to be feared than loved.

And therefore it is necessary, for a prince, who wishes to maintain himself, to learn how not to be good, and to use this knowledge and not use it, according to the necessity of the case.
Of course, it’s possible that some prosecuted Republicans might beat the rap. But this wouldn’t happen until they had been forced to spend huge amounts of time and money on their defense.
And, with 75% of Americans saying they are disgusted with Congress, it’s highly likely that most of those prosecuted would wind up convicted.
And, as Andrew Jackson once said: “One man with courage makes a majority.”

For a half-century, Republicans have been damning the very government they lust to control.
Consider this choice comment from Mitt Romney supporter Ted Nugent:
“I spoke at the NRA and will stand by my speech. It’s 100 percent positive. It’s about we the people taking back our American dream from the corrupt monsters in the federal government under this administration, the communist czars he [President Barack Obama] has appointed.”
Romney, of course, refused to disavow the slander Nugent cast over every man and woman working on behalf of the American people.
Romney and his fellow Republicans salivate at every vile charge they can hurl at the very government they lust to control.
As in the case of Senator Joseph McCarthy, no slander is too great if it advances their path to power.
But there are others–living or at least working in Washington, D.C.–who simply go about their jobs with quiet dedication. And they leave slanderous, self-glorifying rhetoric to Right-wing politicians.
One of these unsung heroes was Stephen Tyrone Johns, a security guard at the United States Holocaust Memorial Museum.

On June 10, 2009, Johns, 39, was shot and killed by James Wenneker von Brunn, a white supremist and Holocaust denier. Brunn was himself shot and wounded by two other security guards who returned fire.
While in jail awaiting his trial, von Brunn–who was 88–died on January 6, 2010.
To work in Washington, D.C., is to realize that this city ranks–with New York City–at the top of Al Qaeda’s list of targets.
No one knows this better than the agents of the United States Secret Service, who protect the President, Vice President, their families and the White House itself 24 hours a day.

Prior to 9/11, visiting the White House was assumed to be an American right. No longer.
Today, if you want to tour the Executive Mansion, you quickly learn there are only two ways to get in:
- Through a special pass provided by your Congressman; or
- By someone connected with the incumbent administration.
Congressmen, however, have a limited number of passes to give out. And most of these go to people who have put serious money into the Congressman’s re-election campaigns.
And the odds that you’ll know someone who works in the White House–and who’s willing to offer you an invitation–are even smaller than those of knowing a Congressman.
But even that isn’t enough to get you through the White House door.
You’ll have to undergo a Secret Service background check. And that requires you to submit the following information in advance of your visit:
- Name
- Date of birth
- Birthplace
- Social Security Number
And be prepared to leave a great many items at your hotel room. Among these:
- Cameras or video recorders
- Handbags, book bags, backpacks or purses
- Food or beverages, tobacco products, personal grooming items (i.e. makeup, lotion, etc.)
- Strollers
- Cell phones
- Any pointed objects
- Aerosol containers
- Guns, ammunition, fireworks, electric stun guns, mace, martial arts weapons/devices, or knives of any size
Visitors enter the White House–after showing a government-issued ID card such as a driver’s license–from the south side of East Executive Avenue.
After passing through the security screening room, they walk upstairs to the first door and through the East, Green, Blue, Red and State Dining rooms.
Secret Service agents quietly stand post in every room–unless they’re tasked with explaining the illustrious history of each section of the White House.
Like everyone else who lives/works there, the Secret Service fully appreciates the incredible sense of history that radiates throughout the building.
This is where
- Abraham Lincoln signed the Emancipation Proclomation;
- Franklin Roosevelt directed the United States to victory in World War II;
- John F. Kennedy stared down the Soviets during the Cuban Missile Crisis.

But even the generally unsmiling Secret Service agents have their human side.
While touring the East Wing of the White House, I asked an agent: “Is the East Room where President Nixon gave his farewell speech?” on August 9, 1974.
“I haven’t been programmed for that information,” the agent joked, inviting me to ask a question he could answer.
Another guest asked the same agent if he enjoyed being a Secret Serviceman.
To my surprise, he said that this was simply what he did for a living. His real passion, he said, was counseling youths.
“If you love something,” he advised, “get a job where you can do it. And if you can’t get a job you’re passionate about, get a job so you can pursue your passion.”
Of the more than 2.65 million civilian employees of the executive branch, more than 800,000 have been sent home without pay.
These men and women aren’t faceless “bureaucrats,” as Right-wingers would have people believe. They are hustands and wives, fathers and mothers. They have bills to pay, just like everyone else.
Many of them, such as agents of the FBI and Secret Service, have taken an oath to defend the United States Constitution–with their lives if necessary.
And they now face the dread of going for weeks or even months without a paycheck–as pawns in another Right-wing case of: “My way or no way.”
They deserve a better break–and so do all those who cherish liberty.

FETUS FANATIC TERRORISM: PART THREE (END)
In Bureaucracy, History, Law, Politics, Social commentary on August 10, 2015 at 12:41 amOn August 1, 2011, Chris Matthews, host of MSNBC’s “Hardball,” wrapped up his program with a search for “options” to avoid another round of Republican extortion tactics:
* * * * *
