YOUR FRIENDS AS YOUR WORST ENEMIES: PART THREE (END)

Two suggestions for interviewees with a dark secret to hide:     

First: Don’t give interviews to journalists you like. (Or, in the case of Fox News, pseudo-journalists.) 

Second: Don’t give interviews at 4 A.M. 

Why?

Because you’re less likely to be on guard with a friendly journalist—and thus reveal truths you will later regret spilling.

And because at 4 A.M. you’re likely so tired or keyed up you make the same mistake.

Part One of this series spotlighted such a slip-up by Kevin McCarthy (R-Bakersfield, CA) on September 30, 2015.

In just 51 words, McCarthy revealed that the House Select Committee on Benghazi was not a legitimate investigative body. Its real purpose was to sabotage the expected Presidential candidacy of Hillary Clinton.

In doing so, McCarthy unintentionally sabotaged his own chances of becoming Speaker of the House when the then-Speaker, John Boehner, retired 

Part Two of this series showed how Donald Trump made a similar mistake on September 21, 2022. 

Appearing on the Right’s favorite television network, Fox News, Trump thoroughly embarrassed himself.

He was facing investigation for illegally removing classified government documents when he left the White House on January 20, 2021, and storing them at his private club, Mar-a-Lago, in Palm Beach, Florida.

Once again, Trump asserted he had done nothing wrong: “If you’re the President of the United States, you can declassify just by saying, ‘It’s declassified.’ Even by thinking about it, because you’re sending it to Mar-a-Lago or to wherever you’re sending it.”

Not only was this blatantly untrue, it was so outlandish that late-night talk show hosts had a comedic field day with it.

And still Republican politicians refuse to learn.

Latest case in point: House Oversight Committee Chairman James Comer (R-KY).

Comer made the same mistake as McCarthy and Trump—letting the public in on an embarrassing secret—with an added twist. He did so at 4 A.M. on May 22.

Speaking—you guessed it—on Fox News, Comer unintentionally admitted weaponizing his investigative committee to aid Donald Trump’s Presidential ambitions.

Fox News host Ashley Strohmier threw out a comforting softball question: “We have talked to you about this on the show, about how the media can just not ignore this any longer. In an op-ed in The Washington Post, it says, ‘Millions Flowed to Biden Family Members. Don’t Pretend It Doesn’t Matter.’

“So do you think that because of your investigation, that is what’s moved this needle with the media?”

Comer, whose committee has been relentlessly investigating Hunter Biden, the son of President Joseph Biden, leaped to answer:

“Absolutely. There’s no question. You look at the polling, and right now Donald Trump is seven points ahead of Joe Biden and trending upward, Joe Biden’s trending downward.

“And I believe that the media is looking around, scratching their head, and they’re realizing that the American people are keeping up with our investigation.” 

His claim that Trump has a seven-point edge over Biden stems from an ABC News/Washington Post survey in early May. But other surveys show Biden leading, and polling generally indicates a tight race between Biden and Trump.

In fact, there is little evidence that House GOP investigations of Biden’s family are having a negative effect on Biden’s political standing. Biden’s approval rating remains low, but surveys show little indication that the Comer-led investigations have had a major effect one way or another.

On May 10, Republicans claimed that President Biden’s family members received millions in suspicious money transfers before Biden became president.

But despite promises of a bombshell revelation, the new evidence Republicans displayed did not directly implicate Biden. 

Comer said that bank records obtained through subpoenas showed that the President’s son Hunter Biden, his brother James Biden and his son Beau’s widow, Hallie Biden, received payments totaling more than $10 million from foreign sources, including from individuals aligned with the Chinese Communist Party.

Comer didn’t say that the President himself received any payments or that he performed an official act in exchange for his family members receiving the money. 

Rep. Jamie Raskin (D-MD.), the committee’s top Democrat, said Comer had failed to provide evidence substantiating his claims of wrongdoing by Biden.

“He continues to bombard the public with innuendo, misrepresentations, and outright lies, recycling baseless claims from stories that were debunked years ago,” said Raskin.

Even before Republicans won control of the House on November 8, 2022, they openly admitted their upcoming investigations would target political opponents and influence public opinion for the 2024 elections 

On August 10, 2022, Rep. Jim Jordan (R-OH): “So, all these things need to be investigated just so you have the truth, plus that will help frame up the 2024 race, when I hope and I think President Trump is going to run again and we need to make sure that he wins.” 

And on October 26, James Comer said: “There are a lot of factors that are going to prevent Joe Biden from running. His age, the results of the midterm elections in two weeks. But also his son. Look, this Biden family investigation’s only going to ramp up in a Republican majority.” 

Not since the notorious reign of Wisconsin Senator Joseph R. McCarthy have Congressional Republicans been so open about their all-consuming drive for all-encompassing power.

YOUR FRIENDS AS YOUR WORST ENEMIES: PART TWO (OF THREE)

Donald Trump—before, during and after his Presidency—has always preferred “journalists” who toss him softball questions and repeatedly pay homage to him.   

Such a “journalist” is Sean Hannity, host of the Fox Network’s Sean Hannity Show.

On September 21, 2022, Hannity—who had “interviewed” Trump on many other occasions—did so again.

From the outset, he made his intentions clear: To exonerate Trump—who is now facing multiple civil and criminal investigations—from all accusations.     

Hannity opened by attacking Trump’s longtime foe, New York Attorney General Letitia James:

“Take a look at New York Attorney General Letitia James. Now, today she filed a lawsuit against Donald Trump and three of his children and other entities, claiming that they inflated the value of the Trump Organization. It is nothing short of a very obvious political stunt. It is not a criminal case. It is a civil case….

“Now, the attorney general isn’t even trying to hide her efforts to weaponize justice in New York State. Her conduct is deeply unethical at best.”

Then Hannity moved on to other “Trump haters”:

“But she’s not alone, you know, from the Trump haters on Capitol Hill, high-ranking deep state bureaucrats in the DOJ, the FBI. Now we have witnessed, going on many years, the 45th President has been the subject of what is non-stop, never-ending legal scrutiny focused not on a specific crime but on the man himself.”

Then he moved on—inevitably—to attacking former Secretary of State and 2016 Presidential candidate Hillary Clinton:  

“And, by the way, the President can declassify any of these documents—unlike, for example, Secretary of State Hillary Clinton, she cannot.

“Still, she stored 110 classified documents on unsecured private servers. Hillary Clinton was never forced to endure a federal raid. She was never charged with any crime.”

Hannity then ran a clip of former FBI Director James Comey saying of Clinton: “Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case.”

But Hannity did not say that Trump, on becoming President, fired Comey for investigating the proven ties between Trump’s Presidential campaign and operatives for Russian president Vladimir Putin.

All of this undoubtedly made Trump feel vindicated and comfortable. Too comfortable, as matters turned out.

When Trump left the White House on January 20, 2021, he illegally took highly-classified government documents to his private club, Mar-a-Lago, in Palm Beach, Florida.

On August 8, 2022, FBI agents searched Mar-a-Lago to recover those documents. Among those retrieved: Eleven sets of classified documents, four of them tagged as “Top Secret” and one as “Top Secret/SCI,” the highest level of classification.

Continuing to exonerate Trump, no matter what the offense, Hannity said: “OK. You have said on Truth Social a number of times you did declassify—”

TRUMP: “I did declassify.”

HANNITY: “OK. Is there a process—what was your process to declassify?”

TRUMP: “There doesn’t have to be a process, as I understand it. You know, there’s—different people say different things, but as I understand there doesn’t have to be.

“If you’re the President of the United States, you can declassify just by saying, ‘It’s declassified.’ Even by thinking about it, because you’re sending it to Mar-a-Lago or to wherever you’re sending it.”

Not even Trump’s attorneys have dared to make such an argument. Not when they demanded a “Special Master” to comb through the seized documents—allegedly so those that belonged to Trump could be returned to him.

Nor did they make such an assertion when, before Special Master Judge Raymond Dearie, they refused to state the process by which Trump had allegedly declassified the documents.

The media—and Trump’s many enemies—quickly seized upon this mind-blowing claim. Late-night TV hosts in particular milked it for laughs.

The Daily Show host Trevor Noah:  How could Trump “declassify documents with his brain” when he couldn’t even “read documents with his brain?”

“If Trump actually had the power to change things just by thinking about them,” joked Jimmy Kimmel, “Don Jr. would have turned into a Big Mac 30 years ago.”  

Nor did Kimmel pass up the opportunity to stick a barb into Hannity: “His approach was basically, ‘Show me on the doll where the FBI investigated you.’ I mean you have to hand it to Sean. When life gives him felons, he makes felon-ade!”

On a serious level, Trump’s outlandish assertion is liable to hurt his—or his attorneys’—appearances before various state and federal judges. 

More than 500 years ago, Niccolo Machiavelli, the father of modern politics, warned that a prince must guard against being taken lightly—and, worse, expose himself to ridicule.

In his book, The Prince, Machiavelli writes: “…He ought….to pay attention to [guilds and classes], mingle with them from time to time, and give them an example of his humanity and munificence, always upholding, however, the majesty of his dignity, which must never be allowed to fail in anything whatever.”

It’s hard to be taken seriously when you claim supernatural powers denied to other, mere mortals. 

YOUR FRIENDS AS YOUR WORST ENEMIES: PART ONE (OF THREE)

It’s a truth well-known to cross-examining attorneys: The best way to obtain the truth is often to “kill your opponents with kindness.”

Witnesses always expect the opposing counsel to immediately start SCREAMING at them. But that only causes the witness to stay alert and say as little as possible.

So the smart attorney comes on as courteous, friendly, even sympathetic.

A classic example of this: A laborer claimed to have permanently injured his shoulder in a railway accident, leaving him unable to work. He claimed he could no longer raise his arm above a point parallel with his shoulder.

The railway’s attorney asked him a few sympathetic questions about his injuries. And the witness quickly volunteered that he was in constant pain and a near-invalid.

“And, as a result of the accident, how high can you raise your arm?” asked the attorney.

The witness slowly raised his arm parallel with his shoulder.

“Oh, that’s terrible,” said the attorney.

Then: “How high could you get it up before the accident?”

Unthinkingly, the witness extended his arm to its full height above his head—to the laughter of the judge, jury and spectators.

Case dismissed.

In politics, sometimes your best friends turn out to be your worst enemies.

Kevin McCarthy proved this during his September 30, 2015 appearance on Fox News.

McCarthy, the Republican member of the House of Representatives from Bakersfield, California, was undoubtedly feeling relaxed.

After all, he wasn’t being interviewed by such “enemies” of the Right as The New York Times or MSNBC political commentator Rachel Maddow.

He was being interviewed by Sean Hannity, a Right-wing political commentator whose books included Conservative Victory: Defeating Obama’s Radical Agenda and Deliver Us From Evil: Defeating Terrorism, Despotism, and Liberalism.

The topic under discussion: Who would be the next Republican Speaker of the House, now that John Boehner had announced his decision to leave not only the Speakership but the House itself in November?

Now Hannity wanted to know what would happen when the next Republican Speaker took office. And McCarthy—who was in the running for the position—was eager to tell him.

“What you’re going to see is a conservative Speaker, that takes a conservative Congress, that puts a strategy to fight and win.

“And let me give you one example. Everybody thought Hillary Clinton was unbeatable, right?

“But we put together a Benghazi special committee. A select committee. What are her [poll] numbers today? Her numbers are dropping. Why? Because she’s untrustable. But no one would have known that any of that had happened had we not fought to make that happen.”

In 51 words, McCarthy revealed that:

  • The House Select Committee on Benghazi was not a legitimate investigative body.
  • Its purpose was not to investigate the 2012 deaths of four American diplomats during a terrorist attack in Benghazi, Libya.
  • Its real purpose was to destroy the Presidential candidacy of Hillary Clinton.
  • To accomplish this, its members spent 17 months and wasted more than $4.5 million of American taxpayers’ funds.

On October 8, 2015, Republicans were expected to choose their nominee for Speaker. On that same date, McCarthy announced that he was withdrawing his name from consideration:

“Over the last week it has become clear to me that our Conference is deeply divided and needs to unite behind one leader. I have always put this Conference ahead of myself. Therefore I am withdrawing my candidacy for Speaker of the House.”

When reporters asked McCarthy if his revelation was the reason he withdrew, he replied, “Well, that wasn’t helpful.”

But then he quickly replayed the official Republican version: “But this Benghazi committee was only created for one purpose: to find the truth on behalf of the families for the four dead Americans.”

On October 29, 2015, Republicans—holding the majority of House members–elected Paul Ryan, (Wisconsin) the 54th speaker of the United States House of Representatives.

Democrats and Republicans were united in their anger that the real reason for the Benghazi “investigation” had been revealed.

Democrats were furious that McCarthy, in an unguarded moment, had revealed that their major Presidential candidate had been the victim of a Republican smear campaign disguised as a legitimate inquiry.

And Republicans were furious that McCarthy, in an unguarded moment, had revealed that the “legitimate inquiry” had been nothing more than a Republican smear campaign.

For McCarthy, the Benghazi Committee had legitimately served the nation—not by uncovering relevant details about a terrorist act but by causing Hillary Clinton’s poll numbers to drop.

In 1981, President Ronald Reagan had attacked the leaders of the Soviet Union thusly: “They reserve unto themselves the right to commit any crime, to lie, to cheat.”

McCarthy’s comments demonstrated that the Republican Party had adopted the same mindset and tactics as the dictators of the former Soviet Union.

Almost seven years after Kevin McCarthy revealed himself and his party as ruthless hypocrites, Republicans suffered a similar outbreak of truth.

But this time, the stakes were higher—involving Donald J. Trump, the former President of the United States.

“HAPPY NEWS” DIDN’T SAVE HITLER–OR TRUMP

THE WHITE HOUSE IS PROPPING UP A DEPRESSED TRUMP WITH TWO FOLDERS OF PROPAGANDA A DAY

So read an August 8, 2017 headline on the PoliticusUSA website.

The story opened:

“Donald Trump receives two folders of screen grabs, transcripts, and pictures of himself looking strong each day as the White House using the communications office to compile propaganda that makes Trump feel better.”

It then quoted Vice News as stating:

Twice a day since the beginning of the Trump administration, a special folder is prepared for the president. The first document is prepared around 9:30 a.m. and the follow-up, around 4:30 p.m.

“Former Chief of Staff Reince Priebus and former Press Secretary Sean Spicer both wanted the privilege of delivering the 20-to-25-page packet to President Trump personally, White House sources say.

“These sensitive papers, described to VICE News by three current and former White House officials, don’t contain top-secret intelligence or updates on legislative initiatives.

“Instead, the folders are filled with screenshots of positive cable news chyrons (those lower-third headlines and crawls), admiring tweets, transcripts of fawning TV interviews, praise-filled news stories, and sometimes just pictures of Trump on TV looking powerful.”

Anonymous sources told Vice that Priebus and Spicer created this “happy news” smorgasbord to boost their own standings:

“Priebus and Spicer weren’t in a good position, and they wanted to show they could provide positive coverage. It was self-preservation.” 

But it didn’t save  Priebus and Spicer. On July 28, 2017, Priebus resigned—after suffering repeated humiliations by Trump—such as being ordered to kill a fly that was buzzing about.

And, on July 21, 2017, Spicer angrily resigned after Trump chose Anthony Scaramucci as White House Communications Director. Trump kept Spicer in the dark about events that he needed to know. 

At 6 a.m. every weekday, three staffers arrived at the Republican National Committee’s “war room.” Their mission: Scour newspapers and the Internet and monitor MSNBC, Fox News and CNN. About every 30 minutes, they sent the White House Communications Office an email with tweets, screenshots, interview transcripts and news stories.

“Maybe it’s good for the country that the President is in a good mood in the morning,” one former RNC official said.

Creating folders of “happy news” to prop up Trump’s fragile ego was a practice unique to the Trump administration.

“If we had prepared such a digest for Obama, he would have roared with laughter,” said David Axelrod, the senior adviser to Barack Obama during his first two years in the White House. “His was a reality-based presidency.”

Trump devours praise like a sugar addict consumes candy. He frequently tweeted his thanks to cable television hosts like Sean Hannity, Lou Dobbs, and the hosts of “Fox & Friends” who lavishly praised his administration.  

But Trump is hardly unique among world leaders to listen only to “happy news.”

During World War II, as his armies were forced to retreat on all fronts, Adolf Hitler increasingly demanded that his ministers refrain from “defeatist talk.”

Hoping for victory and stating that it was inevitable became the key to saving one’s job—if not life—in the steadily-declining Third Reich. Countless Germans who refused to embrace Hitler’s fantasies were executed for “defeatism.”

This was best illustrated by the case of Albert Speer. Hitler had often proclaimed him “my genius architect” before appointing him Minister of Armaments in 1942. As Speer revved up the production of military hardware, Hitler continued to hail his “genius.”

But as Allied bombing raids increasingly devastated Germany’s industrial plants, armaments production began to fall. This forced Speer to tell his Fuhrer the unpalatable truth: Germany was losing its capacity to wage war.

Hitler didn’t want to hear it, turning instead to those who fed him a diet of “happy news.”  When Speer’s deputy, Karl Otto Saur, told Hitler, “By Christmas, we’ll have air superiority!” Hitler was ecstatic.

At a meeting with his generals, the Fuhrer announced: “We have the good fortune to have a genius in our armaments ministry.  I mean Saur.”

The promised air superiority never materialized.

As even Hitler came to realize that the end was near, he blamed Germany for losing the war he had started.

“If the war is lost,” Hitler told Speer, “the nation will also perish….This nation will have proved to be the weaker one and the future will belong solely to the stronger eastern nation.”

He ordered a massive “scorched-earth” campaign throughout Germany.

All German agriculture, industry, ships, communications, roads, food stuffs, mines, bridges, stores and utility plants were to be destroyed.

It would have deprived the entire German population of even the barest necessities after the war.

Fortunately for Germany, Speer dared to sabotage the “Nero Order,” thus ensuring a future for those who survived the war.

Hitler’s demands for only “happy news” did not save him—or his regime.

As the COVID-19 casualties increasingly rose among Americans, Trump demanded ever more “happy news” from Federal health officials charged with combating the disease.

It didn’t save him from the anger of 80 million voters fed up with his lies and criminality.

And it will not save those Americans who substitute wishful thinking for reality.

LIES FOR A TYRANT–IN THE FACE OF DEATH

COVID-19 has so far stricken 6.9 million Americans and caused 185,000 deaths. The virus is raging across the country.

The “miracle economy” that President Donald Trump has often boasted of creating has all but vanished as Americans stay home and/or employers lay off employees.

Still, Right-wing Americans refuse to admit the virus is real, wear masks or socially distance from others.

Typical of these is Trish Regan, host of Trish Regan Primetime on the Fox Business Network. On March 9, she attacked not the virus but those who didn’t stand behind Trump:

“We’ve reached a tipping point. The hate is boiling. Many in the liberal media are using Coronavirus in an attempt to demonize and destroy the President, despite the virus originating halfway around the world.

“This is yet another attempt to impeach the President. And sadly, it seems the left cares little for any of the destruction they leave in their wake, including losses in the stock market. This, unfortunately, is all just part of the political casualties for them.

“This is impeachment all over again. And like with the Mueller investigation, like with Ukraine-gate, they don’t care who they hurt. Whether it be their need to create mass hysteria to encourage a market sell-off unlike anything we’ve seen recently, or whether it be to create mass hysteria to stop our economy dead in its tracks, don’t kid yourself. They told us how much they crave a recession as a way to get rid of Donald Trump.”

To make certain no one in the television audience missed the point, an electronically generated caption read: “Coronavirus Impeachment Scam.”

On the same day that Regan accused Trump’s critics of being haters, Trump himself was directing hate through his weapon of choice: Twitter: 

“The Fake News Media and their partner, the Democrat Party, is doing everything within its semi-considerable power (it used to be greater!) to inflame the CoronaVirus situation, far beyond what the facts would warrant. Surgeon General, ‘The risk is low to the average American.’”

Actually, with the virus spreading quickly throughout at least 33 states, the risk is not low to the average American. It is not the news that’s fake, but the lies and ignorance Trump is spouting.

And: “Now the Democrats are trying to smear Bernie with Russia, Russia, Russia. They are driving him Crazy!”

National security officials had warned that Russia—through its state-owned media—was trying to sow social media agitation and disinformation within the United States. The goal: To ensure that Vermont Senator Bernie Sanders won the Democratic nomination for President. 

According to these officials, Russian President Vladimir Putin believed Sanders would be far easier for Trump—his preferred candidate—to beat in November.

During the 2016 Presidential race, Trump openly called on “Russia”—i.e., Vladimir Putin—to “find the 33,000 emails that are missing [from Democratic Presidential candidate Hillary Clinton’s computer]. I think you will probably be rewarded mightily by our press.”

Hours later, the Main Intelligence Directorate in Moscow targeted Clinton’s personal office and hit more than 70 other Clinton campaign accounts.

And still more from Trump: “The Obama/Biden Administration is the most corrupt Administration in the history of our Country!”

This was a lie. President Barack Obama was never the subject of a Congressional or Special Prosecutor investigation—unlike Trump, who was impeached last December by the House of Representatives but acquitted by a majority-Republican Senate in February.

Making matters worse for Trump: Since taking office, he had claimed responsibility for the success of the stock market. 

On August 28, 2018, appearing on “Fox and Friends,” Trump had boasted: “I tell you what, if I ever got impeached, I think the market would crash, I think everybody would be very poor.” 

And now the market—owing to fears of Coronavirus and Trump’s failures to stem it—was tanking.

On Facebook, a NYMAG.COM story on Trish Regan’s rant ignited the following reactions:

Are these Fox News people asses or what? The entire country of Italy is shut down because of this virus. The virus doesn’t give a fat rat’s ass about Trump or impeachment. Just about spreading and infecting.” 

And: “OMG. Someone needs to sue Fox News. News is supposed to be factual reported events. I saw a news clip from Fox suggesting this is blown out of proportion by the democrats just to hurt Trump. Idiots, I used to work for the CDC (Centers for Disease Control & Prevention). Better listen to what they say. The President lies…. Sue Fox News for libel.”  

The truth is that people like Trish Regan are not asses. Assuming they are allows them to skirt responsibility for the lies and slanders they hurl—and the consequences these bring.

They know what they’re doing—and that is to keep in power a Russian-supported tyrant by any means at hand.

And since the truth won’t help them they resort to lies—even if untold numbers of trusting Americans follow their “advice” and become victims of a raging and deadly virus.

WHEN HATERS BECOME WHINERS

THE WITNESS IS THE ENEMY: PART TWO (END)

Donald Trump has a longstanding hatred of whistleblowers when they betray his crimes and follies. But he feels completely different about “flippers” when their revelations serve his interests.

On July 22, 2016, Wikileaks released 19,252 emails and 8,034 attachments hacked from computers of the highest-ranking officials of the Democratic National Committee (DNC).

The leak revealed a DNC bias for Hillary Clinton and against her lone challenger, Vermont United States Senator Bernie Sanders. Clinton, who was about to receive the Democratic nomination for President, was thoroughly embarrassed. Sanders’ supporters were enraged.

Presidential candidate Trump’s reaction:

  • “WikiLeaks, I love WikiLeaks.”
  • “This WikiLeaks stuff is unbelievable. It tells you the inner heart, you gotta read it.” 
  • This WikiLeaks is like a treasure trove.”
  • “WikiLeaks just came out with a new one just a little while ago it’s just been shown that a rigged system with more collusion, probably illegal, between the Department of Justice the Clinton campaign and the State Department, you saw that.”

But now Trump has reverted to his longtime hatred of “leakers.”

In July, 2019, he told his acting chief of staff, Mick Mulvaney, to withhold almost $400 million in promised military aid for Ukraine, which faces increasing aggression from Russia.

On July 25, Trump telephoned Ukrainian President Volodymyr Zelensky to “request” a “favor”: Investigate Democratic Presidential Candidate Joe Biden and his son, Hunter, who has had business dealings in Ukraine.

The reason for such an investigation: To find embarrassing “dirt” on Biden.

But then a CIA whistleblower filed a complaint about the extortion attempt—and the media and Congress soon learned of it. 

Rep. Adam Schiff (D-Calif.) tweeted: “The transcript of the call reads like a classic mob shakedown: — We do a lot for Ukraine — There’s not much reciprocity — I have a favor to ask — Investigate my opponent — My people will be in touch — Nice country you got there. It would be a shame if something happened to her.”

On September 24, 2019, Nancy Pelosi, speaker to the House of Representatives, announced a formal impeachment inquiry into Trump.

On September 26, Trump told a private group at a midtown hotel: “I want to know who’s the person, who’s the person who gave the whistleblower the information? Because that’s close to a spy.

“You know what we used to do in the old days when we were smart? Right? The spies and treason, we used to handle it a little differently than we do now.”

Trump can’t refute the sheer number of witnesses who have testified to his extortion attempt on Ukraine. So he now seeks to shift blame to the person who originally testified to his extortion.

On November 6, his son, Donald, Jr., tweeted out an article which might—or might not—have contained the name of the Intelligence community whistleblower.

A Trump shill later claimed that Trump hadn’t known about his son’s efforts to attack that official.

The law firm, Kohn, Kohn & Colapinto, LLP, called on Attorney General William Barr to open a criminal investigation into any leaks of the whistleblower’s identity. 

“As attorneys representing whistleblowers for over 35-years we are extremely concerned about the nation-wide ‘chilling effect’ the disclosure of the identity of any intelligence community whistleblower will necessary cause. Whistleblowers need to reassurance that the laws protecting them will be strictly enforced. 

“If the [whistleblower’s] name is revealed by any person, including Donald Trump, Jr., we hereby request that the persons engaging in this obstruction of justice be immediately arrested.” 

Yet Barr, as Trump’s handpicked Attorney General, has so far refused to take any action against those in violation of whistleblower statutes. 

The Occupational Safety and Health Administration (OSHA) enforces the provisions of more than 20 whistleblower statutes protecting employees from retaliation for reporting violations of various workplace-related laws.

According to a 2002 amendment to the federal retaliation statute:

“Whoever knowingly, with intent to retaliate, takes any action harmful to any person, including interference with the lawful employment or livelihood of any person, for providing to a law enforcement officer any truthful information relating to the commission or possible commission of any Federal offense, shall be fined under this title or imprisoned not more than 10 years, or both.”

These forbid an employer to fire, lay off, threaten, reduce pay or hours, blacklist, demote, deny overtime, benefits or promotion to anyone protected by such laws.

One such witness is Lt. Col. Alexander Vindman, an expert on Ukraine. A member of the National Security Council, he felt it improper for a President to ask a foreign leader to investigate an American citizen.

Trump called Vindman, a Purple Heart winner who was wounded in Iraq, “Yesterday’s Never Trumper witness.” 

Ultimately, the identity of the whistleblower doesn’t matter.

As Representative Eric Swalwell (D-CA) tweeted on November 8: “One more time for the people in the back: The whistleblower pulled the fire alarm. The 1st responders showed up and saw smoke, flames, and @realDonaldTrump holding matches. Does it matter who pulled the fire alarm?”

The truth of the original complaint about Trump’s extortion attempt has been repeatedly validated by multiple witnesses.

It now remains to be seen whether Republicans care more about the truth of that complaint—or bowing in subservience to a thoroughly corrupt President.

THE WITNESS IS THE ENEMY: PART ONE (OF TWO)

Before 1966, witnesses who dared expose the deadly secrets of the Mafia came to a brutal end once trials ended. And sometimes before trials even began.

For example: In 1940, Abe “Kid Twist” Reles, a notorious hitman for Murder, Inc., the execution squad of the New York Mafia, turned State’s evidence against his cronies. His testimony sent his former boss, Louis “Lepke” Buchalter, to the electric chair for murder.

He was set to testify against Albert “The Executioner” Anastasia, the chief of Murder, Inc., in November, 1941. Then fate—or bribed police—intervened.

Reles was being guarded round-the-clock by a lieutenant and six detectives at the Half Moon Hotel in Coney Island. Nevertheless, he “fell” 42 feet to his death from his sixth-floor room. No one was prosecuted for his murder.

As Joseph Valachi, a future Mafia witness, later testified: “I never met anybody yet who thought Reles went out that window on purpose.”

In 1966, the United States Justice Department indicted Rhode Island Mafia Boss Raymond Patriarca. Thus, protection of its star witness, hitman Joseph “The Animal” Barboza, became a top priority.

Assigned to guard him was a small, handpicked detail of deputy U.S. marshals under the command of John Partington. For 18 months, the marshals foiled every effort by the Mafia to “clip” Barboza.

His testimony convicted a half-dozen top Mafiosi—including Patriarca. Then the marshals packed Barboza off to California under a new identity—and a new life.

Other Mafiosi—having run afoul of the Mafia and impressed by the success of the marshals in keeping Barboza alive—signed on as witnesses.

This, in turn, led the Justice Department to create an official Witness Security Program. By 2019, the Program had protected, relocated and given new identities to more than 8,600 witnesses and 9,900 of their family members.

Every President since John F. Kennedy has championed the vigorous prosecution of organized crime. And fueling this drive is the testimony of endangered witnesses requiring air-tight security.

Donald Trump is the first President to blatantly attack those who dare to “rat out” their former criminal associates.

On August 21, 2018, attorney Michael Cohen pleaded guilty in federal court in Manhattan to eight counts of campaign finance violations, tax fraud and bank fraud. He also said he had made illegal campaign contributions “in coordination and at the direction of a candidate for federal office”—Donald Trump.  

Among his revelations:

  • Trump has repeatedly asserted that Russia didn’t interfere with the 2016 Presidential election. But Cohen said he believed it did.
  • Trump has repeatedly claimed he had “no business” in Russia. But Cohen testified that the Trump Organization had sought to “pursue a branded property in Moscow.”
  • Trump denied having had sex with and paid off porn “actress” Stormy Daniels. But Cohen confirmed that Trump had instructed him to pay her $130,000 to buy her silence during the 2016 Presidential campaign.

On August 23, on the Fox News program, “Fox and Friends,” Trump attacked Cohen for “flipping” on him: “For 30, 40 years I’ve been watching flippers. Everything’s wonderful and then they get 10 years in jail and they—they flip on whoever the next highest one is, or as high as you can go. It—it almost ought to be outlawed. It’s not fair.

“You know, campaign violations are considered not a big deal, frankly. But if somebody defrauded a bank and he’s going to get 10 years in jail or 20 years in jail but if you can say something bad about Donald Trump and you’ll go down to two years or three years, which is the deal he made.”

Making “flipping” illegal would undo decades of organized crime prosecutions—and make future ones almost impossible.

To penetrate the secrets of criminal organizations, investigators and prosecutors need the testimony of those who are parties to those secrets.  

The Organized Crime Control Act of 1970 gave Justice Department prosecutors unprecedented weapons for attacking crime syndicates across the country. One of these was the authority to give witnesses immunity from prosecution on the basis of their own testimony.

Thus, a witness to a criminal conspiracy could be forced to tell all he knew—and thus implicate his accomplices—and bosses. In turn, he wouldn’t be prosecuted on the basis of his testimony. 

Organized crime members aggressively damn such “rats.” There is no more obscene word in a mobster’s vocabulary.

But no President—until Trump—has ever attacked those who make possible a war on organized crime. 

On August 19, he tweeted: “The failing @nytimes wrote a Fake piece today implying that because White House Councel [sic] Don McGahn was giving hours of testimony to the Special Councel [sic] he must be a John Dean type ‘RAT.’

“But I allowed him and all others to testify – I didn’t have to. I have nothing to hide……” 

In 1973, former White House Counsel John Dean testified before the United States Senate on a litany of crimes committed by President Richard M. Nixon. Dean didn’t lie about Nixon—who ultimately resigned in disgrace.

For Trump, Dean’s sin is that he “flipped” on his former boss, violating the Mafia’s code of omerta, or silence. 

But Trump feels completely different abut “flippers” when their revelations serve his interests.
