MEXICO: A PAST VICTIM OF ILLEGAL IMMIGRATION

In Bureaucracy, History, Law, Law Enforcement, Military, Politics, Social commentary on May 30, 2018 at 12:09 am

On May 8, 2018, United States Attorney General Jeff Sessions announced that a “zero-tolerance” policy toward people illegally entering the United States might separate families while parents are prosecuted.

“We don’t want to separate families, but we don’t want families to come to the border illegally and attempt to enter into this country improperly,” Sessions said. “The parents are subject to prosecution while children may not be. So, if we do our duty and prosecute those cases, then children inevitably for a period of time might be in different conditions.”

Children who are separated from their parents would be put under supervision of the U.S. Health and Human Services Department, Sessions said.

Thomas Homan, U.S. Immigration and Customs Enforcement’s acting director, backed up Sessions’ “get tough” policy change: “Every law enforcement agency in this country separates parents from children when they’re arrested for a crime. There is no new policy. This has always been the policy.”

Since then, that policy has gone into effect. And it has generated widespread outrage by

  1. Civil liberties organizations; and
  2. Those who believe the United States should not have—or enforce—its immigration laws.

“Criminalizing and stigmatizing parents who are only trying to keep their children from harm and give them a safe upbringing will cause untold damage to thousands of traumatized families who have already given up everything to flee terrible circumstances in their home countries,” said Erika Guevara-Rosas, Amnesty International’s Americas director.

In fact, alien-smugglers have increasingly used children as a wedge against American immigration laws. Their strategy: “Surely, Americans won’t arrest innocent children—or the adults who bring children with them.

The Trump administration is proving them wrong.

This is typical behavior for law enforcement agencies: When criminals devise new ways to defeat existing police measures, the police devise new ways to counter those methods.

Meanwhile, those who believe the United States should throw open its doors to everyone who wants to enter are missing—or ignoring—a vital historical lesson.

Ironically, Mexico knows even better than the United States the perils of unchecked illegal immigration.

In 1821, Moses Austin sought a grant from Mexico to settle Texas. After he died in 1821, his son, Stephen, won recognition of the grant by Mexico.

The Mexican government had been unable to persuade large numbers of its own citizens to move to Texas, owing largely to raiding by such fierce Indian tribes as the Comanches.

The government saw the Anglo settlement of Texas as its best hope to tame an otherwise untamable frontier.

Austin convinced numerous American settlers to move to Texas, and by 1825 he had brought the first 300 American families into the territory.

Throughout the 1820s, Austin helped ensure the introduction of slavery into Texas, even though, under Mexican law, this was illegal. Tensions developed between unchecked numbers of Anglo settlers flooding into Texas and the Mexican authorities in charge there.

(“GTT”—“Gone to Texas”—was often carved on cabin doors by debt-ridden settlers who decided to seek their fortune in Texas. And some of the most notorious criminals on the frontier—such as land swindler and knife-fighter James Bowie—joined them.)

James Bowie

Eventually, the irresistible force of unlimited Anglo illegal immigration rebelled against the immovable object of Mexican legal/military authority.

The result:

  • The battle of the Alamo: From February 23 to March 6, 1836, about 200 rebellious Texans withstood a 13-day siege in a former San Antonio mission, only to be slaughtered to the last man by an army of 2,000 Mexican soldiers commanded by President (actually, dictator) Antonio Lopez de Santa Anna. Among the victims: James Bowie and former Congressman David Crockett.
  • The massacre at Goliad:  On March 27, 1836, 425-445 Texans captured after the battle of Coleto were shot en masse by Mexican soldiers.
  • The battle of San Jacinto:  On April 21, 1836, Texans led by General Sam Houston won a surprise Texas victory over Mexican forces who were caught in a mid-afternoon siesta. Santa Anna—who had fled—was captured the next day.

Mexico was forced to give up all rights to Texas—which, 10 years after winning its independence, became a state.

But ongoing conflicts between Mexico and the United States over Texas led to the Mexican war in 1846.

This, in turn, led to a series of devastating American victories over the Mexican army, and the capture of Mexico City itself.

Territory (in green) that Mexico lost after the Mexican War

Mexico suffered the humiliation of both military defeat and the loss of its land holdings within the American Southwest—which, up to 1848, it had controlled.

This territory later became the states of California, New Mexico, Utah, Nevada, Arizona, Texas, and western Colorado.

And the United States finally spread “from sea to shining sea.”

So Mexico knows what it’s doing when it unloads millions of its own citizens—and those of other Latin and Central American countries—on the United States.

Mexico, in short, is a textbook case of what happens to a country that is unable to enforce its own immigration laws.

On April 16, 2015, the Syrian Observatory for Human Rights announced that more than 310,000 people had been killed in Syria’s uprising-turned-civil war.

The Syrian conflict began on March 15, 2011, triggered by protests demanding political reforms and the ouster of dictator Bashar al-Assad.

And who did the Syrian Observatory for Human Rights–safely based in England–blame for this Islamic self-slaughter? Why, the West, of course.

According to its website:

“The silence of the International community for the war crimes and crimes against humanity committed in Syria encourages the criminals to kill more and more Syrian people because they have not found anyone that deter them from continuing their crimes that cause to wound more than 1500000 people; some of them with permanent disabilities, make hundreds of thousands children without parents, displace more than half of Syrian people and destroy infrastructure, private and public properties.”

Got that?

“They have not found anyone that deter them from continuing their crimes”–as if it’s the duty of non-Muslims to bring civilized behavior to Islamics.

And why are all these murderers “continuing their crimes”?  Because of an inner-religious dispute within Islam that traces back to the fourth century.

Yes, it’s Sunni Muslims, who make up a majority of Islamics, versus Shiite Muslims, who comprise a minority.

Each group considers the other takfirs–that is, “apostates.” And, in Islam, being labeled an apostate can easily get you murdered.

But, according to the Syrian Observatory, it’s the duty of the West to convince these murderers to stop slaughtering one another.

There is, however, another perspective to consider–that of the late political scientist Samuel Huntington. In his bestselling 1996 book, The Clash of Civilizations and the Remaking of World Order, he warned:

The fundamental problem for the West is not Islamic fundamentalism. It is Islam, a different civilization whose people are convinced of the superiority of their culture and are obsessed with the inferiority of their power.”

This is starkly outlined in the 2009 book, Slavery, Terrorism and Islam: The Historical Roots and Contemporary Threat, by Dr. Peter Hammond.

Hammond explores the impact of an increasing Muslim population on non-Muslim society–and the changes that can be expected to occur within that society.

Image of Dr. Peter Hammond

Dr. Peter Hammond

According to Hammond:

Islam is not a religion nor a cult. It’s a complete system of religious, legal, political, economic and military components.  The religious component encompasses all the others.

“Islamization” occurs when there are enough Muslims in a country to agitate for their “religious rights.”

The Pew Research Center estimates there are 2.5 million Islamics in the United States. The Council on American-Islamic Relations (CAIR) puts the figure at seven million.

In December, 2015, almost 150 Muslims in Fort Morgan, Colorado, gave a demonstration of what happens when the number of Islamics rises within a non-Islamic society.

Cargill Meat Solutions, headquartered in Wichita, Kansas, is a division of Cargill Inc., which employees 155,000 people in 68 countries.

On December 18, 2015, 11 workers at Cargill’s beef processing plant in Fort Morgan wanted to go pray at the same time in a room in the plant that is set aside for prayer and reflection. A supervisor told the employees they could go pray, but only three at a time, so production would not be affected.

The workers complied with the supervisor’s request and went in smaller groups to pray. But after their shift ended, 10 of the 11 workers resigned, turning in their badges and hard hats.

The following Monday, about 150 employees from the Somali Muslim community didn’t show up to work for three consecutive days. The company fired them all.

Cargill is now hiring to replace those who walked out.

Areas have been set up at Cargill since 2009 to accommodate anyone who requested time to pray.

“There are times when accommodation is not possible,” Michael Martin, a Cargill spokesman, told CBS News. “But in an overwhelming majority of instances, we do everything we can to ensure that we do accommodate employees.”

Tony Aden, one of the fired employees, explained the situation thus: “It don’t matter if I don’t have a job, my religion is more important.”

Negotiating on behalf of the striking–and then fired–employees was the Council on American-Islamic Relations (CAIR).

In 2007, CAIR was named as an unindicted co-conspirator in the Hamas-support trial of the Holy Land Foundation for Relief and Development (HLFRD). The defendants were charged with giving more than $12 million to support Hamas.

Hamas is designated as a terrorist organization by the European Union, Egypt, Japan, Canada, Israel and the United States.

On November 24, 2008, the government obtained guilty verdicts on all counts against HLFRD and the five individual defendants in the retrial.

As the Islamic population rises within the United States, non-Islamics can expect increasing demands for “Islamic rights.” According to Dr. Hammond:

At five percent of the population, Islamics try to get the ruling government to let them rule themselves under Sharia (Islamic) law.

At 10%, they use lawlessness to complain about their conditions.

At 20%, Islamics riot, form jihad militias and burn Christian churches and Jewish synagogues.

At 40%, nations experience widespread massacres, chronic terror attacks and ongoing militia warfare.

Their ultimate goal: To extend Sharia throughout the world–enforcing it on Muslims and non-Muslims alike.

In Bureaucracy, History, Law, Law Enforcement, Military, Politics, Social commentary on May 23, 2017 at 12:02 am

[Editor’s Note: As this goes to press, at least 19 people are reported dead and almost 60 injured at Manchester Arena, Manchester, England where pop singer Ariana Grande was performing. Authorities suspect an Islamic suicide bomber to be responsible.]

The headline in the December 7, 2015 issue of the British newspaper, The Guardian, read:

GERMANY ON COURSE TO ACCEPT ONE MILLION REFUGEES IN 2015

It may turn out to be Germany’s epitaph.

Germany registered 964,574 Islamic asylum-seekers in the first 11 months of 2015.

The Islamic world is at war with itself–in Iraq, Syria and Afghanistan. And while Islamics generally slander the West as Satan’s lair, that’s where Islamic refugees are heading.

The vast majority of these come from Syria, which is locked in a brutal civil war. This began on March 15, 2011, when protesters demanded political reforms and the ouster of dictator Bashar al-Assad.

By April 16, 2015, the Syrian Observatory for Human Rights announced that more than 310,000 people had been killed in Syria’s ongoing conflict.

European countries soon began opening their doors to asylum-seeking Islamics.

  • United Kingdom: Pledged to accept 20,000 Syrians by 2020.
  • Greece: By September, 2015, nearly a quarter of a million Syrians had illegally landed on Greek shores.
  • Sweden: 64,685 Islamics admitted.
  • France: Agreed, by the fall of 2015, to accept 30,000 Syrian refugees over the next two years.
  • Italy: By the fall of 2015, more than 110 refugees had arrived there.

Germany has been–and remains–the main destination for many Islamic immigrants, legal and illegal.

Flag of Germany.svg

According to Germany’s interior ministry, 206,101 Islamics entered the country in November, 2015, setting a new monthly record.  The previous high had been 181,166 in October.

Each immigrant has an estimated four to eight family members who could be legally allowed to enter. That could bring the number of Islamics resettled in Germany to more than seven million.

And the cost to Germany?

Germany has an aging population and one of the lowest birthrates in the world.  Of the refugees it has absorbed, only one in 10 is immediately employable.  The rest will have to be carried on welfare for months, and possibly years.

Behind this unchecked flood stands Chancellor Angela Merkel, who insisted that Germany admit tens of thousands of men, women and children of an alien faith and culture.

Angela Merkel 2011.jpg

Angela Merkel

And, so far, Germans have responded to Merkel’s call with money, food, clothes and even making spare rooms available for immigrants.

And how have many of these refugees thanked their German benefactors for their well-meaning goodwill?

On January 1, 2016, the The New York Times  published a story under this headline:

MUNICH ON HIGH ALERT AFTER NEW YEAR’S EVE TERRORISM THREAT

Hundreds of police officers were posted throughout Munich after the Islamic State threatened a suicide bombing attack.  Two train stations were evacuated.

Police believed that five to seven people were involved in the threat.

And, in Cologne, Germany, about 1,000 men congregated at Cologne’s central train station, then broke off into small groups to sexually molest and rob women. Asylum-seekers and illegal migrants from North Africa comprise the majority of suspects.

Similar attacks were reported in Hamburg and Stuttgart on New Year’s Eve.

Earlier, in May, 2015, German authorities had called off the popular Eschborn-to-Frankfurt bike race after receiving a tip about a possible attack. Police arrested a German-Turkish couple who had been storing weapons in their home.

In November, a game in Hanover between Germany and the Netherlands was called off hours before kickoff when a suspicious package was found.

Meanwhile, uber-liberals such as those who staff Mother Jones  magazine whine that the United States hasn’t followed Germany’s example.

On September 3, 2015, the publication ran a story on the plight of Syrian refugees, under the headline:

GERMANY HAS TAKEN IN 800,000 REFUGEES.  GUESS HOW MANY THE US HAS TAKEN IN?

Quoting The Guardian, the Mother Jones writer gives the answer: “The US has admitted approximately 1,500 Syrian refugees since the beginning of the civil war there in 2011, mostly within the last fiscal year.”

Seven days after this article appeared, on September 10, the Obama administration announced that it would take in at least 10,000 displaced Syrians over the next year.

That is on top of the 2,000 Islamic refugees the United States has already accepted.

According to U.S. Census data, America welcomes about 100,000 Muslim immigrants legally each year. This represents the fastest growing segment of immigrants coming to the United States.

The Pew Research Center estimates there are 2.5 million Islamics in the United States. The Council on American-Islamic Relations (CAIR) puts the figure at seven million.

The Troubling Math of Muslim Migration | National Review Online

And while all this is happening, the FBI is being overwhelmed by the demands of countering Islamic terrorism against the United States.

On July 8, 2015, FBI director James Comey testified before Congress about the increasing burdens his agency faces in combating terrorism.

“We are stopping these things [Islamic terror plots] so far through tremendous hard work, the use of sources, the use of online undercovers.

“But it is incredibly difficult.  I cannot see my stopping these indefinitely.”

Consider the math: The FBI has only 35,000 agents and analysts–against seven million potential suspects.

And only a portion of those agents and analysts are charged with investigating terrorism.

How did all of this begin?  And where is it ultimately leading?

Those questions will be answered in Part Two of this series.

THE REAL CULPRIT IN THE “DARK NIGHT” TRIAL: PART FOUR (END)

In Bureaucracy, History, Law, Law Enforcement, Social commentary on May 5, 2015 at 12:20 am

The victims of the violence are black and white, rich and poor, young and old, famous and unknown. They are, most important of all, human beings whom other human beings loved and needed. No one–no matter where he lives or what he does–can be certain who will suffer from some senseless act of bloodshed. And yet it goes on and on.

–Robert F. Kennedy, April 4, 1968

Senator Robert F. Kennedy announcing the murder of Dr. Martin Luther King, Jr.

What should the surviving victims of the Aurora massacre do to seek redress?

And how can the relatives and friends of those who didn’t survive seek justice for those they loved?

Two things:

First, don’t count on politicians to support a ban on assault weapons.

Politicians–with rare exceptions–have only two goals:

  1. Get elected to office, and
  2. Stay in office.

And too many of them fear the economic and voting clout of the NRA to risk its wrath.

Consider Mitt Romney and President Barack Obama.

Both rushed to offer condolences to the surviving victims of the Aurora massacre.  And both steadfastly refused to even discuss gun control–let alone support a ban on the type of assault weapons used by James Holmes.

On July 22–only two days after the Century 16 Theater slaughter–U.S. Senator Ron Johnson (R-Wis.) said: “The fact of the matter is there are 30-round magazines that are just common all over the place.

“You simply can’t keep these weapons out of the hands of sick, demented individuals who want to do harm.  And when you try and do it, you restrict our freedom.”

That presumably includes the freedom of would-be mass murderers to carry out their fantasies.

Second, those who survived the massacre–and the relatives and friends of those who didn’t–should file wrongful death, class-action lawsuits against the NRA.

There is sound, legal precedent for this.

  • For decades, the American tobacco industry peddled death and disability to millions and reaped billions of dollars in profits.
  • The industry vigorously claimed there was no evidence that smoking caused cancer, heart disease, emphysema or any other ailment.

  • Tobacco companies spent billions on slick advertising campaigns to win new smokers and attack medical warnings about the dangers of smoking.
  • Tobacco companies spent millions to elect compliant politicians and block anti-smoking legislation.
  • From 1954 to 1994, over 800 private lawsuits were filed against tobacco companies in state courts. But only two plaintiffs prevailed, and both of those decisions were reversed on appeal.
  • In 1994, amidst great pessimism, Mississippi Attorney General Mike Moore filed a lawsuit against the tobacco industry.  But other states soon followed, ultimately growing to 46.
  • Their goal: To seek monetary, equitable and injunctive relief under various consumer-protection and anti-trust laws.
  • The theory underlying these lawsuits was: Cigarettes produced by the tobacco industry created health problems among the population, which badly strained the states’ public healthcare systems.
  • In 1998, the states settled their Medicaid lawsuits against the tobacco industry for recovery of their tobacco-related, health-care costs.  In return, they exempted the companies from private lawsuits for tobacco-related injuries.
  • The companies agreed to curtail or cease certain marketing practices.  They also agreed to pay, forever, annual payments to the states to compensate some of the medical costs for patients with smoking-related illnesses.

The parallels with the NRA are obvious:

  • For decades, the NRA has peddled deadly weapons to millions, reaped billions of dollars in profits and refused to admit the carnage those weapons have produced: “Guns don’t kill people.  People kill people.”  With guns.

  • The NRA has bitterly fought background checks on gun-buyers, in effect granting even criminals and the mentally ill the right to own arsenals of death-dealing weaponry.
  • The NRA has spent millions on slick advertising campaigns to win new members and frighten them into buying guns.

  • The NRA has spent millions on political contributions to block gun-control legislation.
  • The NRA has spent millions attacking political candidates and elected officials who warned about the dangers of unrestricted access to assault and/or concealed weapons.

  • The NRA has spent millions pushing “Stand Your Ground” laws in more than half the states, which potentially give every citizen a “license to kill.”
  • The NRA receives millions of dollars from online sales of ammunition, high-capacity ammunition magazines, and other accessories through its point-of-sale Round-Up Program–thus directly profiting by selling a product that kills about 30,288 people a year.

  • Firearms made indiscriminately available through NRA lobbying have filled hospitals–such as those in Aurora–with casualties, and have thus badly strained the states’ public healthcare systems.

It will take a series of highly expensive and well-publicized lawsuits to significantly weaken the NRA, financially and politically.

The first ones will have to be brought by the surviving victims of gun violence–and by the friends and families of those who did not survive it.  Only they will have the courage and motivation to take such a risk.

As with the cases first brought against tobacco companies, there will be losses.  And the NRA will rejoice with each one.

But, in time, state Attorneys General will see the clear parallels between lawsuits filed against those who peddle death by cigarette and those who peddle death by armor-piercing bullet.

And then the NRA–like the tobacco industry–will face an adversary wealthy enough to stand up for the rights of the gun industry’s own victims.

Only then will those politicians supporting reasonable gun controls dare to stand up for the victims of such needless tragedies as the one in Aurora, Colorado.

THE REAL CULPRIT IN THE “DARK KNIGHT” TRIAL: PART THREE (OF FOUR)

In Bureaucracy, History, Law, Law Enforcement, Social commentary on May 4, 2015 at 12:29 am

Among the major accomplishments of the National Rifle Association:

  • In July, 2005, George Zimmerman was arrested for shoving a police officer during an underage drinking raid. The charges were dropped after he completed an alcohol education program. That same summer, his ex-fiancée filed a restraining order against him, alleging that Zimmerman hit her.
  • Yet he was allowed to carry a loaded, hidden handgun as a Florida resident–thanks to the 2005 “Stand Your Ground” law the NRA had rammed through the legislature.
  • Under that law: A Concealed Carry Permit is revoked only if a gun owner is convicted of a felony.  It is not suspended if he’s being investigated for a felony.  It is suspended only if he is actually charged.

George Zimmerman

  • On February 26, 2012, Zimmerman shot unarmed, 17-year-oldTrvon Martin, who was wearing a “hoodie.”  A jury subsquently acquitted him, believing his claim of “self-defense.”
  • In March, the NRA issued its own version of a “hoodie”–the Concealed Carry Hooded Sweatshirt, designed to hide firearms.  Selling on the NRA’s website for $60 to $65, it is advertised thusly:
  • “Inside the sweatshirt you’ll find left and right concealment pockets.  The included Velcro®-backed holster and double mag pouch can be repositioned inside the pockets for optimum draw.  Ideal for carrying your favorite compact to mid-size pistol, the NRA Concealed Carry Hooded Sweatshirt gives you an extra tactical edge, because its unstructured, casual design appears incapable of concealing a heavy firearm – but it does so with ease!”    http://www.nrastore.com/nrastore/ProductDetail.aspx?c=11&p=CO+635&ct=e

  • Anyone—including convicted criminals—can buy these “hide-a-gun” sweatshirts, putting both the public and law enforcers at deadly risk.
  • The NRA often claims that law-abiding citizens defend themselves with guns millions of times every year. But the FBI has determined that, of the approximately 11,000 gun homicides every year, fewer than 300 are justifiable self-defense killings.
  • The NRA supports loopholes that allow criminals to buy guns without background checks, or allow terrorists to buy all the AK-47s they desire.
  • The NRA’s executive vice president, Wayne LaPierre, declared the NRA was “all in” to defeat Barack Obama in 2012.  Yet the President had meekly signed legislation allowing guns to be brought into national parks and onto trains.
  • High-capacity magazines were prohibited under the 1994 Federal Assault Weapons Ban–which expired in 2004. The NRA–aided by the Bush administration and Republicans generally–easily overcame efforts to renew the law.
  • Political scientist Robert Spitzer, author of the book The Politics of Gun Control, notes that since the passage of the 1993 Brady Handgun Violence Prevention Act and the assault weapons ban in 1994, state and national laws have been drifting toward more open gun access:
  • “In 1988, there were about 18 states that had state laws that made it pretty easy for civilians to carry concealed hand guns around in society. By 2011, that number is up to 39 or 40 states having liberalized laws, depending on how you count it, and the NRA has worked very diligently at the state level to win political victories there, and they’ve really been quite successful.”
  • On January 8, 2011, Democratic Rep. Gabrielle Giffords was shot in the head while meeting with constituents outside a,Tucson, Arizona, grocery store.  Also killed was Arizona’s chief U.S. District judge, John Roll, who had just stopped by to see his friend Giffords after celebrating Mass.  The total number of victims: 6 dead, 13 wounded.
  • “The NRA’s response to the Tucson shootings has been to say as little as possible and to keep its head down,” said Spitzer. “And their approach even more has been to say as little as possible and to simply issue a statement of condolence to the families of those who were injured or killed and to wait for the political storm to pass over and then to pick up politics as usual.”
  • This is the standard NRA response to each continuing massacre.
  • In the spring of 2012, the House Oversight Committee prepared to vote on whether to hold U.S. Attorney General Eric Holder in contempt for allegedly refusing to provide documents related to “Fast and Furious.”  This was an undercover operation launched by the Bush administration to track firearms being sold to Mexican drug cartels.
  • The NRA notified Congressional members that how they voted would reflect how the NRA rated them in “candidate evaluations” for the November elections. This amounted to blatant extortion, since the NRA had long accused Holder of having an “anti-gun” agenda.

Summing up the still-current state of gun politics in America, the April 21, 2012 edition of The Economist noted:

“The debate about guns is no longer over whether assault rifles ought to be banned, but over whether guns should be allowed in bars, churches and colleges.”

That is precisely the aim of the NRA–an America where anyplace, anytime, can be turned into the O.K. Corral.

So what should the surviving victims of the Aurora massacre do to seek redress?  And how can the relatives and friends of those who didn’t survive seek justice for those they loved?

THE REAL CULPRIT IN “THE DARK KNIGHT” TRIAL: PART ONE (OF FOUR)

In Business, History, Law, Law Enforcement, Social commentary on April 30, 2015 at 9:01 am

It had happened it before–all too many times before:

  • Midnight vigils for the victims of yet another spree-killer.

  • Makeshift memorials of flowers, candles and teddy bears.
  • Grief counselors for students at elementary, junior high and high schools.
  • And, of course, the inevitable question: “Why?”

And Americans had seen it all before–-too many times before:

  • After the San Ysidro McDonald’s shootings, 1984: 21 dead, 19 wounded.
  • After the 101 California Street shootings in San Francisco, 1993: 9 dead, 6 injured.
  • After the Columbine High School shootings in Colorado, 1999: 15 dead, 21 wounded.
  • After the Virginia Tech shootings, 2007: 32 dead, 23 wounded.
  • After the Tucson shootings, 2011: 6 dead, 13 wounded.

And then, on July 20, 2012, came the massacre at the Century 16 Theater in Aurora, Colorado: 12 dead, 58 wounded.

People who wanted nothing more than to see a movie they were eagerly anticipating: The latest addition to the hugely popular “Batman” franchise: The Dark Knight Rises.

The scene of the crime: The Century 16 Theater in Aurora, Colorado

Snuggled into their seats, some eating popcorn or candy, others sipping sodas. None of them expecting that the violence on the screen would suddenly consume them in real-life.

It was a scene of which nightmares are made:

  • A sudden eruption of smoke and fire as a tear-gas canister explodes.
  • A lone gunman–brandishing a Smith & Wesson AR-15 semi-automatic rifle, a 12-gauge Remington Model 870 shotgun, and a G23 .40 caliber Smith & Wesson Glock pistol.
  • First he blasts the ceiling with a shotgun, and then opens fire on the audience, stopping only to reload his weapon.
  • He begins aiming at the back of the room, and then targets people who are scrambling to escape in the aisles.
  • Some bullets penetrate the wall of the cinema and injure people in an adjoining theater, where the same film is being screened.
  • Adding to the nightmarish quality of the scene: The appearance of the gunman–dressed all in black: a ballistic helment, vestand leggings; a throat protector; a groin protector; a gas mask; and black tactical gloves.

As terrible as the massacre was, it could have been worse.

Police arrived in about 90 seconds and arrested the shooter, James Holmes, in the parking lot of the Century 16 Theater he had just ravaged.

Still, the statistics were terrible enough:

  • Twelve people–several of them heroes who died shielding others with their bodies–would never return to those who loved them.
  • Of the 58 wounded, an unknown number would be physically scarred for life.
  • Some would never fully recover from their injuries.
  • They would not be able to walk. Or see. Or use their arms or hands.
  • Almost all those who were in that theater–-even those who escaped without a scratch-–would be emotionally tormented for months or years to come.
  • Some would never escape those moments of murderous insanity.

It’s possible that Holmes, then 24, an honors graduate of the University of California Riverside, became that most lethal specimen: The genius who slides into madness.

James Holmes

Holmes moved to the University of  Colorado School of Medicine in Aurora in May, 2011, to pursue a PhD in neuroscience.

He had always excelled in his studies, but in early 2012, his grades took a sharp decline. In June, he told the college that he was going to drop out.

Meanwhile, he was amassing an arsenal of weapons and ammunition.

He bought two Glock pistols, a semi-automatic rifle and a shotgun over the last two months from local gun stores and 6,000 rounds of ammunition via the Internet–-all purchased legally under state law.

In early July, 2012, Holmes ordered the paramilitary bulletproof clothing and gas mask that he intended to wear on his rampage.

Finally, he dyed his hair a shocking red-orange and rigged his university apartment with trip-wires and homemade booby-traps. When he was arrested, he told police: “I am the Joker.”

Commentators immediately began asking: Why did Holmes choose to snuff out the lives and dreams of so many people?

But a better question is: “How did he do it?”

It may never be finally known why he did it. But the answer to how makes clear a fundamental truth:

He could not have done it without access to the awesome firepower he was legally able to purchase:

  • The AR-15 semi-automatic rifle is designed for easy reloading. “Even without the grand-sized mag[azine]s, many people who are practiced can reload in 1½ to 2 seconds,” said Steven Howard, a Michigan attorney and security and firearms expert.

  • The AR-15 is a weapon of war.  Its only purpose is to kill large numbers of people–quickly.  Its 100-round drum magazine  allowed Holmes to five 50 to 60 rounds within one minute.
  • The Glock pistol uses a 15-round clip. When it’s done the shooter simply ejects the empty clip and slams in another one, and he’s ready for more killing.

And who has made all of this mayhem not only possible but politically invincible?

Who ultimately bears responsibility not only for those murdered and maimed at an Aurora theater but for the almost 100,000 people who are killed or wounded every year from gun violence?

Your friends at the National Rifle Association.

CHOOSE YOUR VILLAIN

In Bureaucracy, Law, Politics, Social commentary on July 11, 2012 at 9:12 am

Sometimes it’s hard to choose which villain to hate the most.

Take the case of Loretta Robinson, a South Carolina mother who lost her son, Justin Walker, in June, 2011, to a drunk driver.

For Robinson, tragedy was followed by outrage–which came in four stages.

First, the tragedy: Justin Walker, her oldest son, died when his car was struck by another vehicle on White Horse Road in Greenville, South Carolina.

Then, the outrage–Stage 1: The driver of the killer-car turned out to be drunk.

Outrage, Stage 2: The driver of the killer-car also turned out to be an illegal alien named Anna Gonzalez.

Outrage, Stage 3:  Gonzalez had been living in the United States for 12 years–but had never bothered to get a driver’s license.  She had been stopped for license violations in 2011, prior to the accident.  But she was never detained by Immigration and Customs Enforcement (ICE).

Outrage, Stage 4:  Loretta Robinson found herself billed for the various charges associated with the accident, including a $50 charge to clean her son’s blood off the road.

On June 19, 2012, Gonzalez pleaded guilty to drunk driving and driving without a license, and causing the fatal accident.  She was stenced to 17 years in prison.

But, for Robinson, the verdict could not possibly compensate for her injuries.

  • For several months, she had to pay for storage of her son’s wrecked car in case of a trial.
  • She had to pay to have the vehicle towed.
  • She was issued a bill to cover the cost of cleaning up her son’s blood from the road.  She said that was the bill that hurt the most–paying $50 to have the street  washed.
  • She has had a hard time working because of the emotional effects of the accident.  Bills keep arriving when she cannot pay them.

The South Carolina State Office of Victims Assistance offers a combined total of up to $15,000 for medical, funeral, counseling and wage compensation for the families of victims of crime.   Robinson received some money from this agency, but it did not cover the costs of cleanup or storage.

“We have to be able, as a country, to figure out a way [to deal] with people here who are illegal and commit crimes,” Robinson said.

Unfortunately, that is unlikely to happen.

In June, President Barack Obama directed the Department of Homeland Security (DHS) to halt deportations for up to 800,000 illegal aliens who entered the country as children.  The decision halts any deportation proceedings for two years and allows aliens the opportunity to apply for a work permit.

So it’s hard to know which is the greater villain:

  • Federal authorities who, through collusion or incompetence, allowed an illegal alien to not simply remain in the country for 12 years but to drive without a license virtually that entire time; or
  • Local authorities who callously demanded thousands of dollars from a grieving mother, without regard to her emotional or financial state.

The Federal guidelines on dealing with illegal aliens–as issued by the Department of Homeland Security–will likely remain in place at least until the November Presidential election.

It’s been widely charged that Obama offered what amounts to a limited amnesty to woo the Hispanic vote.  This promises to be a close election, and the President isn’t taking any chances.

The reaction of the local authorities portends a startling new development: Not simply blaming the victim but financially penalizing him.

In Colorado, the jobless are now being forced to pay the government.

The state accidentally overpaid $128 million in unemployment benefits in 2011.  That included more than $98 million from state coffers, with the rest coming from the federal government’s extended-benefits plan, according to the U.S. Department of Labor.

And now it is billing the jobless to get that money back.

Nor is this problem limited to Colorado.  In 2011, states across the country accidentally overpaid $5.1 billion in unemployment payments.

The overpayments result primarily from clerical errors and not fraud, said government officials quoted in the Denver Post.

In 2011, Colorado recovered $73 million in unemployment benefits that it had accidentally overpaid.

“If we deliberately lie about our information, they are quick to prosecute,” said Amelia Kelii of Parker.  “But if they make a mistake, we still have to pay for their mistake.”   She owes the state more than $1,000, which she says she cannot pay.

In May, Facebook co-founder Eduardo Saverin renounced his U.S. citizenship.  He did so to avoid a 15% tax on capital gains when Facebook launched its IPO.  Singapore–where he had lived since 2009–does not have a capital gains tax.

Millions of desperate Americans like Loretta Robinson and Amelia Kelii survive–literally–from one check (unemployment or not) to the next.

For them, the demands of politicians like Mitt Romney to abolish taxes on the wealthy seem not only irrelevant, but a sick joke.
