ILLEGAL IMMIGRATION? LET THE AIR FORCE HANDLE IT

In Bureaucracy, History, Law, Military, Politics, Social commentary on May 4, 2018 at 12:09 am

Republican Presidential candidates like Donald Trump, Mitt Romney and Rick Santorum have long demanded an end to illegal immigration.

Their, now  chief proposed solution: Wholesale deportation of millions of illegal aliens from the United States.

But even if Trump, now President, dared to take such a politically controversial step, could it actually succeed?

Suppose the Federal Government could identify and arrest all or most of the estimated 11 to 20 million illegal aliens now living in the United States. Then what?

Sending them back to their native countries would prove a colossal failure.

Most of America’s illegals come from neighboring Hispanic countries in Central and South America. Which means that as soon as they are deported, most of them cross the Mexican border again.

More importantly: The governments of those Central and South American countries use the United States as a dumping ground—of those citizens who might demand reforms in their political and economic institutions.

But there is one approach that could strike a meaningful blow against illegal immigration. It might well be called “The Zanti Option.”

Viewers of the 1960s sci-fi series, The Outer Limits, will vividly recall its classic 1963 episode, “The Zanti Misfits.”

In this, soldiers at an American Army base in a California ghost town nervously await first-contact with an alien race that has landed a space ship nearby.

The soldiers are warned to steer clear of the ship, and they do.  But then an escaped convict (Bruce Dern, in an early role) happens upon the scene—and the ship.

The Zantis, enraged, emerge—and soon the soldiers at the military base find themselves under attack.

A “Zanti”

The soldiers desperately fight back–-with flamethrowers, machineguns or just rifle butts. Finally the soldiers  win, wiping out the Zantis.

But now the base—and probably America—faces a wholesale invasion from the planet Zanti to avenge the deaths of their comrades.

So the soldiers wait anxiously for their next transmission from Zanti—which soon arrives.

To their surprise—and relief—it’s a message of thanks: “We will not retaliate.  We never intended to.  We knew that you could not live with such aliens in your midst.

“It was always our intention that you destroy them…We are incapable of executing our own species, but you are not. You are practiced executioners. We thank you.”

A Republican President could deal with the tsunami of illegal aliens by launching what might be called “Operation Zanti.”

Rather than deport them to countries in Central America—from which they would easily sneak back into the United States—the Federal Government could ship them off to more distant lands.

Like Afghanistan. Or Iraq. Or Syria.

It’s unlikely they would sneak back across the American border from the Middle East.

Such a policy change would:

  1. Close the Mexican revolving door, which keeps illegal immigration flowing; and
  2. Send an unmistakably blunt message to other would-be illegals: “The same fate awaits you.”

Although this might seem a far-fetched proposal, it could be easily carried out by the United States Air Force.

According to this agency’s website: “The C-5 Galaxy is one of the largest aircraft in the world and the largest airlifter in the Air Force inventory.

“The C-5 has a greater capacity than any other airlifter. It [can] carry 36 standard pallets and 81 troops simultaneously.

C-5 transport plane

“[It can also carry] any of the Army’s air-transportable combat equipment, including such bulky items as the 74-ton mobile scissors bridge.

“It can also carry outsize and oversize cargo over intercontinental ranges and can take off or land in relatively short distances.”

The C-5 Galaxy’s maximum cargo weight: 281,001 pounds

Instead of stuffing these planes with cargo, they could be stuffed wall-to-wall with illegal aliens.

The United States Air Force has a proud history of successfully providing America’s soldiers—and allies—with the supplies they need.

From June 24, 1948 to May 12, 1949, only the Berlin Airlift stood between German citizens and starvation.

The Soviet Union had blocked the railway, road, and canal access to the Berlin sectors under allied control. Their goal: Force the western powers to allow the Soviet zone to supply Berlin with food, fuel, and aid.

This would have given the Soviets control over the entire city.

Air forces from the United States, England, Canada, Australia, New Zealand and South Africa flew over 200,000 flights in one year, dropping more than 4,700 tons of necessities daily to the besiged Berliners.

The success of the Berlin Airlift raised American prestige and embarrassed the Soviets, who lifted the blockade.

The Berlin Airlift

A similar triumph came during the Yom Kippur War after Egypt and Syria attacked Israel without warning on October 6, 1973.

A Watergate-embattled President Richard Nixon ordered “Operation Nickel Grass” to deliver urgently-needed weapons and supplies to Israel.

For 32 days, the Air Force shipped 22,325 tons of ammunition, artillery, tanks and other supplies.  These proved invaluable in saving Israel from destruction.

So the mass deportation of millions of illegal aliens lies within America’s technological capability. The only uncertainty: Would any American President be willing to give that order?

CONTROLLING NATIONAL BORDERS: A DOUBLE STANDARD

In Bureaucracy, History, Law, Law Enforcement, Politics, Social commentary on November 24, 2017 at 1:40 am

Alone among major world powers, the United States feels it must apologize for the right to control its own borders.

A flagrant example of this occurred in May, 2010.

First Lady Michelle Obama—accompanied by Margarita Zavala, the wife of then-Mexican President Felipe Calderón—visited a second-grade class in Silver Spring, Maryland.

Michelle Obama (right) talks with students

During a question-and-answer session, a Hispanic girl said to the First Lady: “My mom said, I think, she says that Barack Obama’s taking everybody away that doesn’t has papers.”

Michelle Obama replied, “Yeah, well, that’s something we have to work on, right, to make sure that people can be here with the right kind of papers, right?”

To which the girl replied, “But my mom doesn’t have [papers].”

“Well, we have to work on that,” said Obama. “We have to fix that. Everybody’s got to work together on that in Congress to make sure that happens.”

But many Americans believe the United States has no right to control its own borders. Among these is Deepak Bhargava, executive director of the Center for Community Change.

“The truth is that more mothers and fathers were deported in Obama’s first year as president than were deported in the last year under Bush.

“Mr. Obama, who so eloquently spoke of the pain and anguish caused by tearing families apart as a candidate, as president has only ramped up that pain and anguish,” said Bhargava.

Michelle Obama’s husband, Barack, was then the nation’s chief law enforcement officer—the President of the United States.

Yet on the day following the girl’s public admission, Obama’s Department of Homeland Security announced that its immigration agents would not be pursuing the family:

“ICE [Immigration and Customs Enforcement] is a federal law enforcement a gency that focuses on smart, effective immigration enforcement that prioritizes criminal aliens who pose a threat to our communities.

“Our investigations are based on solid law enforcement work and not classroom Q and As.”

This was echoed by Brian Edwards, chief of staff for the Montgomery County public schools:

“The girl is in school and we’re doing everything we can to keep her safe.”

So the fact that this girl admitted that her mother was in violation of American immigration laws counted for nothing.

The estimated number of illegal aliens within the United States ranges between seven and 20 million or more.

Among other equally disturbing statistics:

  • Between 1992 and 2012, the number of offenders sentenced in federal courts more than doubled, driven largely by a 28-fold increase in the number of unlawful reentry convictions.
  • As unlawful reentry convictions increased, the demographics of sentenced offenders changed.
  • In 1992, Latinos made up 23% of sentenced offenders; by 2012, they made up 48%.
  • The share of offenders who did not hold U.S. citizenship increased over the same period—from 22% to 46%.

Now, contrast this with the way Mexico insists on controlling its own borders.

Mexico has a single, streamlined law that ensures that foreign visitors and immigrants are:

  • In the country legally;
  • Have the means to sustain themselves economically;
  • Not destined to be burdens on society;
  • Of economic and social benefit to society;
  • Of good character and have no criminal records; and
  • Contribute to the general well-being of the nation.

The law also ensures that:

  • Immigration authorities have a record of each foreign visitor;
  • Foreign visitors do not violate their visa status;
  • Foreign visitors are banned from interfering in the country’s internal politics;
  • Foreign visitors who enter under false pretenses are imprisoned or deported;
  • Foreign visitors violating the terms of their entry are imprisoned or deported;
  • Those who aid in illegal immigration are sent to prison.

Mexico uses its American border to rid itself of those who might otherwise demand major reforms in the country’s political and economic institutions.

The Mexican Government still remembers the bloody upheaval known as the Mexican Revolution. This lasted ten years (1910-1920) and wiped out an estimated one to two million men, women and children.

Massacres were common on all sides, with men shot by the hundreds in bullrings or hung by the dozen on trees.

A Mexican Revolution firing squad

All of the major leaders of the Revolution—Francisco Madero, Emiliano Zapata, Venustiano Carranza, Francisco “Pancho” Villa, Alvaro Obregon—died in a hail of bullets.

Francisco “Pancho” Villa

Emiliano Zapata

As a result, every successive Mexican Government has lived in the shadow of another such wholesale bloodletting. These officials have thus quietly decided to turn the United States border into a safety valve.

If potential revolutionaries leave Mexico to find a better life in the United States, the Government doesn’t have to fear the rise of another “Pancho” Villa.

If somehow the United States managed to seal its southern border, all those teeming millions of “undocumented workers” who just happened to lack any documents would have to stay in “Mexico lindo.”

They would be forced to live with the rampant corruption and poverty that have forever characterized this failed nation-state. Or they would have to demand substantial reforms.

There is no guarantee that such demands would not lead to a second—and equally bloody—Mexican revolution.

So successive Mexican governments find it easier—and safer—to turn the United States into a dumping ground for the Mexican citizens that the Mexican Government itself doesn’t want.

END THE “REVOLVING MEXICAN DOOR”: PART ONE (OF TWO)

In Bureaucracy, History, Law, Law Enforcement, Politics, Social commentary on July 9, 2015 at 9:27 am

Except in times of war, no nation has ever been invaded by so many alien residents as the United States.

Throughout 2014, tens of thousands of unaccompanied Hispanic minors–all of them uninvited–illegally entered the United States through the Mexican border.

They are backed up by an estimated 11 to 20 million illegal aliens now living more or less openly throughout the country.

Just as sheer numbers of Mexicans overwhelmed the defenders of the Alamo, this similar Hispanic tidal wave has overwhelmed immigration officials.

Mexicans storming the Alamo – March 6, 1836

It’s also forced the Obama administration to declare a humanitarian crisis and open three emergency shelters on military bases in California, Oklahoma and Texas.

The invasion is taking its greatest toll in cities that already have large numbers of immigrants–such as New York and Los Angeles.

Newly-arrived alien children and their relatives are flooding into schools and hospitals that are supposedly intended for American citizens.  No sooner do they cross the border than they aggressively seek legal aid in converting their illegal arrival into a lifelong legal stay.

Mexicans storming the United States border – today

For years, Republicans and Democrats have clashed over the subject of illegal immigration.  Each side has taken what seems to be an opposing position.

Democrats favor wholesale grants of unearned citizenship to the estimated 11 to 20 million illegal aliens who brazenly violated the law when they sneaked across American borders.

And Republicams favor beefing up security against future waves of such invaders.

But the brutal truth is that neither Democrats nor Republicans truly want to end these invasionsNor do they want to deport the millions of illegals who have already taken up residence here.

Each party has its own reasons for this.

Democrats, primarily governed by liberal ideology, believe it’s racist for whites to demand control of their own national borders.

They ignore the blunt reality that Mexico–America’s largest source of illegal aliens–strictly enforces control of its own borders.

Mexico has a single, streamlined law that ensures that foreign visitors and immigrants are:

  • in the country legally;
  • have the means to sustain themselves economically;
  • not destined to be burdens on society;
  • of economic and social benefit to society;
  • of good character and have no criminal records; and
  • contribute to the general well-being of the nation.

The law also ensures that:

  • immigration authorities have a record of each foreign visitor;
  • foreign visitors do not violate their visa status;
  • foreign visitors are banned from interfering in the country’s internal politics;
  • foreign visitors who enter under false pretenses are imprisoned or deported;
  • foreign visitors violating the terms of their entry are imprisoned or deported;
  • those who aid in illegal immigration will be sent to prison.

But there’s another reason why Democrats are keen to grant automatic citizenship to millions of illegal aliens: They see them as a huge constituency.

They don’t care that these illegals’ defiance of American immigration laws:

  • Floods the United States with millions of poor non-citizens who don’t speak English.
  • Overwhelms the public school system with children–who also don’t speak English–who require bilingual education.
  • Overwhelms the public healthcare system–especially emergency rooms–with poor illegal aliens.  As a result, urgently-needed medical care is often denied toAmerican citizens.

Click here: Cost of Unlawful Immigrants to the U.S. Taxpayers

But Republicans are equally guilty of refusing to take a hard stand against deporting those whose presence is a blatant affront to America’s immigration laws.

There are two reasons for this:

  1. Like Democrats, Republicans want to recruit them as knee-jerk voters.
  2. Republicans want them as low-skilled, low-wage fodder for their major campaign contributors–such as corporate-farms and retail outlets like Wal-Mart.

Unlike Democrats, however, Republicans like to feign outrage at the presence of so many illegal aliens within their midst.

It’s the Republican base that’s demanding an end to illegal immigration.

Those masses of alienated and angry whites who find themselves living in a nation that’s increasingly alien from themselves.

A nation where “Press One for English” is now the norm when contacting government agencies.  A nation where illegal aliens can obtain free medical care that’s denied to native-born citizens.

American citizens protesting illegal immigration

It was enraged citizens like this who, on June 10, 2014, cost Virginia Congressman Eric Cantor his bid for re-election.  Cantor’s 14-year political career crashed on the fury of Tea Party opposition to illegal immigration.

Still, the question remains: What should be done about the tens of thousands of illegals now swarming into the United States?

Democrats hasten to defend President Barack Obama’s refusal to deport en masse these violators.  They claim he is the victim of unpredictable circumstances.

But they don’t offer any solution that involves wholesale deportations of such invaders.  It’s as if they believe this onrushing tidal wave will somehow recede on its own momentum.

Meanwhile, Republicans essentially take the position of Mitt Romney, their failed 2012 Presidential candidate:  Self-deportation.

This way, the party doesn’t have to actually come out in favor of forcibly returning unwanted foreigners to their respective countries.

But there is a way the United States could deal with this unceasing tsunami of foreign invasions.  It might be called “The Zanti Misfits” solution.

CALIFORNIA ATTORNEY GENERAL DEFIED IMMIGRATION LAWS AS D.A.

In Bureaucracy, History, Law, Law Enforcement, Politics, Social commentary on July 8, 2015 at 11:34 am

On July 2, Kathryn Steinle decided to go for an evening stroll with her father along the San Francisco waterfront.

It was the last stroll the 32-year-old medical technology worker would ever take.

Kathryn Steinle

They were walking near Pier 14–a favorite area of the city’s tourists–when a pistol shot rang out.

Steinle, hit in the aorta, collapsed, crying, “Dad, help me, help me.”

Her father immediately gave her CPR before paramedics rushed Steinle to a hospital, where she died.

Her accused killer: Juan Francisco Lopez Sanchez, 45, an illegal alien with a history of seven felony convictions. He had been deported to his native Mexico five times, most recently in 2009.

Francisco Sanchez

On March 26, agents of U.S. Immigration and Customs Enforcement (ICE) turned Sanchez over to San Francisco police on an outstanding warrant.

On March 27, a San Francisco Superior Court judge dismissed charges of possession and distribution of marijuana against Sanchez.

Sanchez was released on April 15.

ICE had issued a detainer for Sanchez in March, requesting to be notified if he would be released.  But the detainer was not honored.

The reason?  San Francisco has been a “sanctuary city” for illegal aliens since 1989.  Its civic officials–acting as though they govern a city-state instead of a small, tourism-dependent city–openly defy Federal immigration laws.

As a result, city and local money cannot be spent on cooperating with Federal immigration authorities.

San Francisco is just one of 31 “sanctuary cities”: Washington, D.C.; New York City; Los Angeles, Chicago; Santa Ana; San Diego; Salt Lake City; Phoenix; Dallas; Houston; Austin; Detroit; Jersey City; Minneapolis; Miami; Denver; Baltimore; Seattle; Portland, Oregon; New Haven, Connecticut; and Portland, Maine.

Kathryn Steinle died because San Francisco authorities chose to defy the legal authority of the Federal Government.

But this is not the first time San Francisco officials have defied Federal immigration authorities–with brutal consequences for American-born citizens.

One of those officials–Kamala Harris–is now California’s Attorney General.

Kamala Harris

From 2004 to 2011, Harris had served as District Attorney for San Francisco. In total defiance of Federal immigration law, she set up a secret unit to keep even convicted illegal aliens out of prison–and in the United States.

San Francisco D.A.’s program trained illegal immigrants for jobs they couldn’t legally hold – Los Angeles Times

Her program, called Back on Track, trained them for jobs they could not legally hold.

One such alumnus was Alexander Izaguirre, an illegal alien who had pled guilty to selling cocaine. Four months later, in July, 2008, he assaulted Amanda Kiefer, a legal San Francisco resident.

Snatching her purse, he jumped into an SUV, then tried to run Kiefer down. Terrified, she leaped onto the hood and saw Izaguirre and a driver laughing.

The driver slammed on the brakes, sending Kiefer flying onto the pavement and fracturing her skull.

The program, Back on Track, became a centerpiece of Harris’ campaign for state Attorney General in 2010.

Steve Cooley, Los Angeles County District Attorney (2000-2012) ran against Harris for the position.  He could have raised Harris’ defiance of Federal law against her: The Los Angeles Times had broken the story in 2009.

But Cooley didn’t have the courage to do it.

Until she was questioned by the Los Angeles Times about the Izaguirre case, Harris had never publicly admitted that the program included illegal aliens.

Harris claimed she first learned that illegal aliens were training for jobs only after Izaguirre was arrested for the Kiefer assault.

Harris said it was a “flaw in the design” of the program to let illegal aliens into the program. “I believe we fixed it,” she told the Times.

Harris never released statistics on how many illegal aliens were included since the program started in 2005.

She said that after Izaguirre’s arrest she never asked–or learned–how many illegal aliens were in Back on Track.

When Harris learned that illegal aliens were enrolled, she allowed those who were following the rules to finish the program and have their criminal records expunged.

It is not the duty of local law enforcement, she said, to enforce Federal immigration laws.

So much for her oath to faithfully defend the Constitution of the United States and that of the state of California “against all enemies, foreign and domestic.”

From 2005 to 2009, 113 admitted drug dealers graduated from Back on Track.  Another 99 were kicked off the program for failing to meet the requirements.  They were sentenced under their guilty plea, the D.A.’s office claimed.

Harris told the Times that graduates of Back on Track were less likely than other offenders to commit crimes again.  But her spokeswoman refused to offer detailed statistics to back this up.

When Harris became San Francisco District Attorney, she vowed she would “never charge the death penalty.” Her opposition to capital punishment would be better-suited to a public defender.

Meanwhile, Amanda Kiefer left California.  Interviewed by the Times, she said she could not understand why San Francisco police and prosecutors would allow convicted illegal aliens back onto the streets.

“If they’re committing crimes,” she said, “I think there’s something wrong that they’re not being deported.”

It’s a sentiment that law-abiding Americans agree with.  And it should go double for those who are charged with enforcing the law.

Except in times of war, no nation has ever been invaded by so many alien residents as the United States.

In recent months, tens of thousands of unaccompanied minors–all of them uninvited–have illegally entered the United States through the Mexican border.

They are backed up by an estimated 11 to 20 million illegal aliens now living more or less openly throughout the country.

Just as sheer numbers of Mexicans overwhelmed the defenders of the Alamo, this similar Hispanic tidal wave has overwhelmed immigration officials.

For years, Republicans and Democrats have clashed over the subject of illegal immigration.  Each side has taken what seems to be an opposing position.

Democrats favor wholesale grants of unearned citizenship to the estimated 11 to 20 million illegal alilens who brazenly violated the law when they sneaked across American borders.

And Republicams favor beefing up security against future waves of such invaders.

But the brutal truth is that neither Democrats nor Republicans truly want to end these invasions.  Nor do they want to deport the millions of illegals who have already taken up residence here.

  • in the country legally;
  • have the means to sustain themselves economically;
  • not destined to be burdens on society;
  • of economic and social benefit to society;
  • of good character and have no criminal records; and
  • contribute to the general well-being of the nation.

The law also ensures that:

  • immigration authorities have a record of each foreign visitor;
  • foreign visitors do not violate their visa status;
  • foreign visitors are banned from interfering in the country’s internal politics;
  • foreign visitors who enter under false pretenses are imprisoned or deported;
  • foreign visitors violating the terms of their entry are imprisoned or deported;

  • Overwlems the public school system with children–who also don’t speak English–who require bilingual education.
  • Overwhelms the public healthcare system–especially emergency rooms–with poor illegal aliens.  As a result, urgently-needed medical care is often denied to American citizens.

It was enraged citizens like this who, on June 10, cost Virginia Congressman Eric Cantor his bid for re-election.

LAW ENFORCERS AS APOLOGISTS

In Bureaucracy, History, Law, Law Enforcement, Politics, Social commentary on May 6, 2014 at 12:55 am

Alone among major world powers, the United States feels it must apologize for the right to control its own borders.

A flagrant example of this occurred four years ago–in May, 2010.

First Lady Michelle Obama-accompanied by Margarita Zavala, the wife of then-Mexican President Felipe Calderón, was visiting a second-grade class in Silver Spring, Md.

“The truth is that more mothers and fathers were deported in Obama’s first year as president than were deported in the last year under Bush.”

“Mr. Obama, who so eloquently spoke of the pain and anguish caused by tearing families apart as a candidate, as president has only ramped up that pain and anguish,” said Bhargava.

Michelle Obama is the wife of the nation’s chief law enforcement officer–the President of the United States.

Yet on the day following the girl’s public admission, the Department of Homeland Security announced that its immigration agents would not be pursuing the family:

“ICE [Immigration and Customs Enforcement] is a federal law enforcement agency that focuses on smart, effective immigration enforcement that prioritizes criminal aliens who pose a threat to our communities.

“Our investigations are based on solid law enforcement work and not classroom Q and As.”

“The girl is in school and we’re doing everything we can to keep her safe,” said Brian Edwards, chief of staff for the Montgomery County public schools.

Depending on the source, the estimated number of illegal aliens within the United States ranges from about 7 to 20 million or more.

Click here: Illegal immigrants in the US: How many are there? – CSMonitor.com

  • in the country legally;
  • have the means to sustain themselves economically;
  • not destined to be burdens on society;
  • of economic and social benefit to society;
  • of good character and have no criminal records; and
  • contribute to the general well-being of the nation.

The law also ensures that:

  • immigration authorities have a record of each foreign visitor;
  • foreign visitors do not violate their visa status;
  • foreign visitors are banned from interfering in the country’s internal politics;
  • foreign visitors who enter under false pretenses are imprisoned or deported;
  • foreign visitors violating the terms of their entry are imprisoned or deported;

All of the major leaders of the Revolution–Francisco Madero, Emiliano Zapata, Venustiano Carranza, Francisco “Pancho” Villa, Alvaro Obregon–died in a hail of bullets.

There is no guarantee that such demands would not lead to a second–and equally bloody–Mexican revolution.

So successive Mexican governments find it easier–and safer–to turn the United States into a dumping ground for the Mexican citizens that the Mexican Government itself doesn’t want.

“A TEAM PLAYER”: PART TWO (END)

In Bureaucracy, Business, History, Law, Law Enforcement, Politics, Social commentary on April 9, 2014 at 12:01 am

In 1959,, J. Edgar Hoover, the legendary director of the FBI, declared war on the Mafia.

He set up a Top Hoodlum Program and encouraged his agents to use wiretapping and electronic surveillance (“bugging”) to make up for lost time and Intelligence.

But Hoover also imposed a series of restrictions that could destroy an agent’s professional and personal life.

William E. Roemer, Jr., assigned to the FBI’s Chicago field office, was one of the first agents to volunteer for such duty.

In his memoirs, Man Against the Mob, published in 1989, Roemer laid out the dangers that went with such work:

  1. If confronted by police or mobsters, agents were to try to escape without being identified.
  2. If caught by police, agents were not to identify themselves as FBI employees.
  3. They were to carry no badges, credentials or guns–or anything else connecting themselves with the FBI.
  4. If they were arrested by police and the truth emerged about their FBI employment, the Bureau would claim they were “rogue agents” acting on their own.
  5. Such agents were not to refute the FBI’s portrayal of them as “rogues.”

If he had been arrested by the Chicago Police Department and identified as an FBI agent, Roemer would have:

  1. Definitely been fired from his position as an FBI agent.
  2. Almost certainly been convicted for at least breaking and entering.
  3. Disbarred from the legal profession (Roemer was an attorney).
  4. Perhaps served a prison sentence.
  5. Been disgraced as a convicted felon.
  6. Been unable to serve in his chosen profession of law enforcement.

Given the huge risks involved, many agents, unsurprisingly, wanted nothing to do with “black bag jobs.”

The agents who took them on were so committed to penetrating the Mob that they willingly accepted Hoover’s dictates.

In 1989, Roemer speculated that former Marine Lieutenant Colonel Oliver North had fallen victim to such a “Mission: Impossible” scenario: “The secretary will disavow any knowledge of your actions….”

In 1986, Ronald Reagan’s “arms-for-hostages” deal known as Iran-Contra had been exposed.

To retrieve seven Americans taken hostage in Beirut, Lebanon, Reagan had secretly agreed to sell some of America’s most sophisticated missiles to Iran.

During this operation, several Reagan officials–including North–diverted proceeds from the sale of those missiles to fund Reagan’s illegal war against the Sandinistas in Nicaragua.

In Roemer’s view: North had followed orders from his superiors without question.  But when the time came for those superiors to step forward and protect him, they didn’t.

They let him take the fall.

Roemer speculated that North had been led to believe he would be rescued from criminal prosecution.  Instead, in 1989, he was convicted for

  • accepting an illegal gratuity;
  • aiding and abetting in the obstruction of a congressional inquiry; and
  • ordering the destruction of documents via his secretary, Fawn Hall.

That is how many employers expect their employees to act: To carry out whatever assignments they are given and take the blame if anything goes wrong.

Take the case of Wal-Mart Stores, Inc., the world’s biggest retailer.

In March, 2005, Wal-Mart escaped criminal charges when it agreed to pay $11 million to end a federal probe into its use of illegal aliens as janitors.

Agents from Immigration and Customs Enforcement (ICE) raided 60 Wal-Mart stores across 21 states in October, 2003.  The raids led to the arrest of 245 illegal aliens.

Federal authorities had uncovered the cases of an estimated 345 illegal aliens contracted as janitors at Wal-Mart stores.

Many of the workers worked seven days or nights a week without overtime pay or injury compensation. Those who worked nights were often locked in the store until the morning.

According to Federal officials, court-authorized wiretaps revealed that Wal-Mart executives knew their subcontractors hired illegal aliens.

Once the raids began, Federal agents invaded the company’s headquarters in Bentonville, Ark., seizing boxes of records from the office of a mid-level executive.

Of course, Wal-Mart admitted no wrongdoing in the case.  Instead, it blamed its subcontractors for hiring illegal aliens and claiming that Wal-Mart hadn’t been aware of this.

Which, of course, is nonsense.

Just as the FBI would have had no compunctions about letting its agents take the fall for following orders right from the pen of J. Edgar Hoover, Wal-Mart meant to sacrifice its subcontractors for doing precisely what the company’s executives wanted them to do.

The only reason Wal-Mart couldn’t make this work: The Feds had, for once, treated corporate executives like Mafia leaders and had tapped their phones.

Which holds a lesson for how Federal law enforcement agencies should treat future corporate executives when their companies are found violating the law.

Instead of seeing CEOs as “captains of industry,” a far more realistic approach would be giving this term a new meaning: Corrupt Egotistical Oligarchs.

A smart investigator/prosecutor should always remember:

Widespread illegal and corrupt behavior cannot happen among the employees of a major government agency or private corporation unless:

  1. Those at the top have ordered it and are profiting from it; or
  2. Those at the top don’t want to know about it and have taken no steps to prevent or punish it.

HELL HATH NO FURY

In Bureaucracy, History, Politics on March 28, 2013 at 12:02 am

Hell hath no fury like a bureaucrat enraged.

On March 14, John Morton, the director of U.S. Immigration and Customs Enforcement (ICE), admitted to Congress that, for three weeks in February, his agency had released 2,228 illegal aliens from immigration jails.

Previously, the Obama administration had claimed that only “a few hundred immigrants” had been released.

The alleged reason: Automatic budget cuts required by the Congressionally-imposed sequestration.

“We were trying to live within the budget that Congress had provided us,” Morton told lawmakers. “This was not a White House call. I take full responsibility.”

Morton and other agency officials spoke during a hearing by the House subcommittee on Homeland Security.

ICE officials had previously claimed that illegal aliens were routinely released.  But Rep. John Carter, R-Texas, the subcommittee’s chairman, didn’t buy this.

Carter pressed Morton about the claim.  And Morton admitted that the release of more than 2,000 illegal aliens was not routine.

Carter was rightly angered–more aliens were released in Texas than in any other state.

But, in hindsight, he shouldn’t be surprised.  This is usually how bureaucracies react when forced to carry out decisions they dislike.

Consider two such incidents during the Presidency of John F. Kennedy.

John F. Kennedy

In April, 1962, U.S. Steel raised its prices by $6 a ton, and other American steel companies quickly followed suit.

Convinced that the price-raise would be inflationary, Kennedy demanded that the steel companies rescind it.  When the companies refused, JFK was furious: “My father always told me all businessmen were sonsofbitches, but I never belileved him till now.”

Then he turned to his brother, Robert, then the Attorney General.  And RFK, in turn, turned to J. Edgar Hoover, the director of the FBI.

RFK had run the Justice Department since January, 1961.  Hoover had run the FBI since 1924.

And by now, he and Hoover detested each other.

J. Edgar Hoover and Robert F. Kennedy

Kennedy had been pressing the FBI to greatly expand its efforts against organized crime and violators of civil rights laws.

Hoover had long maintained there was no nationwide Mafia, only a loose assembly of hoodlums whose crimes did not fall under federal jurisdiction.

And Hoover–a staunch segregationist–wanted nothing to do with enforcing civil rights laws.

There were also differences in style between the two men which highlighted their mutual animosity.  RFK was 36 in 1962; Hoover was 67.  RFK was accustomed to showing up for work in his shirt sleeves; Hoover was always attired in a business suit.

RFK didn’t hesitate to pop into offices–including those of FBI agents–and start asking questions about cases he cared about.  Hoover demanded adherence to a rigid chain-of-command, with himself at its top.

RFK bellieved that the steel companies had illegally colluded to fix prices.  He told Hoover he wanted a full field investigation opened immediately into the steel companies.

As RFK put it: We’re going for broke…their expense accounts, where they’ve been a|nd what they’ve been doing…the FBI is to interview them all …we can’t lose this.”

He ordered the collection of evidence–both personal and professional–from the homes and offices of steel executives.

Hoover saw an opportunity to embarrass RFK while supposedly carrying out orders: He ordered FBI agents to visit the homes of steel executives in the middle of the night.  Even reporters covering the crisis got late-night calls from the Bureau.

On April 13, beginning with Inland Steel, all of the steel companies informed the White House of their decision to refrain from price increases.

But the President’s victory soon turned sour. The press assailed the “Gestapo” tactics he had used against the steel companies.  A cartoon that appeared in the New York Herald Tribune summed it up.

In it, Kennedy’s press secretary, Pierre Salinger, tells the President: “Khrushchev said he liked your style in the steel crisis.”  JFK was so outraged that he canceled the White House subscription to the Tribune.

The FBI scored another victory at the Kennedys’ expense through Robert’s pursuit of organized crime.

RFK wanted the FBI to share its vast treasury of intelligence with other Federal law enforcement agencies charged with pursuing the Mob.  But Hoover refused, claiming the FBI’s files were too sensitive to entrust to other agencies.  And he threatened to resign if pushed too far on this.

This deprived Federal organized crime “strike forces” of essential intelligence.

Hoover, desperate to make up for lost time in pursuing organizeed crime investigations, called on the same tactics he had used against the Communist Party.

He ordered his agents to secretly install wiretaps and electronic bugs in mob hangouts across the country.  This allowed the FBI to quickly learn who was who and doing what in the otherwise impenetrable world of the Mafia.

But in 1965, word leaked out that the FBI had bugged numerous casinos in Las Vegas.  The Bureau faced serious embarrassment.

Hoover, the master bureaucrat, blamed RFK.  He claimed that the Attorney General (who had retired from office in 1964 and become the junior Senator from New York) had authorized him to install bugs and wiretaps.

RFK–who was trying to remake himself as a liberal politician–was hugely embarrassed.

The antagonism between Kennedy and Hoover lasted until the day Kennedy died–on June 6, 1968, after being shot while running for President.
