LIES TOLD BY BULLIES: PART ONE (OF TWO)

There are two ways to deal with bullies: Submit to them—or stand up to them.

Here are three stories of what happened when intended victims counterattacked their would-be predators.

Story #1:

Karen Handel, vice president of public affairs for Susan G. Komen for the Cure, had it all worked out.

She had fashioned what she believed was a politically viable plan for Komen to pull its grant monies from Planned Parenthood (PP).

She didn’t care that this money went entirely for breast cancer screenings for poor women. What she did care about was that about 3% of all PP revenues went toward providing abortion services.

Since being hired by Komen as vice president of public affairs, in April, 2011, Handel had pushed to drop PP from grants. She had promised to de-fund PP during her failed 2010 campaign for governor of Georgia. 

So, in 2012, she made her move.

The official version, as put out by Handel and the top brass of Komen, went: “We’ve halted grants to Planned Parenthood because it’s under investigation by Congress for misuse of funds.”

Unfortunately for Komen, the public instantly saw through the lie. And the results for Komen were as devastating as those that threatened to engulf Arizona two years later.

Any crank in Congress can start an “investigation” into anything.

And PP was “under investigation” by a crank: Rep. Cliff Stearns (R-Fla.), chairman of the Energy and Commerce Subcommittee on Oversight and Investigations.

Stearns, a fanatical anti-abortionist, claimed he wanted to determine whether PP had spent public money on abortions over the last decade.

But Stearns didn’t hesitate to slander the patriotism of thousands of 9/11 “first responders”–the police, firefighters, construction workers and others who risked their lives to save their fellow Americans.

He did so by demanding that they submit their names, birthplaces, addresses, government ID numbers and other personal data to the FBI to prove they were not terrorists. 

Only then could they receive federally-subsidized medical care for injuries caused by exposure to toxic dust and debris at the site.  

Not one terrorist was discovered in the resulting investigations.

Public outrage at Komen was immediate and overwhelming:

  • More than 50 members of Congress signed letters asking  Komen to reverse course.
  • New York City Mayor Michael Bloomberg publicly rebuked Komen and pledged $250,000   to PP.
  • Approximately 37,000 people from all over the country signed a petition demanding Handel’s resignation.
  • PP raised nearly $3 million in contributions.

Reeling before this onslaught of criticism, Komen issued a statement: “We will continue to fund existing grants, including those of Planned Parenthood, and preserve their eligibility to apply for future grants.”

Having failed in their latest assault on women’s rights, the Right’s would-be predators now portrayed themselves as victims:

  • “The last time I checked,” Handel told Right-wing Fox News, “private non-profit organizations have a right and a responsibility to be able to set the highest standards and criteria on their own without interference, let alone the level of vicious attacks and coercion that has occurred by Planned Parenthood. It’s simply outrageous.”
  • “Planned Parenthood campaigns to destroy anyone who questions them,” charged Marjorie Dannenfelser, president of the anti-abortion Susan B. Anthony List.
  • “Their attitude is that of an immature teenager with an enormous sense of entitlement. This is just more proof that Planned Parenthood will pulverize anyone who dares to question them,” Dannenfelser said.
  • “What Planned Parenthood did to that venerable and honorable organization [Komen Foundation] is nothing less than a Mafia-style shakedown,” said Steven H. Aden, senior counsel for the Alliance Defense Fund. The Fund bitterly opposes abortion, gay marriage, birth control and the separation of church and state.

Many conservatives correctly defended Komen’s right, as a private charitable organization, to give—or withhold—its money as it saw fit.

But these same conservatives refused to grant PP’s outraged supporters the same right: To withhold their own monies from Komen. 

National Review’s Daniel Foster called the backlash to Komen “disgusting,” attacking PP and “the Left” for their “gangsterism.”

Story #2:

Two years later, in 2014, the Right made another move to strip Americans it didn’t like of their most basic rights.  Their weapon of choice: Arizona Senate Bill 1062.

The legislation had been passed by the Republican-controlled State House of Representatives and Senate. Its intent: 

  • Allow business owners to turn away gay and lesbian customers.
  • Allow employers to deny equal pay to women.
  • Allow individuals to renege on contract obligations.  
  • Allow hospitals to refuse to provide medical care to a gay or lesbian patient.

And all of these actions would have been legally protected—so long as “sincere religious belief” was cited  as the reason.

The legislation was written by the Right-wing advocacy group Center for Arizona Policy and the Christian legal organization, Alliance Defending Freedom. 

Officially, its intent was to prevent the government from forcing business owners to act in ways contrary to strongly held religious beliefs.

Unofficially, its intent was to appease the hatred of gays and lesbians by the religious Right, a key constituency of the Republican party.

Gays and their supporters reacted by threatening a legal business and tourism boycott of Arizona.  And the business community and its supporters, alarmed, took notice. 

THE NEWS MEDIA: FACING SOME PAINFUL TRUTHS

On September 27, 2020, The New York Times broke the unprecedented story of President Donald Trump’s tax returns, which he has long held secret. 

Among the revelations: He paid no federal income taxes at all for 10 of 15 years. And he paid only $750 in taxes in 2016 and 2017.

For most newspapers and TV networks, such investigative reporting is a rarity. Most media outlets are little more than “happy news” or propaganda organs.

Two years earlier, on April 28, 2018, comedian Michelle Wolf had hosted the annual White House Correspondents Dinner in Washington, D.C. There she skewered high-ranking Trump administration officials and members of the nation’s elite media.

Most of here jokes were focused on Trump administration officials—especially then-Press Secretary Sarah Huckabee Sanders.

But Wolf threw a series of sharp-edged zingers at some of the Nation’s most prominent media. And these comments have gone largely ignored.

They are, however, well worth examining—for the uncomfortable truths they reveal about much of the “news” being served up under the guise of fearless objectivity.

On CNN—where “news” now largely consists of a series of “talking heads” pontificating about stories that other journalists have dug up:  We’ve got our friends at CNN here. You guys love breaking news, and you did it. You broke it. Good work. The most useful information on CNN is when Anthony Bourdain tells me where to eat noodles.

On Fox News’ sexual harassment scandals involving such prominent (and former) members as CEO Roger Ailes and commentator Bill O’Reilly:  Fox News is here. So, you know what that means, ladies: Cover your drinks. Seriously.

On Fox News’ actual role as the propaganda organ of the Republican party:  People want me to make fun of [Fox News commentator] Sean Hannity tonight, but I cannot do that; this dinner is for journalists.

News Media

On weak-rated MSNBC, which is the liberal version of Fox News:  We’ve got MSNBC here. MSNBC’s news slogan is, “This is who we are.” Guys, it’s not a good slogan. “This is who we are” is what your mom thinks the sad show on NBC is called. “Did you watch ‘This Is Who We Are’ this week? Someone left on a Crockpot, and everyone died.”

On Megyn Kelly, who rose to fame and fortune as a Right-wing propaganda shill on Fox News:  And, of course, Megyn Kelly. What would I do without Megyn Kelly? You know, probably be more proud of women. 

And, by the way, Megyn, Santa’s black. The weird old guy going through your chimney was Bill O’Reilly. You might want to put a flue on it or something.  

[This last jibe centered on Kelly’s infamous December 11, 2013 Fox broadcast where she claimed: “I kind of laughed and said this is so ridiculous.  Yet another person claiming it’s racist to have a white Santa. For all you kids watching at home, Santa just is white….Just because it makes you uncomfortable doesn’t mean it has to change. Jesus was a white man too.”]

On the continuing demise of newspapers—on which TV “news reporters” depend for their information:  There’s a lot of print media here. There’s a ton of you guys, but I’m not going to go after print media tonight because it’s illegal to attack an endangered species. Buy newspapers.

On the media’s—especially the television media’s—morbid obsession with Donald Trump:  There’s a ton of news right now; a lot is going on, and we have all these 24-hour news networks, and we could be covering everything. But, instead, we’re covering like three topics. Every hour, it’s Trump, Russia, Hillary and a panel of four people who remind you why you don’t go home for Thanksgiving.

On the media’s responsibility for the rise of a President they now detest: You guys are obsessed with Trump. Did you used to date him? Because you pretend like you hate him, but I think you love him. I think what no one in this room wants to admit is that Trump has helped all of you. He couldn’t sell steaks or vodka or water or college or ties or Eric, but he has helped you.

He’s helped you sell your papers and your books and your TV. You helped create this monster, and now you’re profiting off of him. And if you’re gonna profit off of Trump, you should at least give him some money because he doesn’t have any.

[This last joke was probably the most painful the assembled media bigwigs had to endure. Because it’s undeniably true.

Trump’s campaign was saved from spending millions on TV advertising because the major TV news networks covered his every word. This was especially true when he was attacking women, blacks, Mexicans, Hillary Clinton, Barack Obama—and even beauty pageant contestants.

Trump was “good for the news media” in the same way that Mike Tyson was “good for boxing.” 

Both Trump and Tyson were seen as freaks—and thus guaranteed to lure viewers eager to find out: “What outrageous thing has he done now?”]  And more viewers meant higher ratings–which meant money.

WANT TO STOP GUN MASSACRES? HERE’S HOW

What should the surviving victims of gun massacres do to seek redress?

And how can the relatives and friends of those who didn’t survive seek justice for those they loved?

Two things:

First, don’t count on politicians to support a ban on assault weapons.

Politicians—with rare exceptions—have only two goals:

  1. Get elected to office, and
  2. Stay in office.

And too many of them fear the economic and voting clout of the National Rifle Association (NRA) to risk its wrath.

This is especially true for Republican members of Congress. They have opposed background checks on gun buyers—while allowing criminals and terrorists to own firearms. They champion the sale of assault weapons—which were designed for use by the military, not civilians.

They speak directly to those masses of disaffected Americans for whom the Second Amendment is the Constitution. And they know they can count on those voters to give them lifetime tenure in Congress.

Second, those who survived the massacre—and the relatives and friends of those who didn’t—should file wrongful death, class-action lawsuits against the NRA.

There is sound, legal precedent for this.

  • For decades, the American tobacco industry peddled death and disability to millions and reaped billions of dollars in profits.
  • The industry vigorously claimed there was no evidence that smoking caused cancer, heart disease, emphysema or any other ailment.

  • Tobacco companies spent billions on slick advertising campaigns to win new smokers and attack medical warnings about the dangers of smoking.
  • Tobacco companies spent millions to elect compliant politicians and block anti-smoking legislation.
  • From 1954 to 1994, over 800 private lawsuits were filed against tobacco companies in state courts. But only two plaintiffs prevailed, and both of those decisions were reversed on appeal.
  • In 1994, amidst great pessimism, Mississippi Attorney General Mike Moore filed a lawsuit against the tobacco industry. But other states soon followed, ultimately growing to 46.
  • Their goal: To seek monetary, equitable and injunctive relief under various consumer-protection and anti-trust laws.
  • The theory underlying these lawsuits was: Cigarettes produced by the tobacco industry created health problems among the population, which badly strained the states’ public healthcare systems.
  • In 1998, the states settled their Medicaid lawsuits against the tobacco industry for recovery of their tobacco-related, health-care costs. In return, they exempted the companies from private lawsuits for tobacco-related injuries.
  • The companies agreed to curtail or cease certain marketing practices. They also agreed to pay, forever, annual payments to the states to compensate some of the medical costs for patients with smoking-related illnesses.

The parallels with the NRA are obvious:

  • For decades, the NRA has peddled deadly weapons to millions, reaped billions of dollars in profits and refused to admit the carnage those weapons have produced: “Guns don’t kill people.  People kill people.”  With guns.
  • The NRA has bitterly fought background checks on gun-buyers, in effect granting even criminals and the mentally ill the right to own arsenals of death-dealing weaponry.
  • The NRA has spent millions on slick advertising campaigns to win new members and frighten them into buying guns.

  • The NRA has spent millions on political contributions to block gun-control legislation.
  • The NRA has spent millions attacking political candidates and elected officials who warned about the dangers of unrestricted access to assault and/or concealed weapons.

  • The NRA has spent millions pushing “Stand Your Ground” laws in more than half the states, which potentially give every citizen a “license to kill.”
  • The NRA receives millions of dollars from online sales of ammunition, high-capacity ammunition magazines, and other accessories through its point-of-sale Round-Up Program—thus directly profiting by selling a product that kills about 30,288 people a year.
  • Firearms made indiscriminately available through NRA lobbying have filled hospitals with casualties, and have thus badly strained the states’ public healthcare systems.

It will take a series of highly expensive and well-publicized lawsuits to significantly weaken the NRA, financially and politically.

The first ones will have to be brought by the surviving victims of gun violence—and by the friends and families of those who did not survive it. Only they will have the courage and motivation to take such a risk.

As with the cases first brought against tobacco companies, there will be losses.  And the NRA will rejoice with each one.

But, in time, state Attorneys General will see the clear parallels between lawsuits filed against those who peddle death by cigarette and those who peddle death by armor-piercing bullet.

And then the NRA—like the tobacco industry—will face an adversary wealthy enough to stand up for the rights of the gun industry’s own victims.

Only then will those politicians supporting reasonable gun controls dare to stand up for the victims of these needless tragedies.

THE WHEELS ON THE BUS GO NOWHERE

The San Francisco Municipal Railway (MUNI) is the public transit system for the city and county of San Francisco, California.

In 2018, MUNI, with a budget of about $1.2 billion, served 46.7 square miles. It is the seventh largest transit system—in terms of ridership—in the nation.

Its bus drivers are the highest-paid bus drivers in the nation.

The average MUNI driver makes $79,617, 51% above the national average bus driver salary of $52,730.

This pay is 27% higher than the combined average salaries of drivers in Dallas, Boston and Atlanta.

And yet: What are San Francisco residents getting for all that money being paid out?

Far less than they deserve.

Since the arrival of the Coronavirus plague in San Francisco in early March, 2020, MUNI has:

  • Offered fewer bus routes
  • Made it impossible to guess when a bus will stop
  • Reduced the number of buses and
  • Scrapped its underground lines altogether.

What does all this mean?

It means that, of MUNI’s 89 routes, all but 17 have been eliminated.

MUNI claimed that the cuts were made to allow for increased social distancing on the most vital routes. How riders were supposed to increase social distancing on fewer buses was not explained.

The 38 Geary bus line—which travels east and west—is the most heavily-traveled route in the city. In pre-COVID times, these buses were packed, often with passengers standing close together in the aisles after all available seats were taken.

Loudspeakers aboard MUNI buses regularly tell passengers to socially distance from each other—that is, put at least six feet between themselves and their fellows.

But with far fewer buses running, MUNI passengers can’t be sure when—or if—the next one will arrive when they need to catch it.

So residents don’t hesitate: They scramble aboard, en masse, the first bus that shows up.

This makes social distancing impossible on most rides.

MUNI loudspeakers also tell passengers “You must wear a mask to board MUNI.”  And most passengers do wear a mask when they board.

But that doesn’t mean all of them do—especially those who board through the rear doors, out of sight of the driver way up in front. 

Even when passengers wear masks, they often do so just under their nose or chin—meaning they can sneeze or cough potentially lethal germs on anyone sitting near them.

Another drawback to riding MUNI: Buses don’t always stop when you pull the “Stop” cord. 

Suppose you board the 49 Van Ness at Sutter Street. Now suppose you’re a senior, or disabled, or have a couple of bags of groceries you need to lug up to your apartment. 

The 49 boards at Sutter, but it doesn’t stop until it reaches Jackson Street—which means you pass Bush, Pine, California, Sacramento, Washington and Clay before you reach Jackson.

And if your apartment lies somewhere between Sutter and Jackson, you’re going to have to forego riding MUNI and walk north to it, or you’re going to have to get off at Jackson and walk south to it.

Not content with making above-ground routes needlessly complicated and even dangerous, MUNI has eliminated its underground routes. 

These featured fewer stops over longer distances, thus reducing the amount of time you had to be on board.

MUNI’s official reason for this: To protect its drivers from the dangers of COVID-19.

Meanwhile, the Bay Area Transit System (BART) which serves cities well beyond San Francisco, continues to use its network of underground and above-ground stations.

No one at MUNI has yet explained why its drivers can’t do what BART’s have done for the last year.

And while all this is going on, city officials—specifically, the Mayor and Board of Supervisors—are relentlessly pushing to make San Francisco “car-unfriendly.”

This has long been their goal. And COVID-19 has made it possible for city leaders to aggressively pursue it under the guise of helping restaurants.

Countless spots that once were reserved for parking have been turned into outdoor dining sites. This seems to makes sense for restaurants, which have taken a beating since indoor dining was banned due to COVID. 

But outdoor dining isn’t as safe as many people think.

Sure, you and the person(s) you’re eating with may not be COVID-infected. But what about the people at the packed table just a couple of feet away from you?

And what about the pedestrians who often must walk between unmasked diners on either side of a sidewalk? 

Offering a mixture of incentives and deterrents has long been a preferred method for winning compliance. In Mexico, this has been famously termed “Pan o palo” (“bread or the stick”).

San Francisco has chosen to offer a sticks-only policy:

  • Allow its bus service to treat its patrons with infuriating contempt; and
  • Make it ever harder for residents and tourists to use private automobiles to reach their destinations.

It’s a recipe guaranteed to cost the city dearly—in both residents and tourists.

WHEN A COMPANY/AGENCY IGNORES YOUR PROBLEM

How many times have you called a government agency or company and instantly found yourself put on hold?

To add insult to injury, you usually wind up serenaded by recorded music that would be totally forgettable if it weren’t so unforgivably irritating.

And every 30 seconds or so a recorded voice comes on to assure you: “Your call is very important to us.”

Have you ever wondered:If my call is so important to you, why aren’t you answering it?” 

The truth is that most companies and government agencies don’t want their employees speaking with the customers who make their existence a reality.

Having your questions answered by another human being requires the company/agency to assign—and pay—people to do just that.

Most hiring managers don’t want to hire any more people than they absolutely have to. They want to siphon off as much of the company’s profits for themselves as possible.

And assigning people to answer customers’ calls means that many of those calls will take time to answer, because some problems can’t be solved in a matter of seconds. 

Even government agencies like police departments don’t want to spend any more time than necessary taking the calls of those who need to reach them.

Even calls to 911 can leave you talking to no one, with only a recorded message telling you to wait until someone deigns to speak with you.

And you’re no closer to solving the problem that caused you to phone the company/agency in the first place.

What to do? 

For starters, don’t lose heart. There are usually a great many things you can do to obtain the help you need.

  • Go on the Internet and look up the company’s/agency’s website. 
  • Look for links to their Board of Directors. Often enough you’ll get not only their names but their bios, phone numbers and even email addresses.
  • Look at the bottom of the website page. Many companies/agencies put this information there–and usually in small print.
  • Look for the names of officials who can help you—those at the top, or at least high enough so that whoever responds to your call/letter/email has the necessary clout to address your problem.
  • If you call, don’t ask to speak directly with Mr. Big. Ask to speak with Mr. Big’s secretary, who is far more accessible.
  • Keep your tone civil, and try to make your call as brief as possible. Don’t go into a lot of background about the problems you had getting through.
  • Give the gist and ask for a referral to someone who can help resolve your problem.
  • If the secretary needs more time to study the problem before referring you to someone else, be patient.
  • Answer any questions asked—such as your name, address, phone number and/or email.
  • State—specifically—what you want the company to do to resolve your problem.  If you want a refund or repairs for your product, say so.

  • If you want a refund, don’t ask for more money than you paid for the product. 
  • If you want to return a product for an exchange, don’t expect the company to give you a new one with even more bells and whistles—unless you’re willing to pay the difference in price.
  • If you want an agency to investigate your complaint, don’t expect them to do so instantly.  Give them time to assess your information and that supplied by others.
  • It’s usually possible to get one agency to sit on another—if you can make a convincing case that it’s in that secondary agency’s best interests to do so.  
  • That doesn’t guarantee they will resolve your problem. But if you can show that the agency will gain by it—such as getting good publicity.
  • If a company/agency official has acted so outrageously that the company/agency might be held liable for his actions, don’t be afraid to say so. But don’t threaten to sue.
  • Just point out that the employee has acted in such a way as to jeopardize the company’s/agency’s reputation for integrity/efficiency and that the organization is not well-served by such behavior.
  • Whoever reads your letter/email will instantly realize the legal implications of what you’re saying—and, in most cases, will take quick action to head off a lawsuit by trying to satisfy your request. 
  • Give the CEO’s secretary at least one to two days to get back to you. Remember: Resolving your problem isn’t the only task she needs to complete.
  • If you’re writing the CEO, make sure you use his full name and title–and that you spell both correctly. People don’t get to be CEOs without a huge sense of ego. Nothing will turn him off faster than your failing to get his name and title exactly right.
  • As in the case with his secretary, be brief—no more than a page and a half. Outline the problem you’re having and at least some (though not necessarily all) of the steps you’re taken to get it resolved.
  • Then state what you want the company to do.  Again, be fair and reasonable.

SKIP CHRISTMAS AND SAVE MONEY–AND PROBABLY YOUR LIFE

There are several good reasons for skipping Christmas this year—if not in years beyond 2020.

Reason #1: The historical realities behind the event.

  • There is no reference anywhere in the Bible to the month, day—or even the year—of Jesus’ birth. 
  • There are no sources outside the Bible that give a date to Jesus’ birth.
  • Jesus never commanded his followers to celebrate his birth—but he did call on them to remember his death.  It’s called Easter.
  • Many of the “religious” traditions associated with Christmas stem from the pagan Roman festival, Saturnalia, which celebrated the “birthday” of the sun.
  • This was celebrated December 17-25. 
  • Saturnalia traditions included feasting, gift-giving, lighting candles (to ward off evil spirits) and displaying wreaths (as a sign of coming spring).
  • Early Christians tried mightily to convince their members to stop celebrating the Saturnalia.
  • When these efforts failed, the Roman Catholic Church, in 336 A.D. “Christianised” the festival by naming Saturnalia’s concluding day, December 25, as Jesus’ birthday.

Reason #2: It’s based on a story that’s patently false.

The story of the Three Wise Men—or Kings—bringing gifts to the infant Jesus was added long after Jesus’ birth.

Realistically, there was no reason why anyone in Israel would have known—or cared—about the birth of yet another Jewish child.

If he had actually been born the son of a king, then his birth might have mattered to people generally. 

In his 1973 bestselling Alexander the Great, Robin Lane Fox explains that “in antiquity…life’s perspective was reversed, and youth was mostly described through a series of anecdotes which falsely mirrored the feats of the adult future; proven kings or bishops were remembered as kings or bishops when young.”

Thus, Alexander the Great, the future conqueror of the Persian empire, has been depicted—as a boy—astonishing Persian ambassadors with precocious questions about the innermost workings of that empire.

For followers of the crucified Jesus, it was essential to establish his divinity from the outset of his birth. And what better way to do this than having not one but three Kings show up, uninvited, to declare his reign over them?

Reason #3: It’s actually blasphemous. 

Assume, for a moment, that the story of the Three Wise Men—or Kings—is true. 

The whole point of the story is to establish that Jesus’ birth was a truly special event—and a recognition of his fate to redeem humanity from sin.

No one else in that story is depicted as giving—or getting—gifts.

No matter how much a child might be loved today, almost no one expects him to be a future savior.

So giving him gifts is essentially a parody of the acknowledgement of Jesus’ divinity. 

Reason #4: Christmas is overwhelmingly a commercial—not a religious—event.

  • The Christmas shopping season can start as early as September. Some consumers begin shopping even earlier.
  • For 2019, industry analysts expected the average American to spend $920 on holiday gifts, up from $885 in 2018 and reaching a total of more than $1 trillion.
  • Santa Clause made his first appearance in Coca-Cola magazine ads in the 1920s.
  • In 2019, the average cost of Christmas was $668, up from $633 in 2018.  
  • In 2019, 20% of consumers anticipated taking on debt due to Christmas shopping, with the average amount being $720.
  • For many stores, holiday shopping accounts for nearly a third of annual sales.

Reason #5: At least for 2020, celebrating Christmas within large families could prove fatal.

A December 19 story in Business Insider carries the attention-catching headline: “The Thanksgiving Surge in Coronavirus Deaths is Here. It’s ‘Horrifically Awful,’ a Hospital Chaplain Said.” To sum up its contents:

  • More than 47,000 Americans have died from COVID-19 since Thanksgiving.
  • COVID-19 is now the country’s leading cause of death.
  • It’s just the beginning of the effects of Thanksgiving travel and gatherings,

The Centers for Disease Control and Prevention begged Americans to forego traveling for Thanksgiving. But at least 55 million Americans ignored that warning. Their selfish, egotistical mantra—“I want to be with my family!”—overrode their supposed concern for the lives of their relatives.

As a result, untold numbers of those families will not again be sharing Thanksgiving—or anything else. 

And Dr. Anthony Fauci, the nation’s top expert on infectious diseases, has warned that the Christmas season will pose an even greater threat.

People will gather not just for Christmas Eve or Christmas Day, but for New Year’s Eve and New Year’s Day—not to mention any parties held in-between those dates.

The virus spreads faster indoors, where large numbers of people don’t wear masks, pack closely together, and talk or laugh loudly, thus spreading the droplets across a room.

There will be people who insist that Christmas is a religious event that they are commanded to celebrate—even in the midst of a deadly plague.

For those people, it’s a good time to remember the advice of 1 Corinthians 13:11: “When I was a child, I spoke as a child, I understood as a child, I thought as a child; but when I became a man, I put away childish things.”

DEFEATING CORPORATE PREDATORS WITH “WHO/WHOM?”

It’s easy to be intimidated by a large corporation—such as a bank or phone company—when you’ve been ripped off. After all, it’s well-known, has millions of dollars, and legions of attorneys.

But when that happens, it’s essential to remember two words: Who/Whom?

Translation: Who can do What to Whom

When you’re dealing with people whose greed is equaled only by their arrogance, there is only one way to prevail: You need to make them afraid of you.

And that can be achieved only by finding someone—or some agency—they fear, and turning them into your ally.

A friend of mine—Lynn—tried to order a calendar from an online calendar company. She put in the required information—including her debit card number—but kept getting “Error” messages.

Eventually she quit trying.

Lynn never got the calendar—but she wound up with four separate charges to her debit card, totaling $71.32.

She tried to get a refund from the company—which claimed they couldn’t find the charges.

Meanwhile, Lynn’s bank had in fact confirmed the charges—since the money had been taken from her account. And the bank—Bank of America—promised to remove the charges within 72 hours.

Three days came and went—and no reimbursement had been made to her account.

So Lynn called BofA again—and was told it would take about 45 days to run “an investigation” into her loss.

Luckily, an investigator-friend of hers advised her to file a complaint with the Federal Consumer Financial Protection Bureau (CFPB).  It can be reached at https://www.consumerfinance.gov/ 

According to its website, the agency operates as follows: 

  • “We create clear rules to implement the law and preserve choices for consumers.”
  • “We enforce federal consumer financial laws by investigating cases of potential wrongdoing and taking action.”
  • “We supervise financial companies to ensure compliance with federal consumer laws.”

So she called the agency—at (855) 411-2372 on a Friday—and waited to see what happened. 

Two days later—a Sunday—she called Bank of America to check her balance. To her surprise, she found that the bank had found a way to reverse the fraudulent charges that had been made to her debit card.

And it had done in far less than 45 days.

Clearly, someone at BofA had gotten the message: This is no woman—or agency—to take lightly.

Then there’s this case: From November, 2011 to February 2012, AT&T demanded that Dave (not his real name) pay for a service the company had failed to provide.

They had promised to supply him with Uverse high-speed Internet—at 25 MBPs a second. Instead, he had gotten only 6 MBPs—and a big dot in the middle of his computer screen while watching YouTube videos. 

Finally, an AT&T rep told him the blunt truth: His geographical area in San Francisco was not yet supplied with the fiber-optic cables that could provide high-speed Internet service. 

Dave canceled Uverse—and began getting a series of bills from AT&T.

After getting a phone call from a collection agency, Dave decided to ask me to intervene on his behalf.

I decided to go directly to the Office of the President of AT&T.

Why? Because the man at the top of an organization cannot fob you off with the excuse: “My hands are tied. I can’t do it.” He can do anything he wants.

I found the name of the president by a quick search on Google under: “AT&T Corporate Offices.”

And at the top of the heap stood Randall L. Stephenson––Chairman of the Board, CEO and President of AT&T Inc.

I didn’t expect to speak with Stephenson. One of his chief lieutenants would do nicely—such as a woman I’ll call Margie.

First, I introduced myself and said I was authorized to act on Dave’s behalf. Then I handed the phone to Dave (who was sitting next to me) so he could confirm this. 

After that, I briefly outlined the problems Dave had been having. 

Margie—using Dave’s phone number—quickly accessed the computerized records documenting all I had told her. She said she needed three or four days to fully investigate the matter before getting back to me.

Police long ago learned the “good cop/bad cop” routine usually works wonders. So I decided to apply a variation of this with Margie. 

I said that Dave wanted to resolve this quietly and amicably. But, if necessary, he was prepared to do so through the California Public Utilities Commission (PUC) and the Federal Communications Commission (FCC)—both of which had jurisdiction over AT&T. 

Margie hurriedly said there was no need to conduct an investigation after all. In fact, she added, she was writing a credit to Dave of $150.00 that very minute.

Why had Margie changed her mind?

Just as banks use every excuse to charge their customers for anything they can get away with, so do phone companies. AT&T wouldn’t want the PUC and FCC to start asking: “Is AT&T generally dunning customers for money they don’t owe?”

I had no doubt the answer would have proven to be: “Yes.”

And I believe that Margie felt the same way. 

TWO DEADLY MISTAKES IN ONE DAY

Donald Trump was in a hurry to leave Walter Reed National Military Medical Center—where he’d been taken on October 3 owing to COVID-19.

So on October 6—just three days after being hospitalized, and still highly infectious—he demanded that he be returned to the White House. 

Once ensconced in the Executive Mansion, Trump proceeded to make two deadly mistakes.

Mistake #1: He tweeted a one-minute long video from the White House balcony, saying he “learned so much about coronavirus,” and believed that he was possibly immune to the disease.

“One thing that’s for certain: Don’t let it dominate you,” he said of COVID-19. “Don’t be afraid of it. You’re going to beat it. We have the best medical equipment, we have the best medicines, all developed recently. And you’re going to beat it.

“We’re going back, we’re going back to work,” Trump said. “We’re going to be out front. As your leader, I had to do that. I knew there’s danger to it, but I had to do it..”

Trump’s upbeat message about COVID-19—“Don’t be afraid of it. You’re going to beat it”—alarmed and angered many infectious disease experts. 

“It’s an unconscionable message,” said Dr. Sadiya Khan of Northwestern University Feinberg School of Medicine. “I would go so far as to say that it may precipitate or worsen spread.”

“We have to be realistic in this: COVID is a complete threat to the American population,” said Dr. David Nace, an expert on infectious diseases at the University of Pittsburgh Medical Center.

“Most of the people aren’t so lucky as the president,” with an in-house medical unit and access to experimental treatments, he added.

Especially outraged by Trump’s comment was Amanda Kloots, who lost her husband, Broadway actor Nick Cordero, to the virus.

“Unfortunately not everyone is lucky enough to spend two days in the hospital,” she tweeted, referring to Trump’s short stay for COVID-19 treatment. “I cried next to my husband for 95 days watching what COVID did to the person I love. It IS something to be afraid of.”

Mistake #2: Always wanting to appear in command, Trump ordered his negotiators to halt talks over a new economic stimulus package, after House and Senate Republicans had struggled for months to reach a deal.

“I have instructed my representatives to stop negotiating until after the election when, immediately after I win, we will pass a major Stimulus Bill that focuses on hardworking Americans and Small Business,” Trump wrote in a series of tweets.

Trump’s message stunned lawmakers. The decision is a major blow to Americans still struggling with the fallout from the pandemic and endangers an economic recovery that for months was driven by a $2.2 trillion stimulus passed by Congress in the spring. That money has been largely spent. 

Among those stunned by Trump’s move: Federal Reserve Chairman Jerome Powell.

At the annual meeting of the National Association for Business Economics, Powell warned: “Too little support would lead to a weak recovery, creating unnecessary hardship for households and businesses.”

Powell said that government support—expanded unemployment insurance payments, direct payments to most households and support for small businesses—has prevented a recessionary “downward spiral” where job losses would reduce spending, forcing businesses to cut even more jobs.

A far smarter move by Trump would have been claiming that Republicans were vigorously pursuing a stimulus package—but were facing roadblocks thrown up by spendthrift Democrats. 

That would have allowed Trump to play the part of the self-pitying underdog. And it would have put the blame squarely—if inaccurately—on the Democrats.

But Trump’s ego demands that he be the one seen to take decisive action. On December 11, 2018, it neatly tripped him up.

Nancy Pelosi—then House Minority Leader—and Senate Minority Leader Charles Schumer, met with Trump in the Oval Office. And, true to his love of publicity, Trump made sure the meeting was televised live on TV.

Trump quickly demanded $5.6 billion to create a wall along the U.S.-Mexican border.

When Pelosi and Schumer refused to budge, Trump said: And one way or the other, it’s going to get built. I’d like not to see a government closing, a shutdown. We will see what happens over the next short period of time.”

SCHUMER: “Twenty times you have called for, ‘I will shut down the government if I don’t get my wall.’ None of us have said—you’ve said it.”

TRUMP: “Okay, you want to put that on my—I’ll take it.  You know what I’ll say: ‘Yes, if we don’t get what we want, one way or the other…I will shut down the government. Absolutely.’”

Trump did shut down the government. And because he had threatened to do so—on nationwide TV—he, not the Democrats, was blamed for it. Thirty-five days later, he caved to public pressure and reopened the government.

With the 2020 Presidential election less than a month away and himself behind former Vice President Joe Biden in the polls, it appears that Trump’s ego has once again neatly tripped himself up.

THE NEWS MEDIA: EMBARRASSING THE FIRST AMENDMENT

On September 27, The New York Times broke the unprecedented story of President Donald Trump’s tax returns, which he has long held secret. 

Among the revelations: He paid no federal income taxes at all for 10 of 15 years. And he paid only $750 in taxes in 2016 and 2017.

For most newspapers and TV networks, such investigative reporting is a rarity. Most media outlets are little more than “happy news” or propaganda organs.

On April 28, 2018, comedian Michelle Wolf hosted the annual White House Correspondents Dinner in Washington, D.C. There she skewered high-ranking Trump administration officials and members of the nation’s elite media.

Most of here jokes were focused on Trump administration officials—especially then-Press Secretary Sarah Huckabee Sanders.

But Wolf threw a series of sharp-edged zingers at some of the Nation’s most prominent media. And these comments have gone largely ignored.

They are, however, well worth examining—for the uncomfortable truths they reveal about much of the “news” being served up under the guise of fearless objectivity.

On CNN—where “news” now consists of a series of “talking heads” pontificating about stories that other journalists have dug up:  We’ve got our friends at CNN here. You guys love breaking news, and you did it. You broke it. Good work. The most useful information on CNN is when Anthony Bourdain tells me where to eat noodles.

On Fox News’ sexual harassment scandals involving such prominent (and former) members as CEO Roger Ailes and commentator Bill O’Reilly:  Fox News is here. So, you know what that means, ladies: Cover your drinks. Seriously.

On Fox News’ actual role as the propaganda organ of the Republican party:  People want me to make fun of [Fox News commentator] Sean Hannity tonight, but I cannot do that; this dinner is for journalists.

On weak-rated MSNBC, which is the liberal version of Fox News:  We’ve got MSNBC here. MSNBC’s news slogan is, “This is who we are.” Guys, it’s not a good slogan. “This is who we are” is what your mom thinks the sad show on NBC is called. “Did you watch ‘This Is Who We Are’ this week? Someone left on a Crockpot, and everyone died.”

On Megyn Kelly, who rose to fame and fortune as a Right-wing propaganda shill on Fox News:  And, of course, Megyn Kelly. What would I do without Megyn Kelly? You know, probably be more proud of women. 

And, by the way, Megyn, Santa’s black. The weird old guy going through your chimney was Bill O’Reilly. You might want to put a flue on it or something.  

[This last jibe centered on Kelly’s infamous December 11, 2013 Fox broadcast where she claimed: “I kind of laughed and said this is so ridiculous.  Yet another person claiming it’s racist to have a white Santa. For all you kids watching at home, Santa just is white….Just because it makes you uncomfortable doesn’t mean it has to change. Jesus was a white man too.”]

On the continuing demise of newspapers—on which TV “news reporters” depend for their information:  There’s a lot of print media here. There’s a ton of you guys, but I’m not going to go after print media tonight because it’s illegal to attack an endangered species. Buy newspapers.

On the media’s—especially the television media’s—morbid obsession with Donald Trump:  There’s a ton of news right now; a lot is going on, and we have all these 24-hour news networks, and we could be covering everything. But, instead, we’re covering like three topics. Every hour, it’s Trump, Russia, Hillary and a panel of four people who remind you why you don’t go home for Thanksgiving.

On the media’s responsibility for the rise of a President they now detest: You guys are obsessed with Trump. Did you used to date him? Because you pretend like you hate him, but I think you love him. I think what no one in this room wants to admit is that Trump has helped all of you. He couldn’t sell steaks or vodka or water or college or ties or Eric, but he has helped you.

He’s helped you sell your papers and your books and your TV. You helped create this monster, and now you’re profiting off of him. And if you’re gonna profit off of Trump, you should at least give him some money because he doesn’t have any.

[This last joke was probably the most painful the assembled media bigwigs had to endure. Because it’s undeniably true.

Trump’s campaign was saved from spending millions on TV advertising because the major TV news networks covered his every word. This was especially true when he was attacking women, blacks, Mexicans, Hillary Clinton, Barack Obama—and even beauty pageant contestants.

For the media, Trump was “good for ratings”—in the same way that Mike Tyson was “good for boxing.” Both were seen as freaks—and thus guaranteed to lure viewers eager to find out: “What outrageous thing has he done now?”] 

SAN FRANCISCO–“MY CITY BY THE BUM”: PART TWO (END)

In San Francisco, successive mayors and members of the Board of Supervisors virtually roll out the welcome mat for succeeding waves of

  • Drug addicts
  • Drunks
  • Mentally ill and
  • Bums.

Who can otherwise be classified as DDMBs.

Huge areas of the city are covered in feces, urine, trash and used hypodermic needles. Hospitals overflow with patients that have fallen ill due to the contamination.

In her own special way to the people she calls,
“Come, hand out booze to my bums.”

In February, 2018, NBC News surveyed 153 blocks of the city—an area more than 20 miles. That area includes popular tourist spots like Union Square and the cable car turnaround. It’s bordered by Van Ness Avenue, Market Street, Post Street and Grant Avenue. And it’s also home to City Hall, schools, playgrounds and a police station.

Reporters found trash littered across every block. Forty-one blocks were covered with needles and 96 blocks were  contaminated with piles of human feces.

Most of the trash found consisted of heaps of garbage, food, and discarded junk—including 100 drug needles and more than 300 piles of feces throughout downtown. If you step on one of these needles, you can get HIV, Hepatitis C, Hepatitis B or a variety of other viral diseases.

But you don’t have to actually get stuck by a needle to become a victim. Once fecal matter dries, it can become airborne and release deadly viruses, such as the rotavirus.

“If you happen to inhale that, it can also go into your intestine,” says Dr. Lee Riley, an infectious disease specialist at the University of California, Berkeley. The results can prove fatal, especially in children.

And cleaning up the messes of DDMBs is no easy task. In a 2018 news story on NBC’s San Francisco affiliate, KNTV, Mohammed Nuru, the Director of the Public Works Department, said: “Yes, we can clean, and then go back a few hours later, and it looks as if it was never cleaned. So is that how you want to spend your money?”

A single pile of human waste takes at least 30 minutes for one of his staffers to clean up. “The steamer has to come. He has to park the steamer. He’s got to come out with his steamer, disinfect, steam clean, roll up and go.”

All around you see needles that are left by the addicts
And poop that slops on your shoes.
Whenever you see them
You know bums are smiling
Each time someone shows up with booze.

 

Another danger posed by DDMBs: Hundreds—if not thousands—of them are heroin addicts. Such people will commit virtually any crime to support their habit. And their crimes of choice are burglary and robbery.

Thus, pouring large numbers of them into San Francisco neighborhoods via “Navigation Centers”—essentially holding pens for DDMBs—guarantees that countless decent citizens will become targets for desperate criminals.

Navigation Centers boast that they ban drug-abuse or drug-dealing on their own premises. But they allow DDMBs to come and go at will. Which means they are free to engage in drug-abuse and/or drug-dealing in the neighborhoods where these centers exist.

In 2016, San Francisco spent $275 million on homelessness—up from $241 million in 2015. Four years later, City Hall prepared to spend $300 million to find housing for DDMBs.

Listen, listen, she’s calling to you
“Feed the bums, six-packs a bag
Six-packs, six-packs, six-packs a bag.”

 

San Francisco’s political elite see this blight as well as everyone else. They can’t avoid seeing it, since the city covers 47 square miles.

The latest fad remedy: “Navigation Centers.” These will supposedly warehouse DDMBs temporarily until they can be “navigated” to permanent housing.

But housing is in short supply in San Francisco, and there is no telling how long how many of these drug addicts, alcoholics, mentally disabled and bums will stay in them. Or what harm they will wreak on the neighborhoods warehousing them.

San Francisco should stop catering to its population of DDMBs who prey on the guilt or fear of law-abiding, tax-paying citizens. 

The same laws that protect citizens against patients with highly communicable diseases like typhoid and cholera should be vigorously applied to those whose filthy habits threaten similar public contagion.

Among such reforms:

  • Launch a “Please Do Not Feed the Bums” publicity campaign—as San Francisco has against feeding pigeons. And those caught doing so should be heavily fined. 
  • Trash cans should be equipped with locked doors, to prevent DDMBs from using them as food dispensers.
  • Those living on the street should be given a choice: Go to a local shelter or face arrest and the immediate confiscation of their possessions.
  • San Francisco’s rent control laws should be strengthened, to prevent future evictions owing to the unchecked greed of landlords. Tenants on fixed incomes should be given special protections against extortionate rent increases.
  • Bus drivers should have the right to refuse passengers who stink of urine/feces, as they present a potential health-hazard to others.
  • Owners of restaurants, theaters and grocery stores should likewise be allowed to refuse service on the same basis.
  • Require proof of residency for those applying for welfare benefits. Too many people come to San Francisco because, upon arrival, they can immediately apply for such benefits.
  • The city should set up a special unit to remove “street people” and their possessions from city sidewalks. This could be a division of the Sanitation Department, since its personnel are used to removing filth and debris of all types.  

Only then will San Francisco rightly reclaim its former glory as “the city by the Bay.”
