IS THERE A HITLER IN YOUR CEO?

Each Labor Day, American politicians offer lip-service tribute to those millions of American workers who make corportate profits a reality.

But no one ever says anything about those over-pampered, over-paid CEOs who all too often take credit for the work done by those millions of American workers.

Too many CEOs have–consciously or not–patterened themselves after the ultimate CEO: Adolf Hitler.

Ever since he shot himself in his underground Berlin bunker on April 30, 1945, historians have fiercely debated:  Was der Fuehrer a military genius or an imbecile?

With literally thousands of titles to choose, the average reader may feel overwhelmed.  But if you’re looking for an understandable, overall view of Hitler’s generalship, an excellent choice would be How Hitler Could Have Won World War II by Bevin Alexander.

Among “the fatal errors that led to Nazi defeat” (as proclaimed on the book jacket) were:

  • Wasting hundreds of Luftwaffe pilots, fighters and bombers in a half-hearted attempt to conquer England.
  • Ignoring the pleas of generals like Erwin Rommel to conquer Syria, Iraq and Saudi Arabia–thus giving Germany control of most of the world’s oil.
  • Attacking his ally, the Soviet Union, while still at war with Great Britain.
  • Needlessly turning millions of Russians into enemies rather than allies by his brutal and murderous policies.
  • Declaring war on the United States after the Japanese attacked Pearl Harbor.  (Had he not done so, Americans would have focused all their attention on conquering Japan.)
  • Refusing to negotiate a separate peace with Soviet dictator Joseph Stalin–thus granting Germany a large portion of captured Russian territory in exchange for letting Stalin remain in power.
  • Insisting on a ”not one step back” military “strategy” that led to the unnecessary surrounding, capture and/or deaths of hundreds of thousands of German servicemen.

As the war turned increasingly against him, Hitler became ever more rigid in his thinking.  He demanded absolute control over the smallest details of his forces.  This, in turn, led to astounding and needless losses in German soldiers.

One such incident was immortalized in the 1962 movie, The Longest Day, about the Allied invasion of France known as D-Day.

On June 6, 1944, Rommel ordered the panzer tanks to drive the Allies from the Normandy beaches.  But these could not be released except on direct order of the Fuehrer.

As Hitler’s chief of staff, General Alfred Jodl, informed Rommel: The Fuehrer was asleep–and, no, he, Jodl, would not wake him.

By the time Hitler awoke and issued the order, it was too late.

Nor could he accept responsibility for the policies that were clearly leading Germany to certain defeat.  Hitler blamed his generals, accused them of cowardice, and relieved many of the best ones from command.

Among those sacked was Heinz Guderian, creator of the German panzer corps–and thus responsible for its highly effective “blitzkrieg” campaign against France in 1940.

Another was Erich von Manstein, designer of the strategy that defeated France in six weeks–something Germany couldn’t do during the four years of World War 1.

Finally, on April 29, 1945–with the Russians only blocks from his underground bunker in Berlin–Hitler dictated his “Last Political Testament.”  Once again, he refused to accept responsibility for unleashing a war that would ultimately consume 50 million lives:

“It is untrue that I or anyone else in Germany wanted war in 1939.  It was desired and instigated exclusively by those international statesmen who either were of Jewish origin or worked for Jewish interests.”

Hitler had launched the war with a lie–that Poland had attacked Germany, rather than vice versa.  And he closed the war–and his life–with a final lie.

All of which, once again, brings us back to Niccolo Machiavelli, the father of political science.

In his classic book, The Discourses, he wrote at length on the best ways to maintain liberty within a republic.  In Book Three, Chapter 31, Machiavelli declares: “Great Men and Powerful Republics Preserve an Equal Dignity and Courage in Prosperity and Adversity.”

It is a chapter that Adolf Hitler would have done well to read.

“…A truly great man is ever the same under all circumstances.  And if his fortune varies, exalting him at one moment and oppressing him at another, he himself never varies, but always preserves a firm courage, which is so closely interwoven with his character that everyone can readily see that the fickleness of fortune has no power over him.

“The conduct of weak men is very different.  Made vain and intoxicated by good fortune, they attribute their success to merits which they do not possess, and this makes them odious and insupportable to all around them. 

“And when they have afterwards to meet a reverse of fortune, they quickly fall into the other extreme, and become abject and vile.  

“Thence it comes that princes of this character think more of flying in adversity than of defending themselves, like men who, having made a bad use of prosperity, are wholly unprepared for any defense against reverses.”

Stay alert to signs of such character flaws among your own business colleagues–and especially your superiors.  They are the warning signs of a future catastrophe.

LET ALLAH SORT IT OUT

Even confirmed imbeciles can sometimes get it right.

Or, in the case of former Alaska Governor Sarah Palin, partially right.

Speaking at the annual meeting of the Faith and Freedom Coalition on June 15, Palin said the United States should not intervene in Syria while Barack Obama holds the Presidency:

“Until we have a commander in chief who knows what he is doing… let Allah sort it out!”

Actually, she got it half-right: “Let Allah sort it out”–regardless of who is President.

Recently, noted draft-dodger and former President Bill Clinton had different advice for President Obama.

Clinton urged Obama to intervene in Syria:

“Suppose I had let a million people, two million people be refugees out of Kosovo, a couple hundred thousand people die, and they say, ‘You could have stopped this by dropping a few bombs. Why didn’t you do it?’ And I say, ‘Because the House of Representatives voted 75% against it'”?

“You look like a total wuss, and you would be.”

This is truly heady stuff, coming from a man who has proudly boasted how he outwitted his draft board and thus escaped military service in Vietnam.

Apparently, it’s OK for other Americans to put on a military uniform and risk their lives in pointless missions on behalf of foreigners who hate us.

It’s just not OK for bullet-shy chicken-hawks like Bill Clinton to do it.

Clinton doesn’t seem aware, or concerned, that, in Syria, two of America’s most deadly enemies are now waging war–with each other.

Yes, it’s Hezbollah (Party of God) vs. Al-Qaeda (The Base).

Hezbollah is comprised of Shiite Muslims, who form a minority of Islamics.  A sworn enemy of Israel, it has  kidnapped scores of Americans suicidal enough to visit Lebanon and truck-bombed the Marine Barracks in Beirut in 1983, killing 299 Americans.

Al-Qaeda, on the other hand, is made up of Sunni Muslims, who form the majority of that religion.  It is intolerent of non-Sunni Muslims and has instigated violence against them.  It denounces them as “takfirs”–heretics–and thus worthy of extermination.

Al Qaeda has attacked the mosques and gatherings of liberal Muslims, Shias, Sufis and other non-Sunnis.   Examples of sectarian attacks include the Sadr City bombings, the 2004 Ashoura massacre and the April, 2007 Baghdad bombings.

In a June 1 column entitled, “Stop the Madness,” Dr. James J. Zogby, the founder and president of the Arab American Institute, warns:

“What began as a popular revolt against a brutal and ossified dictatorship, Syria has now degenerated into a bloody battlefield pitting sects and their regional allies against each other in a ‘dance unto death.’

“On the one side, is the Ba’ath regime, supported by Russia, Iran, Hizbullah, and elements in the Iraqi government.

“Arrayed against them are a host of Syrians (some of whom have defected from the armed forces and others who have formed militias receiving arms and support from a number of Arab states and Turkey) and a cast of thousands of foreign Sunni fighters (some of whom have affiliated with al Qaeda) who have entered Syria to wage war on behalf of their brethren.”  [Emphasis added.]

But Clinton isn’t the only one urging Obama to waste American lives in a cause that only Islamic terror groups and right-wing Americans find compelling.

Arizona U.S. Senator John McCain has repeatedly urged the Obama administration to militarily intervene in Syria.

He has demanded that the United States create a “no-fly” zone over Syria to deny Syrian dictator Bashar al Assad the use of his air force against his rebellious subjects.

McCain, unlike Clinton, did serve in Vietnam–as a U.S. Navy pilot.  In October 1967, while on a bombing mission over Hanoi, he was shot down, seriously injured, and captured by the North Vietnamese.  He remained a prisoner of war until his release in 1973.

Now McCain wants today’s young servicemen to have the same opportunities he did–to be blown out of the sky and taken prisoner for another worthless cause.

Just as Sarah Palin was partially correct in urging “let Allah sort it out,” so, too, was Clinton partially correct in his “total wuss” remarks.

President Obama can rightly be called a “total wuss”–but not for keeping Americans out of harm’s way in a war they have no stake in.

He can legitimately be called a “total wuss”–for surrendering to the demands of the same neocons who lied America into a needless 10-year war in Iraq. 

But it’s not too late for Obama to recover from his mistake.

He can establish an all-volunteer brigade for those Americans willing to fight and possibly die in yet another pointless war.  And he can offer to fly them to the border of Syria so they can carry out their self-appointed “conquer or die” mission.

If these armchair strategists refuse to put their own lives on the line in defense of a “cause” they claim to believe in, Obama should have the courage to brutally–and repeatedly–point this out.

CORPORATIONS ARE GREEDY PEOPLE, TOO

It was August 11, 2011–one year before he would receive the official Republican nomination for President.

Hustling for votes, Mitt Romney was speaking to a crowd of hundreds at the Iowa State Fair. He was being pressed about raising taxes to help cover entitlement spending.

Suddenly, a heckler suggested raising corporate tax rates.

Romney responded: “Corporations are people, my friend. Of course they are. Everything corporations earn ultimately goes to the people. Where do you think it goes? Whose pockets? Whose pockets? People’s pockets. Human beings, my friend.”

The line earned him a sustained round of applause from the crowd.

If it’s true that corporations are people, then they are exceptionally greedy and selfish people.

A December, 2011 report by Public Campaign, highlighting corporate abuses of the tax laws, makes this all too clear.

Public Campaign is a national nonpartisan organization dedicated to reforming campaign finance laws and holding elected officials accountable.

Summarizing its conclusions, the report’s author writes:

“Amidst a growing federal deficit and widespread economic insecurity for most Americans, some of the largest corporations in the country have avoided paying their fair share in taxes while spending millions to lobby Congress and influence elections.”

Its key findings:

  • The thirty big corporations analyzed in this report paid more to lobby Congress than they paid in federal income taxes between 2008 and 2010, despite being profitable.
  • Despite making combined profits totaling $164 billion in that three-year period, the 30 companies combined received tax rebates totaling nearly $11 billion.
  • Altogether, these companies spent nearly half a billion dollars ($476 million) over three years to lobby Congress. That’s about $400,000 each day, including weekends.
  • In the three-year period beginning in 2009 through most of 2011, these large firms spent over $22 million altogether on federal campaigns.
  • These corporations have also spent lavishly on compensatng their top executives ($706 million altogether in 2010).

Among those corporations whose tax-dodging and influence-buying were analyzed:

  • General Electric
  • Verizon
  • PG&E
  • Wells Fargo
  • Duke Energy
  • Boeing
  • Consolidated Edison
  • DuPont
  • Honeywell International
  • Mattel
  • Corning
  • FedEx
  • Tenet Healthcare
  • Wisconsin Energy
  • Con-way

The report bluntly cites the growing disparity between the relatively few rich and the vast majority of poor and middle-class citizens:

“Over the past few months, a growing protest movement has shifted the debate about economic inequality in this country.

“The American people wonder why members of Congress suggest cuts to Medicare and Social Security but won’t require millionaires to pay their fair share in taxes.

“They want to know why they are struggling to find jobs and put food on the the table while the country’s largest corporations get tax breaks and sweetheart deals, then use that extra cash to pay bloated bonuses to CEOs or ship jobs overseas.

“….At a time when millions of Americans are still unemployed and millions more make tough choices to get by, these companies are enriching their top executives and spending millions of dollars on Washington lobbyists to stave off higher taxes or regulations.”

Assessing the results of corporate tax-dodging, the report states:

  • Using various tax dodging techniques, including stashing profits in overseas tax havens and tax loopholes, 29 out of 30 companies featured in this study succeeded in paying no federal income taxes from 2008 through 2010.
  • These 29 companies received tax rebates over those three years, ranging from $4 million for Corning to nearly $5 billion for General Electric and totally nearly $11 billion altogether.
  • The only corporation that paid taxes in that three-year period, FedEx, paid a three-year tax rate of 1%, far less than the statutory rate of 35%.

The report bluntly notes the hypocrisy of corporate executives who call themselves “job creators” while enriching themselves by laying off thousands of employees:

“Another area where these corporations have decided to spend lavishly is compensation for their top executives ($706 million altogether in 2010).

“Executives doing particularly well work for General Electric ($76 million in total compensation in 2010), Honeywell International ($54 million), and Wells Fargo ($50 million).

“Executives who have seen the greatest increase work for DuPont (188% increase), Wells Fargo (180% increase) and Verizon (167% increase).

Despite being profitable, some of these corporations have actually laid off workers.

Since 2008, seven of the corporations have reported laying off American workers. The worst offenders are Verizon, which laid off  at least 21,308 workers, and Boeing, which fired at least 14,862 employees.

Insisting that “corporations are people” wins applause from the wealthiest 1% and their Right-wing shills. But it does nothing to better the lives of the increasingly squeezed poor and middle-class.

If the nation is to avoid economic and moral bankruptcy, Americans must demand that powerful corporations be held accountable–and punished harshly when they behave irresponsibly.

THE CASEY DOCTRINE

When William J. Casey was a young attorney during the Great Depression, he learned an important lesson.

Jobs were hard to come by, so Casey thought himself lucky to land one at the Tax Research Institute of America in New York.

His task was to closely read New Deal legislation and write reports explaining it to corporate chieftains.

At first, he thought they wanted detailed legal commentary on the meaning of the new legislation.

But then he quickly learned a blunt truth: Businessmen neither understood nor welcomed Franklin D. Roosevelt’s efforts to reform American capitalism.  And they didn’t want legal commentary.

Instead, they wanted to know: “What must we do to achieve minimum compliance with the law?”

In short: How do we get by FDR’s new programs?

Fifty years later, Casey would bring a similar mindset to his duties as director of the Central Intelligence Agency for President Ronald Reagan.

He was presiding over the CIA when it deliberately violated Congress’ ban on funding the “Contras,” the Right-wing death squads of Nicaragua.

Casey gave lip service to the demands of Congress.  But privately, with the help of Marine Lieutenant  Colonel Oliver North, he set up an “off-the-shelf” operation to provide arms to overthrow the leftist government of Daniel Ortega.

It was what President Ronald Reagan wanted.  So Casey felt he had a duty to get it done.

But the “Casey Doctrine” of minimum compliance didn’t die with Casey (who expired of a brain tumor in 1987).

It’s very much alive among the American business community as President Barack Obama seeks to give medical coverage to all Americans, and not simply the ultra-wealthy.

The single most important provision of the Affordable Care Act (ACA)–better known as Obamacare–requires large businesses to provide insurance to full-time employees who work more than 30 hours a week.

For part-time employees, who work fewer than 30 hours, a company isn’t penalized for failing to provide health insurance coverage.

Obama prides himself on being a tough-minded practitioner of “Chicago politics.”  So it’s easy to assume that he took the “Casey Doctrine” into account when he shepherded the ACA through Congress.

But he didn’t.

The result was predictable.  And its consequences are daily becoming more clear.

Employers feel motivated to move fulltime workers into part-time positions–and thus avoid

  • providing their employees with medical insurance and 
  • a fine for non-compliance with the law.

Some employers have openly shown their contempt for President Obama–and the idea that employers actually have an obligation to those who make their profits a reality.

The White Castle hamburger chain is considering hiring only part-time workers in the future to escape its obligations under Obamacare.

No less than Jamie Richardson, its vice president, has admitted this in an interview.

“If we were to keep our health insurance program exactly like it is with no changes, every forecast we’ve looked at has indicated our costs will go up 24%.”

Richardson claimed the profit per employee in restaurants is only $750 per year.  So, as he sees it, giving health insurance to all employees over 30 hours isn’t feasible.

Nor is Richardson the only corporate executive determined to shirk his responsibility to his employees.

John Schnatter, CEO of Papa John’s Pizza, has been quoted as saying:

  • The prices of his pizzas will go up–by eleven to fourteen cents price increase per pizza, or fifteen to twenty cents per order; and
  • He will pass along these costs to his customers.

“If Obamacare is in fact not repealed,” Schnatter told Politico, “we will find tactics to shallow out any Obamacare costs and core strategies to pass that cost onto consumers in order to protect our shareholders’ best interests.”

After all, why should a multi-million-dollar company show any concern for those who make its profits a reality?

Consider:

  • Papa John’s is the third-largest pizza takeout and delivery chain in the United States.
  • Its 2012 revenues were $318.6 million, an 8.5 percent increase from 2011 revenues of $293.5 million.
  • Its 2012 net income was $14.8 million, compared to its 2012 net income of $12.1 million.

In May, 2012, Schnatter hosted a fundraising event for Republican Presidential candidate Mitt Romney at his own Louisville, Kentucky mansion.

“What a home this is,” gushed Romney.  “What grounds these are, the pool, the golf course.

“You know, if a Democrat were here he’d look around and say no one should live like this. Republicans come here and say everyone should live like this.”

Of course, Romney conveniently ignored a brutally ugly fact:

For the vast majority of Papa John’s minimum-wage-earning employees-–many of them working only part-time-–the odds of their owning a comparable estate are non-existent.

Had Obama been the serious student of Realpolitick that he claims to be, he would have predicted that most businesses would seek to avoid compliance with his law.

To counter that, he need only have required all employers to provide insurance coverage for all of their employees—regardless of their fulltime or part-time status.

This, in turn, would have provided two substantial benefits:

  • All employees would have been able to obtain medical coverage; and
  • Employers would have been encouraged to provide fulltime positions rather than part-time ones, since they would feel: “Since I’m paying for fulltime insurance coverage, I should be getting fulltime work in return.”

The “Casey Doctrine” needs to be kept constantly in mind when reformers try to protect Americans from predatory employers.

NEED PROTECTION? DON’T CALL THE POLICE

Lori Tankel has a problem: A lot of angry people think she’s George Zimmerman.

She’s been getting death threats to her cellphone ever since a jury acquitted him of the second-degree murder of 17-year-old Trayvon Martin.

Unfortunately for her, her number is one digit away from the number Zimmerman used to make his call to police just before he fatally shot Martin.

The phone number had been shown throughout the trial. And, believing the number was Zimmerman’s, someone posted her number online.

On Saturday, July 13, Zimmerman, a self-appointed “neighborhood watchman,” was acquitted of the second-degree murder of Martin.

Just minutes aver the verdict, Tankel began getting death threats: “We’re going to kill you.  We’re going to get you.  Watch your back,” threatened a typical call.

And the threatening calls have been nonstop ever since. Tankel works as a sales representative for several horse companies.

She’s used to relying on her phone to keep her business going. But, almost as soon as the Zimmerman verdict came in, “My phone just started to blow up. Phone call after phone call, multiple phone calls,” Tankel said.

So she did what any ordinary citizen, faced with multiple death threats, would do: She called the police.

According to her, the Seminole County Sheriff’s Office told her the department itself receives around 400 death threats a minute on social media sites.

In short: Unless you’re wealthy, a politician or–best of all–a cop, don’t expect the police to protect you if your life is threatened.

If you doubt it, consider the lessons to be learned when, in February, Christopher Dorner declared war on his former fellow officers of the Los Angeles Police Department.

First, above everyone else, police look out for each other.

Robert Daley bluntly revealed this truth in his 1971 bestseller, Target Blue: An Insider’s View of the N.Y.P.D.  A  police reporter for the New York Times, he served for one year as a deputy police commissioner. “A great many solvable crimes in the city were never solved, because not enough men were assigned to the case, or because those assigned were lazy or hardly cared or got sidetracked.

“But when a cop got killed, no other cop got sidetracked.  Detectives worked on the case night and day…. “

In effect, the citizen who murdered his wife’s lover was sought by a team of detectives, two men.  But he who killed a cop was sought by 32,000.”

Second, don’t expect the police to do for you what they’ll do for one another.

The LAPD assigned security and surveillance details to at least 50 threatened officers and their families.

A typical detail consists of two to five or more guards.  And those guards must be changed every eight to 12 hours. And those details stayed in place long after Dorner was killed in a firefight on February 12.

But if your bullying neighbor threatens to kill you, don’t expect the police to send a guard detail over.  They’ll claim: ”We can’t do anything until the guy does something.  If he does, give us a call.”

Third, the more status and wealth you command, the more likely the police are to address your complaint or solve your case. I

f you’re rich, your complaint will likely get top priority and the best service the agency can provide.

But if you’re poor or even middle-class without high-level political or police connections, you’ll be told: “We just don’t have the resources to protect everybody.”

Fourth, don’t expect your police department to operate with the vigor or efficiency of TV police agencies.

“I want this rock [Hawaii] sealed off,” Steve McGarrett (Jack Lord) routinely ordered when pursuing criminals on “Hawaii Five-O.”

Real-life police departments, on the other hand:

  • Lack state-of-the-art crime labs to analyze evidence.
  • Often lose or accidentally destroy important files.
  • Are staffed by lazy, lazy, indifferent or incompetent officers.
  • Are notoriously competitive, generally refusing to share information with other officers or other police departments-–thus making it easier for criminals to run amok.

Even when police ”solve” a crime, that simply means making an arrest.  The District Attorney may decide not to file charges.

Or the perpetrator may cop to a lesser offense and serve only a token sentence-–or none at all.  Or he might be found not guilty by a judge or jury.

Fifth, the result of all this can only be increased disrespect for law enforcement from a deservedly–and increasingly–cynical public.

It is the witnessing of blatant inequities and hypocrisies such as those displayed in the Christopher Dorner case that most damages public support for police at all levels.

When citizens believe police care only about themselves, and lack the ability-–or even the will-–to protect citizens or avenge their victimization by arresting the perpetrators, that is a deadly blow to law enforcement.

Police depend on citizens for more than crime tips.  They depend upon them to support hiring more cops and  buying state-of-the-art police equipment. 

When public support vanishes, so does much of that public funding. The result can only be a return to the days of the lawless West, where citizens looked only to themselves for protection.

TRAYVON’S REAL KILLER: THE NRA (PART THREE – END)

The victims of the violence are black and white, rich and poor, young and old, famous and unknown. They are, most important of all, human beings whom other human beings loved and needed. No one – no matter where he lives or what he does – can be certain who will suffer from some senseless act of bloodshed. And yet it goes on and on.

What should the surviving victims of gun violence do to seek redress?

And how can the relatives and friends of those who didn’t survive seek justice for those they loved?

Two things:

First, don’t count on politicians to support a ban on assault weapons.

Politicians–with rare exceptions–have only two goals:

  1. Get elected to office, and
  2. Stay in office.

And too many of them fear the economic and voting clout of the NRA to risk its wrath.

Consider Mitt Romney and President Barack Obama.

Both rushed to offer condolences to the surviving victims of the Aurora massacre.  And both have steadfastly refused to even discuss gun control–let alone support a ban on the type of assault weapons used by James Holmes.

On July 22, 2012–only two days after the Century 16 Theater slaughter in Aurora, Colorado–U.S. Senator Ron Johnson (R-Wis.) said: “The fact of the matter is there are 30-round magazines that are just common all over the place.

“You simply can’t keep these weapons out of the hands of sick, demented individuals who want to do harm.  And when you try and do it, you restrict our freedom.”

That presumably includes the freedom of would-be mass murderers to carry out their fantasies.

Second, those who survived the massacre–and the relatives and friends of those who didn’t–should file wrongful death, class-action lawsuits against the NRA.

There is sound, legal precedent for this.

  • For decades, the American tobacco industry peddled death and disability to millions and reaped billions of dollars in profits.
  • The industry vigorously claimed there was no evidence that smoking caused cancer, heart disease, emphysema or any other ailment.

  • Tobacco companies spent billions on slick advertising campaigns to win new smokers and attack medical warnings about the dangers of smoking.
  • Tobacco companies spent millions to elect compliant politicians and block anti-smoking legislation.
  • From 1954 to 1994, over 800 private lawsuits were filed against tobacco companies in state courts. But only two plaintiffs prevailed, and both of those decisions were reversed on appeal.
  • In 1994, amidst great pessimism, Mississippi Attorney General Mike Moore filed a lawsuit against the tobacco industry.  But other states soon followed, ultimately growing to 46.
  • Their goal: To seek monetary, equitable and injunctive relief under various consumer-protection and anti-trust laws.
  • The theory underlying these lawsuits was: Cigarettes produced by the tobacco industry created health problems among the population, which badly strained the states’ public healthcare systems.
  • In 1998, the states settled their Medicaid lawsuits against the tobacco industry for recovery of their tobacco-related, health-care costs.  In return, they exempted the companies from private lawsuits for tobacco-related injuries.
  • The companies agreed to curtail or cease certain marketing practices.  They also agreed to pay, forever, annual payments to the states to compensate some of the medical costs for patients with smoking-related illnesses.

The parallels with the NRA are obvious:

  • For decades, the NRA has peddled deadly weapons to millions, reaped billions of dollars in profits and refused to admit the carnage those weapons have produced: “Guns don’t kill people.  People kill people.”  With guns.

  • The NRA has bitterly fought background checks on gun-buyers, in effect granting even criminals and the mentally ill the right to own arsenals of death-dealing weaponry.
  • The NRA has spent millions on slick advertising campaigns to win new members and frighten them into buying guns.

  • The NRA has spent millions on political contributions to block gun-control legislation.
  • The NRA has spent millions attacking political candidates and elected officials who warned about the dangers of unrestricted access to assault and/or concealed weapons.

  • The NRA has spent millions pushing “Stand Your Ground” laws in more than half the states, which potentially give every citizen a “license to kill.”
  • The NRA receives millions of dollars from online sales of ammunition, high-capacity ammunition magazines, and other accessories through its point-of-sale Round-Up Program–thus directly profiting by selling a product that kills about 30,288 people a year.

  • Firearms made indiscriminately available through NRA lobbying have filled hospitals–such as those in Aurora–with casualties, and have thus badly strained the states’ public healthcare systems.

It will take a series of highly expensive and well-publicized lawsuits to significantly weaken the NRA, financially and politically.

The first ones will have to be brought by the surviving victims of gun violence–and by the friends and families of those who did not survive it.  Only they will have the courage and motivation to take such a risk.

As with the cases first brought against tobacco companies, there will be losses.  And the NRA will rejoice with each one.

But, in time, state Attorneys General will see the clear parallels between lawsuits filed against those who peddle death by cigarette and those who peddle death by armor-piercing bullet.

And then the NRA–like the tobacco industry–will face an adversary wealthy enough to stand up for the rights of the gun industry’s own victims.

TRAYVON’S REAL KILLER: THE NRA (PART TWO OF THREE)

Among the major accomplishments of the National Rifle Association:

  • In July, 2005, George Zimmerman was arrested for shoving a police officer during an underage drinking raid. The charges were dropped after he completed an alcohol education program. That same summer, his ex-fiancée filed a restraining order against him, alleging that Zimmerman hit her.
  • Yet he was allowed to carry a loaded, hidden handgun as a Florida resident–under the 2005 “Stand Your Ground” law the NRA had rammed through the legislature.
  • Under that law: A Concealed Carry Permit is revoked only if a gun owner is convicted of a felony.  It is not suspended if he’s being investigated for a felony.  It is suspended only if he is actually charged.

  • On February 26, 2012, Zimmerman shot unarmed, 17-year-old Trayvon Martin, who was wearing a “hoodie.”
  • In March, the NRA issued its own version of a “hoodie”–the Concealed Carry Hooded Sweatshirt, designed to hide firearms.  Selling on the NRA’s website for $60 to $65, it is advertised thusly:
  • “Inside the sweatshirt you’ll find left and right concealment pockets.  The included Velcro®-backed holster and double mag pouch can be repositioned inside the pockets for optimum draw.  Ideal for carrying your favorite compact to mid-size pistol, the NRA Concealed Carry Hooded Sweatshirt gives you an extra tactical edge, because its unstructured, casual design appears incapable of concealing a heavy firearm – but it does so with ease!”     http://www.nrastore.com/nrastore/ProductDetail.aspx?c=11&p=CO+635&ct=e

  • Anyone—including convicted criminals—can buy these “hide-a-gun” sweatshirts, putting both the public and law enforcers at deadly risk.
  • On July 13, 2013, a Florida jury found George Zimmerman not guilty of second-degree murder of Trayvon Martin–largely through the “Stand-Your-Ground” law the NRA had rammed through the Florida legislature.
  • The NRA often claims that law-abiding citizens defend themselves with guns millions of times every year. But the FBI has determined that, of the approximately 11,000 gun homicides every year, fewer than 300 are justifiable self-defense killings.
  • The NRA supports loopholes that allow criminals to buy guns without background checks, or allow terrorists to buy all the AK-47s they desire.
  • In 2012, the NRA’s executive vice president, Wayne LaPierre, said the NRA was “all in” to defeat Barack Obama.  Yet the President has meekly signed legislation allowing guns to be brought into national parks and onto trains.  Since becoming Chief Executive, he has made no effort to curb gun violence.
  • High-capacity magazines were prohibited under the 1994 Federal Assault Weapons Ban.  It expired in 2004. The NRA–aided by the Bush administration and Republicans generally–easily overcame efforts to renew the ban.
  • Political scientist Robert Spitzer, author of the book The Politics of Gun Control, notes that since the passage of the 1993 Brady Handgun Violence Prevention Act and the assault weapons ban in 1994, state and national laws have been drifting toward more open gun access:
  • “In 1988, there were about 18 states that had state laws that made it pretty easy for civilians to carry concealed hand guns around in society. By 2011, that number is up to 39 or 40 states having liberalized laws, depending on how you count it, and the NRA has worked very diligently at the state level to win political victories there, and they’ve really been quite successful.”
  • On January 8, 2011, Democratic Rep. Gabrielle Giffords was shot in the head while meeting with constituents outside a,Tucson, Arizona, grocery store.  Also killed was Arizona’s chief U.S. District judge, John Roll, who had just stopped by to see his friend Giffords after celebrating Mass.  The total number of victims: 6 dead, 13 wounded.
  • “The NRA’s response to the Tucson shootings has been to say as little as possible and to keep its head down,” says Spitzer.  “And their approach even more has been to say as little as possible and to simply issue a statement of condolence to the families of those who were injured or killed and to wait for the political storm to pass over and then to pick up politics as usual.”
  • In the spring of 2012, the House Oversight Committee prepared to vote on whether to hold U.S. Attorney General Eric Holder in contempt for allegedly refusing to provide documents related to “Fast and Furious.”  This was an undercover operation launched by the Bush administration to track firearms being sold to Mexican drug cartels.
  • The NRA notified Congressional members that how they voted would reflect how the NRA rated them in “candidate evaluations” for the November elections.  This amounted to blatant extortion, since the NRA has long accused Holder of having an “anti-gun” agenda.

Summing up the current state of gun politics in America, the April 21, 2012 edition of The Economist noted:

“The debate about guns is no longer over whether assault rifles ought to be banned, but over whether guns should be allowed in bars, churches and colleges.”

That is precisely the aim of the NRA–an America where anyplace, anytime, can be turned into the O.K. Corral.

So what should the surviving victims of gun violence do to seek redress?  And how can the relatives and friends of those who don’t survive seek justice for those they loved?

TRAYVON’S REAL KILLER: THE NRA (PART ONE OF THREE)

On September 11, 2001, Islamic terrorists snuffed out the lives of 3,000 Americans in New York, Washington, D.C. and Pennsylvania.

But within less than a month, American warplanes began carpet-bombing Afghanistan, whose rogue Islamic “government” refused to surrender Osama bin Laden, the mastermind of the attacks.

By December, the power of the Taliban was broken–and bin Laden was driven into hiding in Pakistan.

For more than ten years, the United States–through its global military and espionage networks–has relentlessly hunted down most of those responsible for that September carnage.

On May 1, 2011, U.S. Navy SEALS invaded bin Laden’s fortified mansion in Abbottabad, Pakistan–and shot him dead.

Now, consider these statistics of death, supplied by the Brady Campaign to Prevent Gun Violence:

Every day–365 days a year

  • 270 people in America, 47 of them children and teens, are shot in murders, assaults, suicides, accidents and police intervention;
  • 87 people die from gun violence, 33 of them murdered;
  • 8 children and teens die from gun violence;
  • 183 people are shot, but survive their gun injuries;
  • 38 children and teens are shot, but survive their gun injuries.

And what does all of this add up to?

  • In one year, almost 100,000 people in America are shot in murders, assaults, suicides, accidents, or by police intervention.
  • Over a million Americans have been killed with guns since 1968, when Dr.  Martin Luther King, Jr. and Robert F. Kennedy were assassinated.
  • U.S. homicide rates are 6.9 times higher than rates in 22 other populous high-income countries combined, despite similar non-lethal crime and violence rates.  The firearm homicide rate in the U.S. is 19.5 times higher.
  • Gun violence impacts society in numerous ways: medical costs; costs of the criminal justice system; security precautions; and reductions in quality of life owing to fear of gun violence.
  • An estimated 41% of gun-related homicides would not occur under the same circumstances had no guns been present.

(This average annual estimated composite picture of gun violence is based on death certificates and estimates from emergency room admissions.)

And who, more than anyone (including the actual killers themselves) has made all this carnage possible?

The National Rifle Association, of course.

But unlike the leadership of Al Qaeda, that of the NRA is not simply known, but celebrated.

Its director, Wayne LaPierre, is courted as a rock star by Democrats and Republicans seeking NRA endorsements–and campaign contributions.

He frequently appears as an honored guest at testimonial dinners and political conventions.

The largest of the 13 national pro-gun groups, the NRA has nearly 4 million members, who focus most of their time lobbying Congress for unlimited “gun rights.”

The NRA claims that its mission is to “protect” the Second Amendment to the United States Constitution, which states:

“A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

NRA members conveniently ignore the first half of that sentence: “A well regulated Militia, being necessary to the security of a free State….”

For the NRA, the Second Amendment is the Constitution, and the rest of the document is a mere appendage.

At the time Congress ratified the Constitution in 1788, the United States was not a world power.  Only after World War II did the country maintain a powerful standing army during peacetime.

But World War II ended 68 years ago, and today the United States is a far different country than it was in 1788:

  • It boasts a nuclear arsenal that can turn any country into thermonuclear ash–anytime an American President decides to do so.
  • It boasts an Army, Navy, Air Force and Marine Corps that can target any enemy, anywhere in the world.
  • Its Special Forces–Green Berets, Delta Force and Navy SEALS–are rightly feared by international terrorists.
  • If a criminal flees or conducts business across state lines, powerful Federal law enforcement agencies–such as the FBI and Drug Enforcement Administration–can put him out of business.

But apparently the NRA hasn’t gotten the word.

  • The NRA has steadfastly defended the right to own Teflon-coated “cop killer” bullets,” whose only purpose is to penetrate bullet-resistant vests worn by law enforcement officers.

  • The NRA and its lobbying arm, the Institute for Legislative Action, is responsible for the “Stand-Your-Ground” ordinances now in effect in more than half the states. These allow for the use of deadly force in self-defence, without any obligation to attempt to retreat first.
  • The NRA rushed to the defense of accused murderer George Zimmerman, the self-appointed “community watchman” who  ignored police orders to stop following 17-year-old Trayvon Martin and ended up shooting him to death.
  • Police did not initially charge Zimmerman because of Florida’s “Stand-Your-Ground” law, which the NRA had rammed through the legislature.
  • The same “Stand-Your-Ground” law will play a major role in the coming trial of Michael Dunn, a white software engineer, for the first-degree murder of Jordan Davis.  The shooting occurred on November 23, 2012, in Jacksonville, Florida.
  • Dunn claimed that he argued with three young black men over the volume of their music in their SUV.  He said that he saw a shotgun appear in one of the SUV’s windows and he fired his handgun eight or nine times before fleeing.
  • Three of Dunn’s bullets killed Davis.  Police said that the men in the SUV were unarmed.

GUNS + ALCOHOL = DEAD BODIES

On July 23, North Carolina lawmakers approved a bill that allows those with concealed-carry weapons permits:

  • To bring firearms into bars and restaurants serving alcohol–so long as the owner doesn’t object.
  • To store weapons in locked cars on the campus of any public school or university.
  • To bring guns onto greenways, playgrounds and other public recreation areas.

The Republican-supported bill was approved by both the House and Senate.  It now heads to Republican Governor Pat McCrory, who is expected to sign it into law.

Now think:

  • You’re mixing high-octane alcohol with high-powered firearms.
  • You’re allowing weapons to be legally stored in parked cars–which can easily be broken into.
  • You’re allowing firearms to be brought onto playgrounds filled with children.

What could possibly go wrong?

The National Rifle Association (NRA)–which backed the measure–will celebrate a return to an era “when men were men” and every argument threatened to become a shootout.

But not everyone in the Old West welcomed the indiscriminate right to carry and use firearms within town.  One of those was the legendary lawman, James Butler “Wild Bill” Hickok.

Contrary to popular belief, Hickok actualy didn’t spend most of his life as a town marshal.  His gunslinging days as a lawman lasted just two years–1869 to 1871.

His first stint as a lawman came at Hays City, Kansas.  As sheriff, he shot and killed at least two men. One of these shootings occurred when Hickok, looking in a bar mirror, saw a ruffian named Strawhan pull a pistol to shoot him in the back.

Hickok, looking into the mirror, threw a “trick shot” over his shoulder–and nailed Strawhan dead.

Then Hickok’s luck ran out.  On July 17, 1870, several members of the 7th U.S. Cavalry attacked him in Drum’s Saloon. Drawing his pistols, he killed one private and wounded another.

Although he had acted in self-defense and the shootings were entirely justifiable, Hickok now faced danger from other, enraged members of the same regiment.  He decided to leave Hays before they could take their revenge.

His next posting as town marshal came in Abilene, Kansas.  This stint lasted from April to December, 1871.  And, like his last one as a “town-tamer,” it ended with a deadly shootout.

A major portion of his duties lay in enforcing the “no firearms worn or used in town” edict.

Abilene was a cattle town, the end of the line for many outfits seeking a major railhead where their hundreds of beeves could be dropped off and shipped eastward.

When cowboys–most of them in their teens or early 20s–reached Abilene, they wanted to celebrate.  Their long drive was over, and now they could finally get paid.  And there were plenty of bars and whores waiting to pick up their newly-issued monies.

This combination of randy men and ready supplies of alcohol and women often led to trouble.  One cowboy might make a pass at another’s “lady” for the night.  Or an argument might erupt over a card game.

It was Hickok’s duty to make sure that such arguments were settled only with fists.  And that meant demanding that all cowboys’ guns be checked at the marshal’s office until the “boys” were ready to leave Abilene.

This, of course, contradicts the “open carry” demands of the NRA.  And most of its members–if transported to the Old West–would find themselves on the wrong side of Hickok.

And that wasn’t a good place to be–as Texas gambler Phil Coe learned to his dismay.

Coe and Hickok had clashed before.  As co-owner of the Bull’s head Saloon, Coe had advertised its wares with a sign depicting a bull with oversized sexual organs.   A number of citizens raged that this was obscene and demanded that the animal’s sexuality be greatly reduced.  The city fathers agreed.

Hickok stood nearby with a shotgun while a painter made the necessary deletions.

On October 5, 1871, cowboys were flooding into Abilene, looking for a good time.  Coe, feeling in high spirits, decided to celebrate by firing his pistol into the air several times.

The shots quickly brought Hickok to the scene.

“Did you fire that shot?” Hickok demanded.

Coe supposedly replied: “I shot at a dog–and I’ll shoot at another.”

Coe threw a shot at Hickok, which missed.

Hickok whipped out his two revolvers and put two bullets into Coe’s stomach, mortally wounding the Texan, who died three days later.

With Coe’s Texas buddies surrounding him, Hickok suddenly heard someone rushing at him from behind.

Hickok whirled and fired twice more–into the chest of his own deputy, Mike Williams, who had been running to his aid.

Hickok, aghast at his mistake, gently carried Williams into a saloon and placed his body onto a billiard table.  Then he raged through Abilene, ordering an end to the festivities and knocking down any cowboys foolish enough to resist.

Owing to this latest explosion in violence, the city fathers quickly reached two decision:

First, they put an end to Abilene’s years as a major cattle shipping point.  From now on, cattlemen were no longer welcome there.

And then they fired Hickok as city marshal in December, 1871.

CNN BECOMES TNN: TRAYVON NEWS NETWORK

Since June 10, CNN has carried one story above all others: The trial of self-appointed “neighborhood watchman” George Zimmerman for the killing of 17-year-old Trayvon Martin.

On CNN, especially, the coverage of this trial has been overwhelming.

So much so that CNN–Cable News Network–could rightly be called TNN–Trayvon News Network.

There are several reasons for this, and they say as much–if not more–about the media as they do about the case itself.

First, there was a dead body in the story–the body of Travon Martin.  There’s a well-known saying in the news business: “If it bleeds, it leads.”  And nothing bleeds like the body of a dead teenager.

Second, the victim was not only dead, he was black.

Third, he died at the hands of a nominally-white man–George Zimmerman, the offspring of a German father and a Peruvian mother.

Although the vast majority of blacks in the United States are murdered by other blacks, it’s Politically Incorrect to say so.  On the other hand, it’s perfectly OK to create the impression that whites pose the greatest danger to blacks.

Fourth, the trial was televised.  There was absolutely no need for this.  It didn’t threaten to overturn existing law–as did Brown v. Board of Education, in which the Supreme Court struck down “separate but equal” public schools for blacks and whites.

This case proved the opening legal salvo in the history of the civil rights movement and ushered in a decade of activism and bloodshed as blacks sought to de-segregate the South.

Nor did the Zimmerman case even carry the weight of the 1985-6 Mafia Commission trial.  There Federal prosecutors convicted the heads of the five most powerful Mafia “families” in the country and sent them to prison.

While individual Mafiosi had been sent to prison, this was the first time the top leadership of all major Mafia “families” had been virtually wiped out.

It signaled a turning point in the fight against organized crime, with Federal investigators and prosecutors finally learning how to use the 10-year-old Racketeer Influenced Corrupt Organization (RICO) Act to their advantage.

Fifth, televising the trial meant the networks–especially CNN–didn’t have to do anything.  They didn’t have to send reporters into the streets to dig up information.  All that was necessary was to let the camera show what was happening in the courtroom.

Sixth, when each day’s televised proceedings came to an end, CNN and other networks could easily round up a series of “talking heads” to pontificate on the meaning of it all. 

These people had no more idea than the average viewer of what impact–if any–that day’s events would have on the legal fate of George Zimmerman.

But it gave CNN a chance to use up airtime that could have otherwise gone on stories like the national debt, Detroit declaring bankruptcy and the Supreme Court rejecting an Arizona law requiring voters to prove their citizenship.

Seventh, the networks could count on a controversial outcome no matter what the verdict.

If Zimmerman were convicted, his white supporters would be outraged and his black detractors overjoyed.  And if Zimmerman were acquitted–which is what actually happened–then the opposite reactions would occur.

Either way, there was certain to be angry demonstrators in the street.  For the networks this would hopefully include a full replay of the race riots which shook the nation following the police beating of Rodney King in 1992 and the murder of Dr. Martin Luther King, Jr., in 1968.

Eighth, if rioting erupted, CNN and other networks would rush news cameras to the scenes of carnage and claim they were doing this “in the finest traditions of journalism” to keep the public fully informed.

In reality, they would be doing it to keep their ratings up.

If any of this seems familiar, it’s because–unfortunately–it is.

The 1995 O.J. Simpson trial set the standard for televised murder trials.

It came complete with a weak-kneed judge (Lance Ito), incompetent prosecutors (Christopher Darden and Marcia Clark), bizarre witnesses (Kato Kaelin) and grandstanding defense attorneys (Johnnie Cochran, F. Lee Bailey and Robert Kardashian).

The case seemed to go on forever.  The primary jury was sworn in on November 2, 1994.  Opening statements began on January 24, 1995, and the trial dragged on until a “Not Guilty” verdict came on October 3, 1995

For those who enjoy wallowing in sensationalism, the case offered everything:

  • Interracial marriage;
  • A famous has-been football player;
  • Sexually-charged domestic abuse (in this case, black-on-white/male-on-female violence);
  • A dead, beautiful blonde;
  • Two grisly murders (those of Simpson’s ex-wife, Nicole, and a waiter-friend of hers, Ronald Goldman);
  • Allegations by Simpson’s lawyers that he was the target of white, racist police.

Since then, television networks have repeatedly sought stories that promise to deliver the thrills–if not actual news value–of the Simpson case.

The George Zimmerman trial didn’t offer the ratings voltage of the Simpson one.  But the networks did their best to make it happen.
